5349 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
5450 SECTION 1. NEW LAW A new section of law to be codified
5551 in the Oklahoma Statutes as Section 6-517 of Title 2, unless there
5652 is created a duplication in numbering, reads a s follows:
5753 A. For purposes of this section, "commercial harvesting
5854 facility" means a privately or publicly owned premises managed or
5955 engaged on a business basis for the harvesting or hunting of legall y
6056 acquired and privately owned cervidae, to include whi tetail deer,
6157 mule deer or elk, cervi dae hybrids, turkey, exotic species, an d
6258 exotic hybrid species for barter, the offer to sell, or for the
6359 possession with intent to sell for profit or monetary gain.

9186 B. No person may propagate or hold in captivity any wi ldlife
9287 belonging to the state. A commercial harvesting license shall be
9388 issued by the Oklahoma Department of Agriculture, Food, and Forestry
9489 to a commercial harvesting facility that applies for the co mmercial
9590 harvesting license if that commercial harvesti ng facility complies
9691 with all applicable laws and rules governing the harvest ing of
9792 legally acquired cervidae, to include whitetail deer, mule deer and
9893 elk, cervidae hybrids, turkey, exotic species, an d exotic hybrid
9994 species harvested in a commercial harve sting facility.
10095 C. Before obtaining a commercial harvesting facility license or
10196 renewal the applicant shall submit proof that any additional animals
10297 have been secured from a source other than wild sto ck of this state.
10398 D. The Secretary of Agriculture, Sta te Veterinarian, or their
10499 designees shall have the authority to inspect a com mercial
105100 harvesting facility and its operations at any time if there is
106101 probable cause that a violation has occurred. All other inspections
107102 shall require prior notice as determine d in the rule promulgation by
108103 the Oklahoma Department of Agriculture, Food, an d Forestry.
109104 E. The annual fee for a commercial harvesting facility license
110105 shall be Three Hundred Dollars ($300.00).
111106 F. All licenses issued pursuant to this section shall expir e
112107 August 31 of each year and shall rep lace those issued previously
113108 pursuant to Section 4-106 of Title 29 of the Oklahoma Statutes.

142136 shall promulgate rules as necessary pursuant to the commercial
143137 harvesting license outlined in this s ection.
144138 SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -106, is
145139 amended to read as follows:
146140 Section 4-106. A. No person may propagate or hold in captivity
147141 any wildlife or domesticated animals hunted for sport for commercial
148142 hunting area purposes without having procured a license from the
149143 Director of the Department of Wildlife Conservation. Licenses shall
150144 be classified as big game, upland g ame, or a combination of big game
151145 and upland game.
152146 1. A big game license commercial harvesting lice nse, as created
153147 in Section 1 of this act, shall be required for legally acquired
154148 exotic ungulates, domesticated an imals so designated by the Oklahoma
155149 Wildlife Conservation Commission, exotic swine, and legally a cquired
156150 whitetail and mule deer, turkey and other species of big game
157151 lawfully taken under the provisions of subsection A of Section 5 -411
158152 and Section 5-401 of this title. Wildlife that has been cross bred
159153 with exotic wildlife shall be considered native an d not exotic
160154 unless documentation shows otherwise.
161155 2. An upland game license s hall be required for legally
162156 acquired captive-raised pheasants, all species of q uail, Indian
163157 chukars, water fowl, and othe r similar or suitable gallinaceous

191184 birds; and shall include turkey if no other big game species are
192185 listed on the license/application .
193186 B. Before obtaining a license or a renewal of a license the
194187 applicant shall submit proof that such wildlife or domestica ted
195188 animals hunted for sport will be or have been secur ed from a source
196189 other than the wild stock in this state. Any person obtaining or
197190 renewing a license shall submit a true and complete inventory of
198191 said animals before a license shall be approved. Eac h license shall
199192 specifically list the different species and/or subspecies to be
200193 hunted on the listed hunting area or premises.
201194 C. Any game warden of the Oklahoma Department of Wildlife
202195 Conservation shall have auth ority to inspect any and all records and
203196 invoices pertaining to the commercial hunting operations of any
204197 person licensed or requesting licensure pursuant to this section and
205198 additionally shall have the authority to inspect any and all
206199 facilities, equipment and property connected to the hunting
207200 operation of any person licensed or requesting licensure p ursuant to
208201 this section.
209202 D. 1. The annual fee for a commercial hunting area l icense for
210203 upland game under this section shall be One Hundred Dollars
211204 ($100.00).
212205 2. The annual fee for a commercial hunt ing area license for:
213206 a. big game pursuant to this sect ion shall be Two Hundred
214207 Fifty Dollars ($250.00), or

242234 b. a combination of big ga me and upland game pursuant to
243235 this section shall be Three Hundred Fifty Dollars
244236 ($350.00).
245237 E. D. All licenses issued pur suant to this section shall expire
246238 on June 30 of each y ear.
247239 F. E. Exemptions from this license requirement shall be
248240 operators of running pens used for the performance test or training
249241 of dogs. Operators of such running pens may acquire coyotes from
250242 wild stock without having to possess a fur dealer 's license for such
251243 purpose and no license shall be required of those involved in
252244 performance testing or training dogs in such running pens so long as
253245 no other wildlife are taken or hunted in any manner.
254246 G. F. Any person convicted of violating the provisions of this
255247 section shall be punished by a fine of not less than Five Hundred
256248 Dollars ($500.00) nor more than One Thousand Five Hundred Dollars
257249 ($1,500.00), or by impr isonment in the county jail not to exceed
258250 sixty (60) days, or by both such fine and imprisonment.
259251 H. G. Any person convicted of violating the provisions of this
260252 section shall have the commercial hunting area license revoked. No
261253 new license shall be issu ed for a period of six (6) months from and
262254 after the date on which the revocation order becomes effec tive.
263255 I. H. The Department is authorized to promulgate rules
264256 pertaining to commercial hunting areas this section.

292283 SECTION 3. It being immediately necessary for the preservation
293284 of the public peace, health or safety, an emergency is hereby
294285 declared to exist, by reason whereof this act shall take effect and
295286 be in full force from and after its passage an d approval.
