4744 Chapter 300, O.S.L. 2022 (37A O. S. Supp. 2022,
4845 Section 6-102), which relates to the prohibited acts
4946 of licensees; expanding the exceptions to the means
5047 or inducements to stimulate the consumption of
5148 alcoholic beverages; providing that a specific number
5249 of beers in reusable containers may be delivered to
5350 individuals for on-premises consumption; and

6360 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6461 SECTION 1. AMENDATORY 37A O.S. 2021, Section 6 -102, as
6562 amended by Section 1, Chapter 300, O.S.L. 2022 (37A O.S. S upp. 2022,
6663 Section 6-102), is amended to read as follows:
6764 Section 6-102. A. No licensee of the ABLE Commission shall:
65+1. Receive, possess or sell any alcoholic bevera ge except as
66+authorized by the Oklahoma Alcoholic Beverage Control Act and by the
67+license or permit which the licensee holds;

95-1. Receive, possess or sell any alcoholic bevera ge except as
96-authorized by the Oklahoma Alcoholic Beverage Control Act and by the
97-license or permit which the licensee holds;
9894 2. Employ any person under eighteen (18) years of age in the
9995 selling of beer or w ine or employ any person under twenty-one (21)
10096 years of age in the selling of spirits. Provided:
10197 a. a mixed beverage, beer and wine, c aterer, public
10298 event, special event, bottle club, retail wine or
10399 retail beer licensee may employ servers or sales
104100 clerks who are at least eighteen (18) years of age,
105101 except persons under twenty-one (21) years of age may
106102 not serve in designated bar or loung e areas, and
107103 b. a mixed beverage, beer and wine, caterer, public
108104 event, special event or bottle club licensee may
109105 employ or hire musical bands who have musicians who
110106 are under eighteen (18) years of age if each such
111107 musician is either accompanied by a pare nt or legal
112108 guardian or has on their person, to be made available
113109 for inspection upon demand by any employee of the ABLE
114110 Commission or law enforcement officer, a written ,
115111 notarized affidavit from the parent or legal guardian
116112 giving the underage musician pe rmission to perform in
117113 designated bar or lounge areas;

145-3. Give any alcoholic beverage as a prize, premium or
146-consideration for any lottery, game of chance or skill or a ny type
147-of competition;
148143 4. Use any of the following means or inducements to stimulate
149144 the consumption of alcoholic beverages, including but not limited
150145 to:
151146 a. deliver more than two drinks to one person at on e
152147 time, except:
153148 (1) as provided for serving tast ing flights defined
154149 in Section 6-102.1 of this title, or
155150 (2) up to six (6) bottles or cans of beer in its
156151 original packaging for on-premises consumption
157152 may be delivered to one person at one time in a
158153 reusable container, including but not limited to
159154 a bucket or insulated cooler which may be cooled
160155 by ice or another cooling method,
161156 b. sell or offer to sell to any person or group of
162157 persons any drinks at a price that is less than six
163158 percent (6%) below the markup of the cost to the mixed
164159 beverage licensee; provided, a mixed beverage licensee
165160 shall be permitted to offer these drink specials on
166161 any particular hour of any particular day and shall
167162 not be required to offer these drink specials for an
168163 entire calendar week or from open to close, a nd shall
164+not be required to offer such drink specials at all
165+venues operating under the same mixed beverage
166+license; provided, a mixed beverage licensee selling

196-not be required to offer such drink specials at all
197-venues operating under the same mixed beverage
198-license; provided, a mixed beverage licensee selling
199193 wine, beer, or cocktails to-go shall be permitted to
200194 offer these to-go drinks at a different price than on-
201195 premises drinks,
202196 c. sell or offer to sell to an y person an unlimited
203197 number of drinks during an y set period of time for a
204198 fixed price, except at private functions not open to
205199 the public,
206200 d. sell or offer to sell drinks to any perso n or group of
207201 persons on any one day or portion thereof at prices
208202 less than those charged the general public on that
209203 day, except at private f unctions not open to the
210204 public,
211205 e. increase the volume of alcoholic beverages contained
212206 in a drink without increas ing proportionately the
213207 price regularly charged for such drink during the same
214208 calendar week, or
215209 f. encourage or permit, on the licensed prem ises, any
216210 game or contest which invo lves drinking or the
217211 awarding of drinks as prizes.
212+Provided, that the provision s of this paragraph shall not

245-Provided, that the provision s of this paragraph shall not
246-prohibit the advertising or offering of food, entertainment or
247-bottle service in licensed establishments;
248-5. Permit or allow any patron or person to exit the licensed
249-premises with an open container of any alcoholic beverage.
250243 Provided, this prohibition shall not be applicable to closed
251244 original containers of alcoholic beverages which are carr ied from
252245 the licensed premises of a bottle club by a patr on, closed original
253246 wine containers removed from the premises of restaurants, h otels and
254247 motels, or to closed original containers of alcoholic bev erages
255248 transported to and from the place of business of a licensed caterer
256249 by the caterer or an employee of th e caterer;
257250 6. Serve or sell alcoholic beverages with an expired license
258251 issued by the ABLE Commission;
259252 7. Permit any person to be drunk or int oxicated on the
260253 licensee's licensed premises; or
261254 8. Permit or allow any pat ron to serve or pour himself or
262255 herself any alcoholic beverage, except a licensee may offer a patron
263256 self-pour service of beer or wine, or both, from automated devices
264257 on licensed premises so long as:
265258 a. the licensee monitors and has t he ability to control
266259 the dispensing of such beer or wine , or both, from the
267260 automated devices. "Automated device" shall mean any
268261 mechanized device capable of dispensing wine or beer,
262+or both, directly to a patron in exchange for
263+compensation that a licen see has received dire ctly
264+from the patron, and
265+b. each licensee offering a patron self-pour service of
266+wine or beer, or both, from any automated device shall

296-or both, directly to a patron in exchange for
297-compensation that a licen see has received dire ctly
298-from the patron, and
299-b. each licensee offering a patron self-pour service of
300-wine or beer, or both, from any automated device shall
301293 provide constant video monitoring of the automated
302294 device at all times during which the licensee i s open
303295 to the public. The licensee shall keep recorded
304296 footage from the video monitoring for at least sixty
305297 (60) days, and shall provi de the footage, upon
306298 request, to any agent of the Director of t he ABLE
307299 Commission or other authorized law enforcement age nt.
308300 B. 1. The compensation required by subparagraph a o f paragraph
309301 8 of subsection A of this section shall be in the form of a radio
310302 frequency identification (RFID) device, mobile application or any
311303 other technology approved by the ABLE Commission contai ning a fixed
312304 amount of volume of thirty-two (32) ounces for beer and ten (10)
313305 ounces for wine that may be directly exchanged for beer o r wine
314306 dispensed from the automated device:
315307 a. RFID devices may be assigned, used or reactivated only
316308 during a business day,
317309 b. each RFID device shall be obtained from the licens ee
318310 by a patron,
311+c. a licensee shall not issue more than one active RFID
312+device to a patron, and
313+d. an RFID device shall be deemed active if the RFID
314+device contains volume credit or has not yet been used
315+to dispense ten (10) ounces of wine or thirty -two (32)
316+ounces of beer.

346-c. a licensee shall not issue more than one active RFID
347-device to a patron, and
348-d. an RFID device shall be deemed active if the RFID
349-device contains volume credit or has not yet been used
350-to dispense ten (10) ounces of wine or thirty -two (32)
351-ounces of beer.
352343 2. In order to obtain an RFID device from a licensee, each
353344 patron shall produce a valid driver license, identificat ion card or
354345 other government-issued document that contains a pho tograph of the
355346 individual and demonstrates that the indiv idual is at least twenty-
356347 one (21) years of age. Each RFID device shall be pro grammed to
357348 require the production of the patron's valid identification before
358349 the RFID device can be used for the first t ime during any busine ss
359350 day or for any subsequent reactiv ation.
360351 3. Each RFID device shall become inactive at the end of each
361352 business day.
362353 4. Each RFID device shall be programmed to allow the dispensing
363354 of no more than ten (10) ounces of wine or thirty -two (32) ounces of
364355 beer to a patron:
365356 a. once an RFID device has been used to dispense ten (10)
366357 ounces of wine or thirty -two (32) ounces of beer to a
367358 patron, the RFID device shall become inac tive, and
368359 b. any patron in possession of an inactive RFID device
369360 may, upon production of the patron's valid
361+identification to the licensee or licensee's employee,
362+have the RFID device reactivated to al low the
363+dispensing of an additional ten (10) ounces of wine or
364+thirty-two (32) ounces of beer from an automated
365+device.

397-identification to the licensee or licensee's employee,
398-have the RFID device reactivated to al low the
399-dispensing of an additional ten (10) ounces of wine or
400-thirty-two (32) ounces of beer from an automated
401-device.
402392 Paragraphs 1, 2, 3 and 4 of this subsection shall not apply to wine
403393 or beer that is dispensed directly to the licensee or the licensee 's
404394 agent or employee.
405395 C. A mixed beverage or beer and wine licensee shall not be
406396 deemed to have violated the provisions of paragraph 5 of subsec tion
407397 A of this section if it allowed a patron to leave the licensed
408398 premises with an open container of beer or wi ne only and:
409399 1. The otherwise prohibited act was committed during the hours
410400 of 8 a.m. to midnight on the day of a schedul ed home football game
411401 of institutions within The Oklahoma State System of Higher
412402 Education, and the establishment is located within tw o thousand
413403 (2,000) feet of the institution;
414404 2. The licensee is participating by invitation in a municipally
415405 sanctioned art, music or sporting event within city limits when the
416406 municipality has provided written notice of the event and a list of
417407 invited licensees to the ABLE Commission at least five (5) days
418408 prior to the event; or
419409 3. The patron remains on the connected, physi cal property of
420410 the licensee or in a public area adjacent to the physical property
411+of the licensee with prior municipal approval; prov ided that written
412+notice of the use of the connected, physical property of the
413+licensee or public area shall be provided t o the ABLE Commission at
414+least five (5) days prior to suc h use.
415+SECTION 2. This act shall become effective November 1, 2023.
