8181 BE IT RESOLVED BY THE SENAT E AND THE HOUSE OF REPRESENTATIVES OF THE
8282 2ND SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
8383 SECTION 1. The Secretary of State shall refer to the people for
8484 their approval or rejection, as and in the manner provided by law,
8585 the following propos ed amendment to Section 4 of Article III of the
8686 Oklahoma Constitution to read as follows:
8787 Section 4. A. The Legislature shall prescribe the time and
8888 manner of holding and conducting all elections, and enact such laws
8989 as may be necessary to detect and punish fraud in such el ections.

142142 throughout the state and, when it is so provided, no person shall
143143 vote at any election unless he shall have registered according to
144144 law.
145145 B. The Secretary of the State Election Board shall direct the
146146 secretary of a county election board to co nduct a post-election
147147 audit of general election results for the purpose of maintainin g the
148148 security of the election system by ensuring that voting devices and
149149 software used in a particular election correctly ta bulated votes.
150150 Audits shall be conducted in ten randomly selected counties per
151151 general election. If a county is randomly selected to co nduct a
152152 post-election audit, that county shall not be required to conduct
153153 another audit by random selection until all c ounties have been
154154 randomly selected to conduct aud its. Any county may be required
155155 after any election to conduct a post-election audit for good cause.
156156 C. The method, timing and procedures for conducting a post -
157157 election audit shall be determined by the Secretary of the State
158158 Election Board as directed by laws enacted by the Legislature . The
159159 secretary of a county election board shall report the findings of a
160160 post-election audit to the Secretary of the State Election Board,
161161 and such report shall be availa ble to the public.
162162 SECTION 2. The Ballot Title for the proposed Constitutional
163163 amendment as set forth in SECTION 1 of this resolution shall be in
164164 the following form:

218218 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
219219 This measure amends Section 4 of Article 3 of the Oklahoma
220220 Constitution. The measure will require post-election audits in
221221 10 randomly selected cou nties after every general election to
222222 preserve the security of the electi on system. The measure
223223 allows audits in any county for good cause. The measure gives
224224 the Legislature the authority to en act laws about the method,
225225 timing, and procedures of post-election audits. The measure
226226 requires audit reports to be available to the public.
