5162 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5263 SECTION 1. NEW LAW A new section of law not to be
5364 codified in the Oklahoma Statutes reads a s follows:
5465 A. This act shall be known and may be cited as the "Rural
5566 Emergency Room Access to Care and Facilities Improvements Act".
56-B. The Legislature hereby finds that access to reliable,
57-adequate, and available emergency room care throughout the state is
58-beneficial to the state and its citizens and must be secured.
59-SECTION 2. NEW LAW A new section of law to be codified
60-in the Oklahoma Statutes as Section 1-2740 of Title 63, unless there
61-is created a duplication in numbering, rea ds as follows:
62-A. There is hereby created in the State Treasury a revolving
63-fund for the State Department of Health to be designated the "Rural

93+B. The Legislature hereby finds that access to reliable,

96+SECTION 2. NEW LAW A new section of law to be codified

92102 Fund". The fund shall be a continuing fund , not subject to fiscal
93103 year limitations, and shall consist of all monies legally directed
94104 for deposit to the fund. All monies accruing to the credit of said
95105 fund are hereby approp riated and may be bud geted and expended by the
96106 State Department of Health for the purpose of providing grants to
97107 qualifying facilities in accordance with the provisions and
98108 limitations of subsections C and D of this section. Expenditures
99109 from said fund shall be made upon warrants issued by the State
100110 Treasurer against claims file d as prescribed by law with the
101111 Director of the Office of Management and Enter prise Services for
102112 approval and payment.
103113 B. As used in the Rural Emergency Room Access to Care and
104114 Facilities Improvements Act:
105115 1. "Qualifying facilities " means a hospital located in a county
106116 with a population less than 50,000 as reported in the most recent
107-Federal Decennial Census published by the United States Census
108-Bureau; and
109-2. "Qualified emergency room physician" means a board-certified
110-emergency room physician.
111-C. From any available, unencumbered balance in the Rural
112-Emergency Room Access to Care and Facilities Improvements Revolving
113-Fund, the State Departme nt of Health is authorized to award gra nts
114-to qualifying hospitals as follows:

148+Emergency Room Access to Care and Facilities Improvements Revolving
149+Fund, the State Departme nt of Health is authorized to award gra nts
150+to qualifying hospitals as follows:
142151 1. For qualifying hospitals staffing qualified emergency room
143152 physicians at least fifty percent (50%) of facility's operating
144153 hours, an annual grant amount shall not exceed One Million Dollars
145154 ($1,000,000.00); and
146155 2. For qualifying hospitals staffing qualif ied emergency room
147156 physicians for less than fifty percent (50%) of facility operating
148157 hours, an annual grant amount shall not exceed Five Hundred Thousand
149158 Dollars ($500,000.00).
150159 D. No grant shall be awarded or paid under the provisions of
151160 this act that would exceed the available , unencumbered balance of
152161 the Rural Emergency Room Access to Care and Facilities Improvements
153162 Act.
154163 E. The State Depart ment of Health may promulgate rules as
155164 needed to implement the provisi ons of the Rural Emergency Room
156165 Access to Care and Facilities Improvements Act.
157166 SECTION 3. This act shall become effective July 1, 2023.

158193 SECTION 4. It being immediately necessary for the preservation
159194 of the public peace, h ealth or safety, an emergency is hereby
160195 declared to exist, by reason whereo f this act shall take effect and
161196 be in full force from and after its passage and approval.
