50 | 55 | | SECTION 1. The Secretary of State shall refer to the people fo r |

51 | 56 | | their approval or rejection, as and in the manner provided by law, |

52 | 57 | | the following proposed amendment to the Oklahoma Consti tution by |
---|
53 | 58 | | adding a new Section 2A to Article II to read as follows: |

54 | 59 | | Section 2A. A. It being necessary for the liberty of free |
---|
55 | 60 | | persons, the rights of unborn persons shall be equal to the right s |
---|
56 | 61 | | of born persons. The State of Oklahoma finds that: |
---|
57 | 62 | | 1. The life of each person begins at conception; |
---|
87 | 93 | | 3. The natural parents of unborn persons have protectable |
---|
88 | 94 | | interests in the life, liberty , and the pursuit of happiness of |
---|
89 | 95 | | their unborn child. |

90 | 96 | | B. As used in this section: |

91 | 97 | | 1. “Abortion” means the use or prescription of any instrument, |
---|
92 | 98 | | medicine, drug, or any other substance or device intentionally to |
---|
93 | 99 | | terminate the pregnancy of a female known to be pregnant with an |
---|
94 | 100 | | intention other than to increase the probab ility of a live birth, to |
---|
95 | 101 | | preserve the life or health of the child after live birth, to remove |
---|
96 | 102 | | an ectopic pregnancy, or to remove a dead unborn child who died as |
---|
97 | 103 | | the result of a spontaneous miscarriage, accidental traum a, or a |
---|
98 | 104 | | criminal assault on the pregn ant female or her unborn child ; and |
---|
99 | 105 | | 2. “Unborn person” means the unborn offspring of human beings |
---|
100 | 106 | | from the moment of conceptio n, through pregnancy and until live |
---|
101 | 107 | | birth including the human conc eptus, zygote, morula, blastocyst, |
---|
102 | 108 | | embryo, and fetus. |
---|
103 | 109 | | C. 1. Consistent with Amendments V and XIV of the Un ited |
---|
104 | 110 | | States Constitution including but not limited to the Equal |
---|
105 | 111 | | Protection Clause of Amendment XIV of the United States Constitution |
---|
106 | 112 | | and the Due Process Clauses of Amendments V and XIV of the United |
---|
107 | 113 | | States Constitution, and pursuant to powers reserved to t his state |
---|

138 | 145 | | this state, in accordance with the Constitution of the United States |

140 | 147 | | 2. Nothing in this Constitution secures or protects the right |

141 | 148 | | to perform or receive an abortion, nor shall any provision of this |

142 | 149 | | Constitution be construed to preclude, invalidate , or in any way |

143 | 150 | | limit a statute that prohibits abortion, regulates abortion , or |
---|
144 | 151 | | regulates abortion differently from other acts or procedures . |
---|
145 | 152 | | D. 1. No person in this state shall perform an abortion of an |
---|
146 | 153 | | unborn person in utero except as provided in paragraph 2 of this |
---|
147 | 154 | | subsection. |
---|
148 | 155 | | 2. The prohibition provided by paragraph 1 of this subsection |
---|
149 | 156 | | shall not apply to an abortion that is necessary to prevent the |
---|
150 | 157 | | death of a pregnant woman. The exception provided by this paragraph |
---|
151 | 158 | | shall not include an abortion performed solely on the basis of the |
---|
152 | 159 | | mental or emotional health of the pregnant woman. |
---|
153 | 160 | | E. Any person found guilty of performing an abortion in |
---|
154 | 161 | | violation of subsection D of this section shall, upon conviction, be |
---|
155 | 162 | | guilty of manslaughter in the first degree. |
---|
156 | 163 | | F. This section shall only apply to ab ortions performed in this |
---|
157 | 164 | | state. Nothing in this section shall be construed to affect an |
---|
186 | 194 | | G. Nothing in this section shall be inte rpreted as creating a |
---|
187 | 195 | | cause of action against a woman for indirectly harming her unborn |
---|
188 | 196 | | child by failing to properly care for herself or by failing to |
---|
189 | 197 | | follow any particular program of prenatal care. |
