8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.3, as
8585 amended by Section 2, Chapter 266, O.S.L. 2014 (51 O.S . Supp. 2020,
8686 Section 24A.3), is amend ed to read as follows:
8787 Section 24A.3. As used in the Oklahoma Open Records Act:
8888 1. “Record” means all documents, including, but not limited to,
8989 any book, paper, photograph, microfilm, data fi les created by or
9090 used with computer software, computer tape, d isk, record, sound
9191 recording, film recording, video record or other material regardless

144144 the authority of, or coming into the c ustody, control or possession
145145 of public officials, public bodie s, or their representatives in
146146 connection with the transaction of public business, the expenditure
147147 of public funds or the administering of public property. “Record”
148148 does not mean:
149149 a. computer software,
150150 b. nongovernment persona l effects,
151151 c. unless public disclosure is required by other laws or
152152 regulations, vehicle movement records of the Oklahoma
153153 Transportation Authority obtained in connection with
154154 the Authority’s electronic toll collection syst em,
155155 d. personal financial informat ion, credit reports or
156156 other financial data obtained by or submitted to a
157157 public body for the purpose of evaluating credit
158158 worthiness, obtaining a license, permit, or for the
159159 purpose of becoming qualified to contract with a
160160 public body,
161161 e. any digital audio/video recordings of the tol l
162162 collection and safeguarding activities of the Oklahoma
163163 Transportation Authority,
164164 f. any personal information provided by a guest at any
165165 facility owned or operated by the Oklahoma Tourism and
166166 Recreation Department or the Board of Trustees of the

220220 purchaser of a product sold by or through the Oklahoma
221221 Tourism and Recreation Department or the Q uartz
222222 Mountain Arts and Conference Center and Nature Park,
223223 g. a Department of Defense Form 214 (DD Form 214) filed
224224 with a county clerk, including any DD Form 214 filed
225225 before July 1, 2002, or
226226 h. except as provided for in Section 2 -110 of Title 47 of
227227 the Oklahoma Statutes,
228228 (1) any record in connection with a Motor Vehi cle
229229 Report issued by the Department of Public Safety,
230230 as prescribed in Section 6 -117 of Title 47 of the
231231 Oklahoma Statutes, or
232232 (2) personal information within driver records, as
233233 defined by the Driver’s Privacy Protection Act,
234234 18 United States Code, Sections 2721 through
235235 2725, which are stored and maintained by the
236236 Department of Public Safety; or
237237 i. any information provided to a state agency or entity
238238 that will be utilized to provide a license or
239239 certificate to an individual including, but not
240240 limited to, an applicant’s personal address, phone
241241 number, other contact information or any other

294294 license or certificate. Provided, however, the
295295 license or certificate shall be a public record.
296296 2. “Public body” shall include, but not be limited to, any
297297 office, department, board, bureau, commission, agency, trusteeship,
298298 authority, council, committee, trust or any entity cr eated by a
299299 trust, county, city, village, town, township, district, school
300300 district, fair board, court, executive offic e, advisory group, task
301301 force, study group, or any subdivision thereof, supported in whole
302302 or in part by public funds or entrusted with th e expenditure of
303303 public funds or administering or operating public property, and all
304304 committees, or subcommittees ther eof. Except for the records
305305 required by Section 24A.4 of this title, “public body” does not mean
306306 judges, justices, the Council on Judicia l Complaints, the
307307 Legislature, or legislators;
308308 3. “Public office” means the physical location where public
309309 bodies conduct business or keep records;
310310 4. “Public official” means any official or employee of any
311311 public body as defined herein; and
312312 5. “Law enforcement agency” means any public body charged with
313313 enforcing state or local criminal laws and initiating criminal
314314 prosecutions, including, but not limited to, police departments,
315315 county sheriffs, the Department of Public Safety, the Oklahoma State
316316 Bureau of Narcotics and Dangerou s Drugs Control, the Alcoholic

370370 SECTION 2. AMENDATORY 51 O.S. 2011, Section 24A.7, as
371371 amended by Section 1, Chapter 130, O.S.L. 2014 (51 O.S. Supp. 2020,
372372 Section 24A.7), is amended to rea d as follows:
373373 Section 24A.7. A. A At the sole discretion of the public body,
374374 a public body may keep personnel records confidential:
375375 1. Which relate to internal personnel inv estigations including
376376 examination and selection material for employment, hiring,
377377 appointment, promotion, dem otion, discipline, or resignation; or
378378 2. Where disclosure would constitute a clearly unwarranted
379379 invasion of personal privacy such as employee eval uations, payroll
380380 deductions, employment applications submitted by persons not hi red
381381 by the public body, and transcripts from instit utions of higher
382382 education maintained in the personnel files of certified public
383383 school employees; provided, however, that no thing in this subsection
384384 shall be construed to exempt from disclosure the degree obtained and
385385 the curriculum on the transcripts of certified public school
386386 employees.
387387 B. All personnel records not specifically falling within the
388388 exceptions provided in subse ction A of this section shall be
389389 available for public inspection and copying inc luding, but not
390390 limited to, records of:

442442 1. An employment application of a person who becomes a public
443443 official;
444444 2. The gross receipts of public funds;
445445 3. The dates of employ ment, title or position; and
446446 4. Any final disciplinary action resulting in loss of pay,
447447 suspension, demotion of position, or termination.
448448 C. Except as may otherwise be made confidential by statute, an
449449 employee of a public body shall have a right of acces s to his own
450450 personnel file.
451451 D. Public bodies shall keep confidential the home address,
452452 telephone numbers and social security numb ers of any person employed
453453 or formerly employed by the public body.
454454 E. Except as otherwise required by Section 6 -101.16 of Title 70
455455 of the Oklahoma Statutes, public bodies shall keep confidential all
456456 records created pursuant to the Oklahoma Teacher and Le ader
457457 Effectiveness Evaluation System (TLE) which identify a current or
458458 former public employee and contain any evaluation, obs ervation or
459459 other TLE record of such employee.
460460 SECTION 3. AMENDATORY 51 O.S. 2011, Section 24A.10, as
461461 last amended by Section 1, Chapter 197, O.S.L. 2018 (51 O.S. Supp.
462462 2020, Section 24A.10), is amended to read as follows:
463463 Section 24A.10. A. Any information, records or other material
464464 heretofore voluntarily supplied to any state agency , board or

516516 commission shall be subject to full disclosure pursuant to Section
517517 24A.1 et seq. of this title.
518518 B. If disclosure would give an unfair advantage to competitors
519519 or bidders, a public body may keep confidential records r elating to:
520520 1. Bid specifications for competitive bidding prior to
521521 publication by the public body; or
522522 2. Contents of sealed bids prior to the opening of bids by a
523523 public body; or
524524 3. Computer programs or software but not data thereon; or
525525 4. Appraisals relating to the sale or acqui sition of real
526526 estate by a public body prior to award of a contract; or
527527 5. The prospective location of a private business or industry
528528 prior to public disclosure of such prospect except for records
529529 otherwise open to inspection s uch as applications for perm its or
530530 licenses.
531531 C. Except as set forth hereafter, the Oklahoma Department of
532532 Commerce, the Oklahoma Department of Career and Technology
533533 Education, the technology center school districts, the Oklahoma Film
534534 and Music Office, ins titutions within the Oklahom a State System of
535535 Higher Education, and the Department of Corrections may keep
536536 confidential:
537537 1. Business plans, feasibility studies, financing proposals,
538538 marketing plans, financial statements or trade secrets submitted by

590590 a person or entity seeking econom ic advice, business dev elopment or
591591 customized training from such Departments or school d istricts;
592592 2. Proprietary information of the business submitted to the
593593 Department or school districts for the purpose of business
594594 development or customized training, an d related confidentiali ty
595595 agreements detailing the information or records designated as
596596 confidential; and
597597 3. Information compiled by such Departments or school districts
598598 in response to those submissions.
599599 The Oklahoma Department of Commerce, the Oklahoma D epartment of
600600 Career and Technology Education, the technology center school
601601 districts, the Oklahoma Film and Music Office, institutions within
602602 the Oklahoma State System of Higher Education , and the Department of
603603 Corrections may not keep confidential that su bmitted information
604604 when and to the extent the person or entity submitting the
605605 information consents to disclosure.
606606 D. Although they must provide public access to their records ,
607607 including records of the address, rate paid for se rvices, charges,
608608 consumption rates, adjustments to the bill, reasons for adjustment,
609609 the name of the person that aut horized the adjustment, and payment
610610 for each customer, public bodies that provide utility services to
611611 the public may shall keep confidential and shall redact from any
612612 record, personal email a ddresses, credit information, credit card
613613 numbers, telephone numbers, social sec urity numbers, bank account

665665 information for individ ual customers, and any portion of any record
666666 that contains the name or any other identifier of the occupants of
667667 any residential structure. Public bodies that provide utility
668668 services to the public may keep confidential utility supply and
669669 utility equipment supply contracts for any industrial customer with
670670 a connected electric lo ad in excess of two thousand five hundred
671671 (2,500) kilowatts if public access to such contracts would give an
672672 unfair advantage to competitors of the customer; provided that,
673673 where a public body performs billing or collection services for a
674674 utility regulated by the Corporation Commissi on pursuant to a
675675 contractual agreement, any customer or individual payment data
676676 obtained or created by the public body in performance of the
677677 agreement shall not be a record for purposes of this act the
678678 Oklahoma Open Records Act.
679679 SECTION 4. This act shall become effective November 1, 2021.
