53	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	51		SECTION 1. AMENDATORY 70 O. S. 2021, Section 13-116, is
55	52		amended to read as follows :
56	53		Section 13-116. A. School district personnel shall be
57	54		prohibited from using corporal punishment on students identified
58	55		with the most significant cognitive disabilities according to
59	56		criteria established by the State Department of Education u nless
60	57		addressed in an annual individualized education program (IEP)
61	58		developed in accordance with the Individu als with Disabilities
62	59		Education Act (IDEA) .

90	86		B. A waiver to the provisions of su bsection A of this section
91	87		shall be granted if the par ent or legal guardian of a student
92	88		provides written consent.
93	89		C. As used in this section, "corporal punishment" means the
94	90		deliberate infliction of physical pain by hitting, paddling,
95	91		spanking, slapping or any other physical force used as a means of
96	92		discipline.
97	93		SECTION 2. This act shall become effective November 1, 2023.
