5750 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 12 O.S. 2021, Section 759, is
5952 amended to read as follows:
6053 Section 759. A. When a general execution is issued and p laced
6154 in the custody of a sheriff for levy, a certified copy of the
6255 execution shall be filed i n the office of the county clerk of the
6356 county whose sheriff holds the execution and shall be indexed in the
6457 same manner as judgments. At the time the execution is filed, the
6558 court clerk shall collect from the party seeking a general execution
6659 all fees necessary for the paym ent of the disinterested p ersons or a
60+legal entity for services in appraising the subject property
61+pursuant to the requirements of subsection B of this section.

94-legal entity for services in appraising the subject property
95-pursuant to the requirements of subsection B of this section.
9688 B. If a general or special execution is levied upon lands and
9789 tenements, the sheriff shall end orse on the face of the wr it the
9890 legal description and shall have three disinterested persons who
9991 have taken an oath to impartially appraise t he property levied on or
10092 a legal entity which has provided a written affidavit of
10193 impartiality, upon actual view; and the disinterested pers ons or
10294 legal entity shall return to the officer a signed estimate of the
10395 real value of the property. If an estimate is obtained from a
10496 disinterested legal entity, such estimate shall be developed by the
10597 legal entity using at leas t three independent, credi ble sources,
10698 each of which has estimated the real value of the subject property
10799 independently. The disinterested pe rsons or legal entity shall be
108100 paid for such services by the court clerk of the county where t he
109101 property is located within thirty (30) days of the date that they
110102 return their estimate of the real value of the property. If three
111103 disinterested persons or a disinterested legal entity are not
112104 available to appraise the property, the sheriff may use th e market
113105 value of the property, not the assessed value, in a county where the
114106 market value is included on the public re cord in the office of the
115107 county assessor. The sheriff shall be pai d an administrative fee of
116108 Fifty Dollars ($50.00) if the market value is obtained from the
117109 county assessor.

145-C. To extend a judgment lien beyond the initial or any
146-subsequent statutory period, prior to the expiration of such period,
147138 a certified copy of o ne of the following must be filed and indexed
148139 in the same manner as judgments in the office of t he county clerk in
149140 the county in which the statement of judgment was filed and the lien
150141 thereof is sought to be retained:
151142 1. A general execution upon the judgm ent;
152143 2. A notice of renewal of judgment;
153144 3. A garnishment summons issued against the judgment debtor; or
154145 4. A notice of income assignment sent to a payor of the
155146 judgment debtor.
156147 SECTION 2. This act shall become effecti ve November 1, 2022.
