5160 BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
5261 SECTION 1. NEW LAW A new section of law not to be
5362 codified in the Oklahoma Statutes reads as follows:
5463 A. This act shall be known and ma y be cited as the “Women’s
5564 Bill of Rights”.
5665 B. The purpose of the Women’s Bill of Rights is to bring
5766 clarity, certainty, and uniformity under the laws of this state with
5867 respect to natural persons of both biological sexes and the manner
59-in which they are treated as such under the la ws of this state. All
60-laws where the application thereof is contingent upon the
61-classification of a person as being female or male, woman or man,
62-girl or boy, are hereby superseded and inte rpreted to the extent
63-necessary by this act, including, but not limited to, any

98+necessary by this act, including, but not limited to, any
9199 educational benefits, corrections housing, employment protections,
92100 and civil rights laws codified in the statutes of this state.
93101 SECTION 2. AMENDATORY 25 O.S. 2021, Section 16, is
94102 amended to read as follows:
95103 Section 16. The word “person,” As used in the Oklahoma
96104 Statutes:
97105 1. “Father” means the male parent o f a child or children as
98106 defined in Section 7 of this title;
99107 2. “Female” means a natural person whose biological
100108 reproductive system is developed to produce ova;
101109 3. “Male” means a natural person whose biological repr oductive
102110 system is developed to fertil ize the ova of a female;
103111 4. “Man” or “boy” means a natural person who is male;
104112 5. “Mother” means the female parent of a child or chi ldren as
105113 defined in Section 7 of this title;
106114 6. “Natural person” means a person as defined in paragraph 7 of
107115 this section, except for bodies politic or corporate;
108116 7. “Person”, except when used by way of contrast, includes not
109117 only human beings, but bodie s politic or corporate ;
110-8. “Sex” means a natural person’s biological sex at birth; and
111-9. “Woman” or “girl” means a natural person who is female.

144+8. “Sex” means a natural person’s biological sex at birth; and
145+9. “Woman” or “girl” means a natural person who is female.
146+SECTION 3. AMENDATORY 25 O.S. 2021, Section 1101, is
147+amended to read as follows:
141148 Section 1101. A. This act provides f or exclusive remedies
142149 within the state of the p olicies for individuals alleging
143150 discrimination in employment on the basis of race, color, national
144151 origin, sex, religion, creed, age, disability or genetic
145152 information.
146153 B. This act shall be construed accordi ng to the fair import of
147154 its terms to further t he general purposes stated in this sec tion and
148155 the special purposes of the particular provision involved.
149156 C. Any policy, program, or statute that prohibits sex
150157 discrimination shall be construed to forbid unfa ir treatment of
151158 females or males in relation to similarly situated members of the
152159 opposite sex. The state or its political subdivisions shall not be
153160 prohibited from establishing distinctions between sexes when such
154161 distinctions are substantially related t o an important government
155162 objective, including, but not limited to, biology, privacy, safety,
156163 or fairness.
157164 SECTION 4. AMENDATORY 25 O.S. 2021, Sec tion 1201, is
158165 amended to read as follows:
159166 Section 1201. In Section 1101 et seq. of this title, unless the
160167 context otherwise requires:
161-1. “Discriminatory practice ” means a practice designated as
162-discriminatory under the terms of this act;
163-2. “Equal”, with reference to sex as defined in Section 16 of
164-this title, shall not be construed to mean same or identical, and to

197203 corporation, joint apprenticeship committee, joint -stock company,
198204 labor union, legal repre sentative, mutual company, partnership,
199205 receiver, trust, trustee, trustee in ba nkruptcy, unincorporated
200206 organization, any other legal or commercial entity, the sta te, or
201207 any governmental entity or agency.
202208 SECTION 5. NEW LAW A new se ction of law to be codified
203209 in the Oklahoma Statutes as Section 1202 of Title 25, unless there
204210 is created a duplication in numbering, reads as follows:
205211 The state, any political subdivision , or any state agency or
206212 department, including, but not limited to, public school districts,
207213 that collects vital sta tistics for the purpose of gath ering accurate
208214 public health, crime, economic, or other data shall include, but not
209215 be limited to, the identification of any natural person who is part
210216 of the collected data as either male or female as defined in Section
211217 16 of Title 25 of the Oklahoma Statutes.
