BE IT RESOLVED BY THE SENATE A ND THE HOUSE OF REPRESENTATIVES OF THE 1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE: SECTION 1. The Secretary of State shall refer to the people for their approval or rejection, as and in the manner p rovided by law, the following proposed amendment to Section 4 of Article III of the Oklahoma Constitution to read as follows: Section 4. A. The Legislature shall prescribe the time and manner of holding and conducting all elections, and enact such laws as may be necessary to detect and punish fraud in such elections. The Legislature may provide by law for the registration of elec tors throughout the state and, when it is so provided, no person shall vote at any election unless he or she shall have registered according to law. The Legislature shal l prescribe the time and manner at which a qualified elector may request and submit an ab sentee ballot and have the ballot counted in the precinct in which he or she is properly registered, if on the occurrence of any election, the elector will be absent from his or her residence or otherwise unable to vote at the proper polling place because of: 1. An occupation or business of the elector that requires him or her to be elsewhere; 2. Illness or physical disability of the elector; 3. The observance of a r eligious holiday by the elector; or 4. Election day duties if the elector is a county employee. SECTION 2. The Ballot Title for the proposed Constitutional amendment as set forth in SECTION 1 of this resolution shall be in the following form: BALLOT TITLE Legislative Referendum N o. ____ State Question No. ____ THE GIST OF THE PROPOSITION IS AS FOLLOWS: This measure will amend Section 4 of Article 3 of the Oklahoma Constitution.
