	49	+	the awarding of grants to certain hospitals; limiting
	50	+	amounts of awards based on provided criteria;
	51	+	limiting grant awards to certain balance; author izing
	52	+	the promulgation of rules; providing for
	53	+	noncodification; providing for codification;
	54	+	providing an effective date; and declaring an
	55	+	emergency.

51	62		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	63		SECTION 1. NEW LAW A new section of law not to be
53	64		codified in the Oklahoma Statutes reads a s follows:
54	65		A. This act shall be known and may be cited as the "Rural
55	66		Emergency Room Access to Care and Facilities Improvements Act".
56		-	B. The Legislature hereby finds that access to reliable,
57		-	adequate, and available emergency room care throughout the state is
58		-	beneficial to the state and its citizens and must be secured.
59		-	SECTION 2. NEW LAW A new section of law to be codified
60		-	in the Oklahoma Statutes as Section 1-2740 of Title 63, unless there
61		-	is created a duplication in numbering, rea ds as follows:
62		-	A. There is hereby created in the State Treasury a revolving
63		-	fund for the State Department of Health to be designated the "Rural

	93	+	B. The Legislature hereby finds that access to reliable,

92	102		Fund". The fund shall be a continuing fund , not subject to fiscal
93	103		year limitations, and shall consist of all monies legally directed
94	104		for deposit to the fund. All monies accruing to the credit of said
95	105		fund are hereby approp riated and may be bud geted and expended by the
96	106		State Department of Health for the purpose of providing grants to
97	107		qualifying facilities in accordance with the provisions and
98	108		limitations of subsections C and D of this section. Expenditures
99	109		from said fund shall be made upon warrants issued by the State
100	110		Treasurer against claims file d as prescribed by law with the
101	111		Director of the Office of Management and Enter prise Services for
102	112		approval and payment.
103	113		B. As used in the Rural Emergency Room Access to Care and
104	114		Facilities Improvements Act:
105	115		1. "Qualifying facilities " means a hospital located in a county
106	116		with a population less than 50,000 as reported in the most recent
107		-	Federal Decennial Census published by the United States Census
108		-	Bureau; and
109		-	2. "Qualified emergency room physician" means a board-certified
110		-	emergency room physician.
111		-	C. From any available, unencumbered balance in the Rural
112		-	Emergency Room Access to Care and Facilities Improvements Revolving
113		-	Fund, the State Departme nt of Health is authorized to award gra nts
114		-	to qualifying hospitals as follows:

	150	+	to qualifying hospitals as follows:
142	151		1. For qualifying hospitals staffing qualified emergency room
143	152		physicians at least fifty percent (50%) of facility's operating
144	153		hours, an annual grant amount shall not exceed One Million Dollars
145	154		($1,000,000.00); and
146	155		2. For qualifying hospitals staffing qualif ied emergency room
147	156		physicians for less than fifty percent (50%) of facility operating
148	157		hours, an annual grant amount shall not exceed Five Hundred Thousand
149	158		Dollars ($500,000.00).
150	159		D. No grant shall be awarded or paid under the provisions of
151	160		this act that would exceed the available , unencumbered balance of
152	161		the Rural Emergency Room Access to Care and Facilities Improvements
153	162		Act.
154	163		E. The State Depart ment of Health may promulgate rules as
155	164		needed to implement the provisi ons of the Rural Emergency Room
156	165		Access to Care and Facilities Improvements Act.
157	166		SECTION 3. This act shall become effective July 1, 2023.
