95 | 105 | | fund are hereby approp riated and may be bud geted and expended by the |

96 | 106 | | State Department of Health for the purpose of providing grants to |
---|
97 | 107 | | qualifying facilities in accordance with the provisions and |
---|
98 | 108 | | limitations of subsections C and D of this section. Expenditures |
---|
99 | 109 | | from said fund shall be made upon warrants issued by the State |
---|
100 | 110 | | Treasurer against claims file d as prescribed by law with the |
---|
101 | 111 | | Director of the Office of Management and Enter prise Services for |
---|
102 | 112 | | approval and payment. |

103 | 113 | | B. As used in the Rural Emergency Room Access to Care and |
---|
104 | 114 | | Facilities Improvements Act: |
---|
105 | 115 | | 1. "Qualifying facilities " means a hospital located in a county |
---|
106 | 116 | | with a population less than 50,000 as reported in the most recent |
---|
142 | 151 | | 1. For qualifying hospitals staffing qualified emergency room |
---|
143 | 152 | | physicians at least fifty percent (50%) of facility's operating |
---|
144 | 153 | | hours, an annual grant amount shall not exceed One Million Dollars |
---|
145 | 154 | | ($1,000,000.00); and |
---|
146 | 155 | | 2. For qualifying hospitals staffing qualif ied emergency room |
---|
147 | 156 | | physicians for less than fifty percent (50%) of facility operating |
---|
148 | 157 | | hours, an annual grant amount shall not exceed Five Hundred Thousand |
---|
149 | 158 | | Dollars ($500,000.00). |

150 | 159 | | D. No grant shall be awarded or paid under the provisions of |
---|
151 | 160 | | this act that would exceed the available , unencumbered balance of |
---|
152 | 161 | | the Rural Emergency Room Access to Care and Facilities Improvements |
---|
153 | 162 | | Act. |
---|
154 | 163 | | E. The State Depart ment of Health may promulgate rules as |
---|
155 | 164 | | needed to implement the provisi ons of the Rural Emergency Room |
---|
156 | 165 | | Access to Care and Facilities Improvements Act. |
---|
157 | 166 | | SECTION 3. This act shall become effective July 1, 2023. |
