53	49		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
54	50		SECTION 1. NEW LAW A new section of law to be codified
55	51		in the Oklahoma Statutes as Section 6-517 of Title 2, unless there
56	52		is created a duplication in numbering, reads a s follows:
57	53		A. For purposes of this section, "commercial harvesting
58	54		facility" means a privately or publicly owned premises managed or
59	55		engaged on a business basis for the harvesting or hunting of legall y
60	56		acquired and privately owned cervidae, to include whi tetail deer,
61	57		mule deer or elk, cervi dae hybrids, turkey, exotic species, an d
62	58		exotic hybrid species for barter, the offer to sell, or for the
63	59		possession with intent to sell for profit or monetary gain.

91	86		B. No person may propagate or hold in captivity any wi ldlife
92	87		belonging to the state. A commercial harvesting license shall be
93	88		issued by the Oklahoma Department of Agriculture, Food, and Forestry
94	89		to a commercial harvesting facility that applies for the co mmercial
95	90		harvesting license if that commercial harvesti ng facility complies
96	91		with all applicable laws and rules governing the harvest ing of
97	92		legally acquired cervidae, to include whitetail deer, mule deer and
98	93		elk, cervidae hybrids, turkey, exotic species, an d exotic hybrid
99	94		species harvested in a commercial harve sting facility.
100	95		C. Before obtaining a commercial harvesting facility license or
101	96		renewal the applicant shall submit proof that any additional animals
102	97		have been secured from a source other than wild sto ck of this state.
103	98		D. The Secretary of Agriculture, Sta te Veterinarian, or their
104	99		designees shall have the authority to inspect a com mercial
105	100		harvesting facility and its operations at any time if there is
106	101		probable cause that a violation has occurred. All other inspections
107	102		shall require prior notice as determine d in the rule promulgation by
108	103		the Oklahoma Department of Agriculture, Food, an d Forestry.
109	104		E. The annual fee for a commercial harvesting facility license
110	105		shall be Three Hundred Dollars ($300.00).
111	106		F. All licenses issued pursuant to this section shall expir e
112	107		August 31 of each year and shall rep lace those issued previously
113	108		pursuant to Section 4-106 of Title 29 of the Oklahoma Statutes.

141	135		G. The Oklahoma Department of Agriculture, Food, and Forestry
142	136		shall promulgate rules as necessary pursuant to the commercial
143	137		harvesting license outlined in this s ection.
144	138		SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -106, is
145	139		amended to read as follows:
146	140		Section 4-106. A. No person may propagate or hold in captivity
147	141		any wildlife or domesticated animals hunted for sport for commercial
148	142		hunting area purposes without having procured a license from the
149	143		Director of the Department of Wildlife Conservation. Licenses shall
150	144		be classified as big game, upland g ame, or a combination of big game
151	145		and upland game.
152	146		1. A big game license commercial harvesting lice nse, as created
153	147		in Section 1 of this act, shall be required for legally acquired
154	148		exotic ungulates, domesticated an imals so designated by the Oklahoma
155	149		Wildlife Conservation Commission, exotic swine, and legally a cquired
156	150		whitetail and mule deer, turkey and other species of big game
157	151		lawfully taken under the provisions of subsection A of Section 5 -411
158	152		and Section 5-401 of this title. Wildlife that has been cross bred
159	153		with exotic wildlife shall be considered native an d not exotic
160	154		unless documentation shows otherwise.
161	155		2. An upland game license s hall be required for legally
162	156		acquired captive-raised pheasants, all species of q uail, Indian
163	157		chukars, water fowl, and othe r similar or suitable gallinaceous

191	184		birds; and shall include turkey if no other big game species are
192	185		listed on the license/application .
193	186		B. Before obtaining a license or a renewal of a license the
194	187		applicant shall submit proof that such wildlife or domestica ted
195	188		animals hunted for sport will be or have been secur ed from a source
196	189		other than the wild stock in this state. Any person obtaining or
197	190		renewing a license shall submit a true and complete inventory of
198	191		said animals before a license shall be approved. Eac h license shall
199	192		specifically list the different species and/or subspecies to be
200	193		hunted on the listed hunting area or premises.
201	194		C. Any game warden of the Oklahoma Department of Wildlife
202	195		Conservation shall have auth ority to inspect any and all records and
203	196		invoices pertaining to the commercial hunting operations of any
204	197		person licensed or requesting licensure pursuant to this section and
205	198		additionally shall have the authority to inspect any and all
206	199		facilities, equipment and property connected to the hunting
207	200		operation of any person licensed or requesting licensure p ursuant to
208	201		this section.
209	202		D. 1. The annual fee for a commercial hunting area l icense for
210	203		upland game under this section shall be One Hundred Dollars
211	204		($100.00).
212	205		2. The annual fee for a commercial hunt ing area license for:
213	206		a. big game pursuant to this sect ion shall be Two Hundred
214	207		Fifty Dollars ($250.00), or

242	234		b. a combination of big ga me and upland game pursuant to
243	235		this section shall be Three Hundred Fifty Dollars
244	236		($350.00).
245	237		E. D. All licenses issued pur suant to this section shall expire
246	238		on June 30 of each y ear.
247	239		F. E. Exemptions from this license requirement shall be
248	240		operators of running pens used for the performance test or training
249	241		of dogs. Operators of such running pens may acquire coyotes from
250	242		wild stock without having to possess a fur dealer 's license for such
251	243		purpose and no license shall be required of those involved in
252	244		performance testing or training dogs in such running pens so long as
253	245		no other wildlife are taken or hunted in any manner.
254	246		G. F. Any person convicted of violating the provisions of this
255	247		section shall be punished by a fine of not less than Five Hundred
256	248		Dollars ($500.00) nor more than One Thousand Five Hundred Dollars
257	249		($1,500.00), or by impr isonment in the county jail not to exceed
258	250		sixty (60) days, or by both such fine and imprisonment.
259	251		H. G. Any person convicted of violating the provisions of this
260	252		section shall have the commercial hunting area license revoked. No
261	253		new license shall be issu ed for a period of six (6) months from and
262	254		after the date on which the revocation order becomes effec tive.
263	255		I. H. The Department is authorized to promulgate rules
264	256		pertaining to commercial hunting areas this section.
