3864 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

4065 SECTION 1. NEW LAW A new se ction of law to be codified
4166 in the Oklahoma Statutes as Section 110.5 of Title 74, unless there
4267 is created a duplication in numbering, reads a s follows:

4468 A. There is hereby continued a Jim Thorpe Repair Expenditure
4569 Oversight Committee originally created in Section 382 of Title 73 of

96+the Oklahoma Statutes. The authorized distributions from the Legacy
4797 Capital Financing Fund as described in Enrolled House Bill No. 1011
4898 of the 1st Extraordinary Session of the 59th Oklahoma Legislature
4999 that are needed for repairs to the interior and e xterior of the Jim
50100 Thorpe Office Building shall be subject to the approva l of the Jim
51101 Thorpe Repair Expenditure Oversight Committee; provided, however,
52102 the expenditure of those p roceeds shall be subject to a request for
53103 proposal process.

55104 The Committee shall be composed of nine (9) members as follows:

57105 1. Three persons to be app ointed by the Governor, one of whom
58106 shall serve as chair of the Committee;
59-
60107 2. Three legislators to be appointed by the Speaker of the
61108 Oklahoma House of Representatives, two of whom shall be members of
62109 the majority political party and one of whom shall be a member of
63110 the minority political party; and
64-
65111 3. Three legislators to be appointed by the President Pro
66112 Tempore of the Oklahoma State Senate, two of whom shall be members
67113 of the majority political party and one of whom shall be a member of
68114 the minority political party. Five members of the Committee shall
69115 constitute a quorum and the vote of five members shal l be necessary
70116 for any action taken by the Committee. The Committee shall be
71117 staffed by employees of the Office of Mana gement and Enterprise
72118 Services. The Committee shall be subject to the Oklahoma Open
73119 Meeting Act.

75146 B. The Committee shall deliver a prel iminary plan for the
76147 renovation, repair, and remodeling of the Jim Thorpe Office Building
77148 to the Director of the Office of Manag ement and Enterprise S ervices
78149 no later than December 31, 2022. The preliminary plan shall include
79150 the following components:

81151 1. Establishment of the Office of Management and Enterprise
82152 Services' goal and criteria for use by the vendor; and
83-
84153 2. Selection criteria for the design -build team vendor to be
85154 selected through a Request for Proposal process.

87155 C. Following receipt of the pre liminary plan as approved by the
88156 Committee, the Office of Management and Enter prise Services shall
89157 solicit Requests for Proposals to select the vendor for the project.

91158 D. The Committee shall deliver a final plan to the Director of
92159 the Office of Management and Enterprise Services no later than Ju ne
93160 30, 2023. The final plan shall include the following components:

95161 1. Approval of the final scope of work developed by the vendor;

98163 2. Approval of the project phasing developed by the vendor.

100164 E. Following delivery of the final plan, the Committee s hall
101165 continue to oversee the expendit ure of proceeds from the sale of
102166 obligations issued pursuant to the prov isions of this section until
103167 completion of the renovation, repair, and remodeling of the Jim
104168 Thorpe Office Building. The Committee may also propos e and approve
105169 amendments to the plan as it deems appropriate.

107196 F. The Director of the O ffice of Management and Enterprise
108197 Services shall have responsibility to substantially implement the
109198 plan as presented by the Co mmittee.

111199 G. The continuation of the Committee, as provided in this act,
112200 shall be interpreted to result in no disruption to the current
113201 operations and structure of the Committee.

115202 SECTION 2. It being immediately necessary for the p reservation
116203 of the public peace, health or safety, an emergency is hereby
117204 declared to exist, by reason whereof this act shall take effect and
118205 be in full force from and after its passage an d approval.
