49	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	49		SECTION 1. AMENDATORY 21 O.S. 2021, Section 843.5, is
51	50		amended to read as follows:
52	51		Section 843.5 A. Any person who shall willfully or maliciously
53	52		engage in child abuse , as defined in this section, shall, upon
54	53		conviction, be guilty of a fe lony punishable by imprisonmen t in the
55	54		custody of the Department of Corrections not exceed ing life
56	55		imprisonment, or by imprisonment in a county jail not exceeding one
57	56		(1) year, or by a fine of not les s than Five Hundred Dollars
58	57		($500.00) nor more than Five Thousand Dollars ($5,000.00), or both
59	58		such fine and imprisonment.
60	59		B. Any person responsible for the health, safety or w elfare of
61	60		a child who shall willfully or maliciously engage in enabling child
62	61		abuse, as defined in this section, shall, upon convicti on, be

97	95		as defined in this section, shall, upon conviction, be p unished by
98	96		imprisonment in the cus tody of the Department of Corrections not
99	97		exceeding life imprisonment, or by imprisonment in a county jail not
100	98		exceeding one (1) year , or by a fine of not less than Five Hundred
101	99		Dollars ($500.00) nor more than Five Thousan d Dollars ($5,000.00),
102	100		or both such fine and imprisonment.
103	101		D. Any parent or other person who shall willfully or
104	102		maliciously engage in enabling child neglect shall, upon conviction,
105	103		be punished by impriso nment in the custody of the Department of
106	104		Corrections not exceeding life imprisonment , or by imprisonment in a
107	105		county jail not exceeding one (1) y ear, or by a fine of not less
108	106		than Five Hundred Dollars ($500.00) nor more than Five Thousand
109	107		Dollars ($5,000.00), or both such fine and imprisonment .
110	108		E. Any person responsible for the health, sa fety or welfare of
111	109		a child who shall willfully or maliciousl y engage in child sexu al
112	110		abuse, as defined in this section, shall, upon conviction, be
113	111		punished by imprisonmen t in the custody of the Department of

141	138		Corrections not exceeding life imprisonment , or by imprisonment in a
142	139		county jail not exceeding one (1) year, or by a fine of not less
143	140		than Five Hundred Dollars ($500.00) nor more than Five Thousand
144	141		Dollars ($5,000.00), or both such fine and imprisonment, except as
145	142		provided in Section 51.1a of this title or as otherwise provided in
146	143		subsection F of this section fo r a child victim under twelve (12)
147	144		years of age. Except for persons sentenced to life or life without
148	145		parole, any person sentenced to imprisonment for two (2 ) years or
149	146		more for a violation of thi s subsection shall be required to serve a
150	147		term of post-imprisonment supervision pu rsuant to subparagraph f of
151	148		paragraph 1 of subsection A of Section 991a of Title 22 of t he
152	149		Oklahoma Statutes under conditions determined by the Department of
153	150		Corrections. The jury shall be advised that the mandatory post-
154	151		imprisonment supervision shall be in addition to the actual
155	152		imprisonment.
156	153		F. Any person responsible for the health, safet y or welfare of
157	154		a child who shall willfully or maliciously engage in child sexual
158	155		abuse, as defined in this section, to a child under twelve (12)
159	156		years of age shall, upon conviction, be punished by imprisonment in
160	157		the custody of the Department of Correctio ns for not less than
161	158		twenty-five (25) years nor more than life imprisonment , and by a
162	159		fine of not less than Five Hundred Dollars ($500.00) nor mor e than
163	160		Five Thousand Dollars ($5,000.00).

199	195		H. Any person who shall willfully or maliciously engage in
200	196		child sexual exploitation , as defined in this section, shall, upon
201	197		conviction, be punished by imprisonment in the cus tody of the
202	198		Department of Corrections not exceeding life imprisonment, or by
203	199		imprisonment in a county jail not exceeding one (1) year, or by a
204	200		fine of not less than Five Hundred Dollars ($500.00) nor more than
205	201		Five Thousand Dollars ($5,000.00) , or both such fine and
206	202		imprisonment except as provided in subsection I of this section for
207	203		a child victim under tw elve (12) years of age. Except for persons
208	204		sentenced to life or life without parole, any person sentenced to
209	205		imprisonment for two (2) years or more for a violation of this
210	206		subsection shall be req uired to serve a term of post-imprisonment
211	207		supervision pursuant to subparagraph f of paragraph 1 of subsection
212	208		A of Section 991a of Title 22 of the Oklahoma Statutes unde r
213	209		conditions determined by the Department of Corrections. The jury

243	238		I. Any person who shall willfully or maliciously engage in
244	239		child sexual exploitation, as defined in this section, of a child
245	240		under twelve (12) years of age sh all, upon conviction, be punished
246	241		by imprisonment in the cus tody of the Department of Corrections for
247	242		not less than twenty -five (25) years nor more than life
248	243		imprisonment, and by a fine of not less than Five Hund red Dollars
249	244		($500.00) nor more than Five Tho usand Dollars ($5,000.00).
250	245		J. Any person responsible for the health, safety or welfare of
251	246		a child who shall willfully or maliciously engage in enabling child
252	247		sexual exploitation, as defined in this section , shall, upon
253	248		conviction, be punished by imprisonm ent in the custody of the
254	249		Department of Corrections not exce eding life imprisonment, or by
255	250		imprisonment in a county jail not exceeding one (1) year, or by a
256	251		fine of not less than Five Hundred Dollars ($500.00) no r more than
257	252		Five Thousand Dollars ($5,000.00 ), or both such fine and
258	253		imprisonment.
259	254		K. Notwithstanding any other provision of law, any person
260	255		convicted of forcible anal or oral sodomy, rape, rape by
261	256		instrumentation, or lewd molestation of a child under f ourteen (14)
262	257		years of age subsequent to a prev ious conviction for any offense of
263	258		forcible anal or oral sod omy, rape, rape by instrumentation, or lewd

291	285		molestation of a child under fourteen (14) years of age shall be
292	286		punished by death or by imprisonment for life without parole.
293	287		L. Provided, however, th at nothing contained in this section
294	288		shall prohibit any pare nt or guardian from using reasonable and
295	289		ordinary force pursuant to Section 844 of this title.
296	290		M. Consent shall not be a defense for any violation pr ovided
297	291		for in this section.
298	292		N. Notwithstanding the age requirements of other statutes
299	293		referenced within this section, this section shall apply to any
300	294		child under eighteen (18) years of age.
301	295		O. As used in this secti on:
302	296		1. "Child abuse" means:
303	297		a. the willful or malicious harm or threatened harm or
304	298		failure to protect from harm or threatened harm to the
305	299		health, safety or welfare of a child under eighteen
306	300		(18) years of age by a person responsible for a
307	301		child's health, safety or welfare, or
308	302		b. the act of willfully or maliciously injuring,
309	303		torturing or maiming a child under eighteen (18) years
310	304		of age by any person ;
311	305		2. "Child neglect" means the willful or malicious neglect, as
312	306		defined by Section 1 -1-105 of Title 10A of the Oklahoma Statutes, of
313	307		a child under eighteen (18) years of age by a person responsibl e for
314	308		a child's health, safety or welfare;

342	335		3. "Child sexual abuse" means the willful or malicious sexual
343	336		abuse of a child under eighteen (18) years of age by a person
344	337		responsible for a child's health, safety or welfare and includes,
345	338		but is not limited to:
346	339		a. sexual intercourse,
347	340		b. penetration of the vagina or anus, however slight, by
348	341		an inanimate object or any part of the human body not
349	342		amounting to sexual intercourse,
350	343		c. sodomy,
351	344		d. incest, or
352	345		e. a lewd act or proposal, as defined in this section;
353	346		4. "Child sexual exploitation" means the willful or malicious
354	347		sexual exploitation of a child under eighteen (18) years of age by
355	348		another and includes, but is not limited to:
356	349		a. human trafficking, as provided for in Se ction 748 of
357	350		this title, if the offense involv ed child trafficking
358	351		for commercial sex,
359	352		b. trafficking in children, as provided for in Section
360	353		866 of this title, if the offense was committed for
361	354		the sexual gratification of any person,
362	355		c. procuring or causing the participation of a minor in
363	356		child pornography, as provided for in Section 1021.2

393	385		pornography, as provided for in Section 1024.2 of this
394	386		title,
395	387		e. engaging in or soliciting prostitution, a s provided
396	388		for in Section 1029 of this title, if the offense
397	389		involved child prostitution,
398	390		f. publication, distribution or participation in the
399	391		preparation of obscene material, as provided for in
400	392		Section 1040.8 of this title, if the offense involved
401	393		child pornography,
402	394		g. aggravated possession of child pornography, as
403	395		provided for in Section 1040.12a of this title,
404	396		h. sale or distribution of obscene material, as provided
405	397		for in Section 1040.13 of this title,
406	398		i. soliciting sexual conduct or communication with a
407	399		minor by use of technology, as provided for in Section
408	400		1043.13a 1040.13a of this title,
409	401		j. offering or transporting a child fo r purposes of
410	402		prostitution, as provided for in Section 1087 of this
411	403		title, and or
412	404		k. child prostitution, as provided for in Section 1088 of
413	405		this title;

441	432		5. "Enabling child abuse" means the causing, procuring or
442	433		permitting of child abuse by a person responsible for a child's
443	434		health, safety, or welfare causing, procuring, or permitting:
444	435		a. the willful or malicious harm or threatened harm or
445	436		failure to protect from harm or threat ened harm to the
446	437		health, safety, or welfare of a child under eighteen
447	438		(18) years of age, or
448	439		b. the act of willfully or maliciously injuring,
449	440		torturing, or maiming a child under eighteen (18)
450	441		years of age by any person ;
451	442		6. "Enabling child neglect " means the causing, procuring or
452	443		permitting of child neglect by a person responsible for a child's
453	444		health, safety, or welfare causing, procuring, or permitting child
454	445		neglect as defined by Section 1-1-105 of Title 10A of the Oklahoma
455	446		Statutes;
456	447		7. "Enabling child sexual abuse" means the causing, procuring
457	448		or permitting of child sexual abuse by a person responsible for a
458	449		child's health, safety, or welfare causing, procuring, or permitting
459	450		child sexual abuse as defined by Section 1-1-105 of Title 10A of the
460	451		Oklahoma Statutes;
461	452		8. "Enabling child sexual exploitation" means the causing,
462	453		procuring or permitting of child sexual exploitation by a person
463	454		responsible for a child's health, safety or welfare;

491	481		9. "Incest" means marrying, committing adultery or fornicating
492	482		sexual intercourse or penetration of the vagina or anus, however
493	483		slight, by an inanima te object or any part of the human body not
494	484		amounting to sexual intercourse with a child by a person responsible
495	485		for the health, safety or welfare of a child who is within the
496	486		degrees of consanguinity within which marriages are by the laws of
497	487		this state declared incestuous and void;
498	488		10. "Lewd act or proposal" means:
499	489		a. making any oral, written or electronic or computer -
500	490		generated lewd or indecent proposal to a child for the
501	491		child to have unlawful sexual relations or sexual
502	492		intercourse with any person,
503	493		b. looking upon, touching, mauling or feeling the body or
504	494		private parts of a child in a lewd or lascivious
505	495		manner or for the purpose of sexual gratification,
506	496		c. asking, inviting, en ticing or persuading any child to
507	497		go alone with any person to a secluded, remote or
508	498		secret place for a lewd or lascivious purpose,
509	499		d. urinating or defecating upon a child or causing,
510	500		forcing or requiring a child to defecate or urinate
511	501		upon the body or priv ate parts of another person for
512	502		the purpose of sexual gratif ication,
513	503		e. ejaculating upon or in the presence of a child,

542	531		look upon the body or private parts of another person
543	532		for the purpose of sexual gr atification,
544	533		g. causing, forcing or requiring any child to v iew any
545	534		obscene materials, child pornography or materials
546	535		deemed harmful to minors as such terms are defined in
547	536		Sections 1024.1 and 1040.75 of this title,
548	537		h. causing, exposing, forcing or requirin g a child to
549	538		look upon sexual acts performed in the presence of the
550	539		child for the purpose of sexual gratification, or
551	540		i. causing, forcing or requiring a child to touch or feel
552	541		the body or private parts of the child or another
553	542		person for the purpose of sexual gratification;
554	543		11. "Permit" means to authorize or allow for the care of a
555	544		child by an individual when the person authorizing or allowing su ch
556	545		care knows or reasonably should know that the child will be placed
557	546		at risk of the conduct or harm proscribed b y this section;
558	547		12. "Person responsible for a child's health, safety or
559	548		welfare" for purposes of this section shall include, but not be
560	549		limited to:
561	550		a. the parent of the child,
562	551		b. the legal guardian of the child,
563	552		c. the custodian of the child,
564	553		d. the foster parent of the child,

593	581		the parent of the child cohabitates, who is at least
594	582		three (3) years older than the child ,
595	583		f. any other person eighteen (18) years of age or older
596	584		residing in the home of the child, who is at least
597	585		three (3) years older than the child,
598	586		g. an owner, operator, agent, employee or volunteer of a
599	587		public or private residential home, institution,
600	588		facility or day treatment program, as defined in
601	589		Section 175.20 of Title 10 of the Oklaho ma Statutes,
602	590		that the child attended,
603	591		h. an owner, operator, agent, employee or volunteer of a
604	592		child care facility, as defined in Section 402 of
605	593		Title 10 of the Oklahoma Statutes, that the child
606	594		attended,
607	595		i. an intimate partner of the parent of the child, as
608	596		defined in Section 60.1 of Title 22 of the Oklahoma
609	597		Statutes, or
610	598		j. a person who has voluntarily accepted responsibility
611	599		for the care or supervision of a child;
612	600		13. "Sexual intercourse" means the actual penetration, however
613	601		slight, of the vagina or anu s by the penis; and
614	602		14. "Sodomy" means:
