7575 BE IT RESOLVED BY THE SEN ATE AND THE HOUSE OF RE PRESENTATIVES OF THE
7676 2ND SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
7777 SECTION 1. The Secretary of State shall refer to the people for
7878 their approval or rejection, as and in the mann er provided by law,
7979 the following proposed amendment to Sections 8D through 8F of
8080 Article X of the Oklahoma Constitution to read as follows:
8181 Section 8D. A. Despite any provision to the contrary,
8282 beginning January 1, 2009, each head of household veteran who has
8383 been honorably discharg ed from active service in any branch of the
8484 Armed Forces of the United States or Oklahoma National Guard and who
8585 has been certified by the United States Department of Veterans
8686 Affairs or its successor to have a one -hundred-percent (100%)
8787 permanent disability sustained through military action or accident

139139 or resulting from disease contracted while in such active service or
140140 the surviving spouse of such head of household veteran shall be
141141 entitled to claim an exemption for the full amount of all household
142142 personal property which is subject to ad valor em taxation and which
143143 is not subject to any form of taxation in lieu of ad valorem
144144 taxation.
145145 B. In order to be eligible for the exemption authorized by this
146146 section, the individual shall be required to prove residen cy within
147147 the State of Oklahoma.
148148 C. The Legislature shall be authorized to enact such laws as
149149 may be necessary in order to implement the exemption provided by
150150 this section; however, the exemption amount shall not be subject to
151151 modification by such enactme nts and shall be for the full amount of
152152 the valuation of any household personal property as otherwise
153153 prescribed by this section.
154154 Section 8E. A. Despite any provision to the contrary,
155155 beginning January 1, 2006, e ach head of household veteran who has
156156 been honorably discharged from active servic e in any branch of t he
157157 Armed Forces of the Uni ted States or Oklahoma National Guard and who
158158 has been certified by the United States Department of Veterans
159159 Affairs or its successor to have a one hundred percent (100%)
160160 permanent disability sustained through military action or a ccident
161161 or resulting from disease contracted while in such active service or
162162 the surviving spouse of such head of household veteran shall be

215215 value of the homestead.
216216 B. In order to be eligible for the exemption authorized by this
217217 section, the individual shall be required to prove residency within
218218 the State of Oklahoma and must have previous ly qualified for the
219219 homestead exemption authorize d by law or be eligible for the
220220 homestead exemption pursuant to law.
221221 C. If a homestead otherwise eligible for the exemption
222222 authorized by this section is transferred on or after January 1 of a
223223 calendar year, another homestead property acquired by the qual ifying
224224 head of household veteran or by the surviving spouse of such
225225 qualifying head of household veteran shall be exempt to the same
226226 extent as the homestead property previously owned by such person or
227227 persons for the year during which the new homestead is acquired and,
228228 subject to the requirements of this se ction, for each year
229229 thereafter.
230230 Section 8F. A. Despite any provision to the contrary, and
231231 except as otherwise provided by subsection D of this section,
232232 beginning January 1, 2015, the surviving spouse o f the head of
233233 household a servicemember who is determined by the United States
234234 Department of Defense or any branch of the United States military to
235235 have died while in the line of duty shall be entitled to claim an
236236 exemption for the full amount of the fair cash value of the
237237 homestead until such surviving spouse remarries.

289289 B. In order to be eligible for the exemption authorized by this
290290 section, the surviving spouse sh all be required to prove residency
291291 within the State of Oklahoma and must have previously qua lified for
292292 the homestead exempti on authorized by law or be eligible for the
293293 homestead exemption pursuant to law.
294294 C. If a homestead otherwise eligible for the exemp tion
295295 authorized by this section is transferred on or after January 1 of a
296296 calendar year, another homestead property acquired by the surviving
297297 spouse shall be exempt to the same extent as the homestead property
298298 previously owned by such person for the year d uring which the new
299299 homestead is acquired and, subject to the requirements of this
300300 section, for each year thereafter.
301301 D. The provisions of this section shall be applicable for the
302302 2014 calendar year with respect to an existing homestead property
303303 owned by the surviving spouse of a person previously determined to
304304 have died while in the line of dut y by the United States Departmen t
305305 of Defense or applicable branch of the United States military.
306306 SECTION 2. The Ballot Title for the proposed Constitutional
307307 amendment as set forth in SECTION 1 of this resolution shall be in

363363 This measure amends Sections 8D through 8F of Article 10 of the
364364 Oklahoma Constitution . It updates and modernizes the language
365365 for the household property exemption for disabled veterans and
366366 surviving spouses, the homestead exemption for disabled veterans
367367 and surviving spouses, and the homestead exemption for surviving
368368 spouses of veterans who have died in the line of duty by
369369 replacing the words “head of household” with the words “veteran”
370370 and “servicemember”.

374374 SECTION 3. The President Pro Tempore of the Senate shall,

377377 hereof, with the Secretary of State and one copy with the Attorney
378378 General.
379379 SECTION 4. A special election is hereby ordered to be held
380380 throughout the State of Oklahoma on the date of June 28, 2022, at
381381 which time the proposed amendment s to the Oklahoma Constitution, as
382382 set forth in SECTION 1 of this resolution, shall be submitted to the
383383 people of Oklahoma for th eir approval or rejection as and in the
384384 manner provided by law.
