AS INTRODUCED 
 
A Joint Resolution directing th e Secretary of State 
to refer to the peopl e for their approval or 
rejection a proposed amendme nt to Section 4 of 
Article III of the Oklahoma Constitution; requiring 
post-election audits in certain counties; authorizing 
post-election audits in any county f or good cause; 
authorizing the Legislature to enact laws for the 
method, timing and procedures of post-election 
audits; requiring audit reports to be available to 
the public; providing ballot title; and directing 
filing. 
 
 
 
 
 
BE IT RESOLVED BY THE SENAT E AND THE HOUSE OF REPRESENTATIVES OF THE 
2ND SESSION OF THE 58TH OKLAHOMA LEGISLATURE: 
SECTION 1.  The Secretary of State shall refer to the people for 
their approval or rejection, as and in the manner provided by law, 
the following propos ed amendment to Section 4 of Article III of the 
Oklahoma Constitution to read as follows: 
Section 4.  A. The Legislature shall prescribe the time and 
manner of holding and conducting all elections, and enact such laws 
as may be necessary to detect and punish fraud in such el ections.  
The Legislature may provide by law for the registration of e lectors

throughout the state and, when it is so provided, no person shall 
vote at any election unless he shall have registered according to 
law. 
B. The Secretary of the State Election Board shall direct the 
secretary of a county election board to co nduct a post-election 
audit of general election results for the purpose of maintainin g the 
security of the election system by ensuring that voting devices and 
software used in a particular election correctly ta bulated votes. 
Audits shall be conducted in ten randomly selected counties per 
general election.  If a county is randomly selected to co nduct a 
post-election audit, that county shall not be required to conduct 
another audit by random selection until all c ounties have been 
randomly selected to conduct aud its.  Any county may be required 
after any election to conduct a post-election audit for good cause. 
C.  The method, timing and procedures for conducting a post -
election audit shall be determined by the Secretary of the State 
Election Board as directed by laws enacted by the Legislature . The 
secretary of a county election board shall report the findings of a 
post-election audit to the Secretary of the State Election Board, 
and such report shall be availa ble to the public. 
SECTION 2.  The Ballot Title for the proposed Constitutional 
amendment as set forth in SECTION 1 of this resolution shall be in 
the following form:

THE GIST OF THE PROPOSITION IS AS FOLLOWS: 
This measure amends Section 4 of Article 3 of the Oklahoma 
Constitution.  The measure will require post-election audits in 
10 randomly selected cou nties after every general election to 
preserve the security of the electi on system.  The measure 
allows audits in any county for good cause.  The measure gives 
the Legislature the authority to en act laws about the method, 
timing, and procedures of post-election audits.  The measure 
requires audit reports to be available to the public.

SECTION 3.  The President Pro Tempore of the Senate shall, 
immediately after the passage of this resolution, prepare and f ile 
one copy thereof, including the Ballot Titl e set forth in SECTION 2 
hereof, with the Secretary of State and one copy with the Attorney 
General.
