16	46		amending 19 O.S. 2011, Section 901.7, which relates
17	47		to the powers and duties of the directors;
18	48		authorizing the acquisition of certain certification
19	49		or license; providing for certain contract;
20	50		authorizing response outside certain boundaries with
21	51		certain documentation; and providing an effective

29	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	58		SECTION 1. AMENDATORY 19 O.S. 2011, Section 901.7, is
32	59		amended to read as follows:
33		-
34	60		Section 901.7. A. The board of directors shall have the po wer
35	61		and duty to:
36		-
37	62		1. Manage and conduct the business affairs of such district;
38		-
39	63		2. Make and execute all necessary contracts;

41	64		3. Purchase or lease -purchase and maintain all necessary and
42	65		convenient engines, hoses, hose carts or other appliances and
43	66		supplies for the full equipment of a fire company or department;

45	94		4. Appoint fire company officers and employees, sufficient to
46	95		maintain and operate the equipment owned by such district;

50	96		5. Take by grant, purchase, condemnation, gift, devise or
51	97		lease, and to dispose of, real or personal property of every kind
52	98		necessary for the operation of the district;

54	99		6. Construct or otherwise acquire suitable firehouses and other
55	100		buildings or structures suitable for the housing of equipment and
56	101		supplies of the district, or fo r carrying on its own business and
57	102		affairs;

59	103		7. Employ such officers and employees as may be required, fix
60	104		their compensation and prescribe their duties;
61		-
62	105		8. Establish rules and regulations for the district and for the
63	106		prevention of fires and conflagration s within the district and for
64	107		the protection of property at and during any fire;

66	108		9. Prepare an annual budget and follow existing laws pertaining
67	109		to the budget process such as public notices, public hearings,
68	110		protest periods and filing requirements in the same manner as they
69	111		apply to other forms of government in Oklahoma;

71	112		10. Determine vacancies of the board of directors, fill
72	113		vacancies and conduct board elections in the event of a vacancy on
73	114		the board of directors;

75	115		11. Develop bylaws for the due and orde rly administration of
76	116		the affairs of the board of directors and for its responsibilities
77	117		specified pursuant to this chapter, and may compel the attendance of

78	145		absent members in the manner and under penalties as the board may
79	146		prescribe; and

81	147		12. Do any and all other things necessary and proper in the
82	148		management and operation of the district for the purpose of
83	149		protecting property within its boundaries from fire.

85	150		B. A fire protection district, created pursuant to this
86	151		chapter, shall be deemed a political subdi vision of this state. The
87	152		board may submit an application to include the fire fighters of the
88	153		district in the Oklahoma Firefighters Pension and Retirement System.
89	154		The application for affiliation shall be submitted in accordance

92	155		with subsection A of Secti on 49-105.2 of Title 11 of the Oklahoma
93	156		Statutes.

95	157		C. The Board of Directors may acquire a certification or
96	158		license to operate an emergency medical services agency from the
97	159		State Department of Health or contract for services with a certified
98	160		or licensed emergency medical service agency. The district ’s
99	161		emergency medical service agency may respond outside of the district
100	162		boundaries; provided, that the political subdivisions having
101	163		jurisdiction over the area provide to the Department proper
102	164		documentation of their support.

104	165		SECTION 2. This act shall become effective November 1, 2021.
