27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 22 O.S. 2021, Section 152, is
30	57		amended to read as follows:

32	58		Section 152. A. Prosecutions for the crimes of bribery,
33	59		embezzlement of public money, bonds, securities, assets or property
34	60		of the state or any coun ty, school district, municipality or other
35	61		subdivision thereof, or of any misappropri ation of public money,
36	62		bonds, securities, assets or property of the state or any county,
37	63		school district, municipality or other subdivision thereof,
38	64		falsification of publi c records of the state or any county, school
39	65		district, municipality or other subdivis ion thereof, and conspiracy

40	93		to defraud the State of Oklahoma or any county, school district,
41	94		municipality or other subdivision thereof in any manner or for any
42	95		purpose shall be commenced within seven (7) years after the
43	96		discovery of the crime; provided, ho wever, prosecutions for the
44	97		crimes of embezzlement or misappropriation of public money, bonds,
45	98		securities, assets or property of any school district, including
46	99		those relating to student activity funds, or the crime of

49	100		falsification of public records of any independent school district,
50	101		the crime of criminal conspiracy, the crime of embezzlement pursuant
51	102		to Sections 1451 through 1461 of Title 21 of the Oklahoma Statutes,
52	103		the crime of False Personation or Identity Theft pursu ant to
53	104		Sections 1531 through 1533.3 of Title 21 of the Oklahoma Statutes,
54	105		the financial exploitation of a vulnerable adult pursuant to
55	106		Sections 843.1, 843.3 and 843.4 of Title 21 of the Oklahoma
56	107		Statutes, or Medicaid fraud pursuant to Section 1005 of Title 56 of
57	108		the Oklahoma Statutes, shall be commenced within five (5) years
58	109		after the discovery of the crime.

60	110		B. Prosecutions for criminal violations of any state income tax
61	111		laws shall be commenced within five (5) years after the commission
62	112		of such violation.

64	113		C. 1. Prosecutions for sexual cri mes against children,
65	114		specifically rape or forcible sodomy, sodomy, lewd or indecent
66	115		proposals or acts against children, involving minors in pornography
67	116		pursuant to Section 886, 888, 1111, 1111.1, 1113, 1114, 1021.2,

68	144		1021.3, 1040.12a or 1123 of Title 21 of the Oklahoma Statutes, child
69	145		abuse pursuant to Section 843.5 of Title 21 of the Oklahoma
70	146		Statutes, and child trafficking pursuant to Section 866 of Title 21
71	147		of the Oklahoma Statutes shall be commenced by the forty -fifth
72	148		birthday of the alleged victim. Pr osecutions for such crimes
73	149		committed against victims eighteen (18) years of age or older shall
74	150		be commenced within twelve (12) years after the discovery of the
75	151		crime. As used in this paragraph, “discovery” means the date that a
76	152		physical or sexually related c rime involving a victim eighteen (18)
77	153		years of age or older is reported to a law enforcement agency.

79	154		2. However, prosecutions for the crimes listed in paragraph 1
80	155		of this subsection may be commenced at any time after the commission
81	156		of the offense if:
82		-
83	157		a. physical evidence is collected and preserved that is
84	158		capable of being tested to obtain a profile from
85	159		deoxyribonucleic acid (DNA), and
86		-
87	160		b. the identity of the offender is subsequently
88	161		established through the use of a DNA profile using
89	162		evidence listed in subp aragraph a of this paragraph.

93	163		A prosecution under this exception must be commenced within
94	164		three (3) years from the date on which the identity of the suspect
95	165		is established by DNA testing.

97	193		3. No prosecution under this subsection shall be based upon the
98	194		memory of the victim that has been recovered through psychotherapy
99	195		unless there is some evidenc e independent of such repressed memory.

101	196		4. Any person who knowingly and wil lfully makes a false claim
102	197		pursuant to this subsection or a claim that the person knows lacks
103	198		factual foundation may be reported to local law enforcement for
104	199		criminal investigation and, upon conviction, shall be guilty of a
105	200		felony.

107	201		D. Prosecutions for criminal violations of any provision of the
108	202		Oklahoma Wildlife Conservation Code shall be co mmenced within three
109	203		(3) years after the commission of such offense.
110		-
111	204		E. Prosecutions for the crime of criminal fraud or workers ’
112	205		compensation fraud pursuant to Section 1541.1, 1541.2, 1662 or 1663
113	206		of Title 21 of the O klahoma Statutes shall commence within three (3)
114	207		years after the discovery of the crime, but in no event greater than
115	208		seven (7) years after the commission of the crime.

117	209		F. Prosecution for the crime of false or bogus check pursuant
118	210		to Section 1541.1, 1541. 2, 1541.3 or 1541.4 of Title 21 of the
119	211		Oklahoma Statutes shall be commenced within five (5) years after the
120	212		commission of such offense.

122	213		G. Prosecution for the crime of solicitation fo r murder in the
123	214		first degree pursuant to Section 701.16 of Title 21 of t he Oklahoma
124	215		Statutes shall be commence d within seven (7) years after the
125	216		discovery of the crime. For purposes of this subsection,

129	246		H. In all other cases a prosecution for a public offense must
130	247		be commenced within three (3) years after its commission.

132	248		I. Prosecution for the crime of accessory after the fact must
133	249		be commenced within the same statute of limitations as that of the
134	250		felony for which the person acted as an access ory.

138	251		J. Prosecution for the crime of arson pursuant to Section 1401,
139	252		1402, 1403, 1404 or 1405 of Title 21 of the Oklahoma Statutes shall
140	253		be commenced within seven (7) years after the commission of the
141	254		crime.

143	255		K. Prosecutions for criminal violations in whi ch a deadly
144	256		weapon is used to commit a felony or prosecutions for criminal
145	257		violations in which a deadly weapon is used in an attempt to commit
146	258		a felony shall be commenced within seven (7) years after the
147	259		commission of the crime.

149	260		L. No prosecution under su bsection C of this section shall be
150	261		based upon the memory of the victim that has been recovered through
151	262		psychotherapy unless there is some evidenc e independent of such
152	263		repressed memory.

160	296		M. As used in paragraph 1 of subsection C of thi s section,
161	297		“discovery” means the date that a physical or sexually related crime
162	298		involving a victim eighteen (18) years of age or older is reported
163	299		to a law enforcement agency. Prosecutions for the crime of human
164	300		trafficking pursuant to Section 748 of Title 21 of the Oklahoma
165	301		Statutes shall be commenced within three (3) years after discovery
166	302		of the crime. For purposes of this subsec tion, “discovery” means
167	303		the date upon which the crime is reported to a law enforcement
168	304		agency.

170	305		SECTION 2. This act shall become effective November 1, 2022.
