28	53		BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:

30	54		SECTION 1. NEW LAW A new section of law to be codified
31	55		in the Oklahoma Statutes as Section 1-539.11 of Title 63, unless
32	56		there is created a duplica tion in numbering, reads as follows:

34	57		This act shall be known and may be cited as the "First
35	58		Responders Job Protection Act".

37	59		SECTION 2. NEW LAW A new section of law to be codified
38	60		in the Oklahoma Statutes as Section 1-539.12 of Title 63, unless
39	61		there is created a duplication in numbering , reads as follows:

41	62		As used in this section:

43	63		1. "Controlled dangerous substance" means a drug, substance or
44	64		immediate precursor in Schedules I through V of the Uniform
45		-	Controlled Dangerous Substances Act or any drug, substance or ENR. H. B. NO. 1408 Page 2

	92	+	Controlled Dangerous Substances Act or any drug, substance or
46	93		immediate precursor listed either temporarily or permanently as a
47	94		federally controlled substance;

49	95		2. "First responder" means an individual who performs emergency
50	96		medical services on scene in accordance with the Oklahoma Emerg ency
51	97		Response Systems Development Act and rules of the State Board of
52	98		Health promulgated thereto;

54	99		3. "Passive exposure" means when an individual is exposed to a
55	100		controlled dangerous substance without actually ingesting or using
56	101		the substance himself or herself; and

58	102		4. "Volunteer" means a person who enters in to a service or
59	103		undertaking of the person's free will without compensation or
60	104		expectation of compensation in money or other thing of value in
61	105		order to provide a service, care, assistance, adv ice, or other
62	106		benefit; provided, being legally entitled to receiv e compensation
63	107		for the service or undertaking performed shall not preclude a person
64	108		from being considered a volunteer.

66	109		SECTION 3. NEW LAW A new section of law to be codified
67	110		in the Oklahoma Statutes as Section 1-539.13 of Title 63, unless
68	111		there is created a duplication in numbering, reads as follows:

70	112		A. The first responder or volunteer first responder subject to
71	113		drug testing shall verbally report , to the first responder's agency
72	114		or private employer prior to testing, any specific known potential

73	142		passive exposure to any controlled dangerous drug that has occurred
74	143		in the previous fourteen (14) days while responding to an emergency.

76	144		B. In the event of a positive drug test, the medical review
77	145		officer shall be provided with documentation of the verbal report
78	146		and a subsequent written report provided by the responding agency in
79	147		order to rule out passive exposure.

81	148		SECTION 4. This act shall become effective November 1, 2023.
