4948 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5049 SECTION 1. AMENDATORY 21 O.S. 2021, Section 843.5, is
5150 amended to read as follows:
5251 Section 843.5 A. Any person who shall willfully or maliciously
5352 engage in child abuse , as defined in this section, shall, upon
5453 conviction, be guilty of a fe lony punishable by imprisonmen t in the
5554 custody of the Department of Corrections not exceed ing life
5655 imprisonment, or by imprisonment in a county jail not exceeding one
5756 (1) year, or by a fine of not les s than Five Hundred Dollars
5857 ($500.00) nor more than Five Thousand Dollars ($5,000.00), or both
5958 such fine and imprisonment.
6059 B. Any person responsible for the health, safety or w elfare of
6160 a child who shall willfully or maliciously engage in enabling child

141138 Corrections not exceeding life imprisonment , or by imprisonment in a
142139 county jail not exceeding one (1) year, or by a fine of not less
143140 than Five Hundred Dollars ($500.00) nor more than Five Thousand
144141 Dollars ($5,000.00), or both such fine and imprisonment, except as
145142 provided in Section 51.1a of this title or as otherwise provided in
146143 subsection F of this section fo r a child victim under twelve (12)
147144 years of age. Except for persons sentenced to life or life without
148145 parole, any person sentenced to imprisonment for two (2 ) years or
149146 more for a violation of thi s subsection shall be required to serve a
150147 term of post-imprisonment supervision pu rsuant to subparagraph f of
151148 paragraph 1 of subsection A of Section 991a of Title 22 of t he
152149 Oklahoma Statutes under conditions determined by the Department of
153150 Corrections. The jury shall be advised that the mandatory post-
154151 imprisonment supervision shall be in addition to the actual
155152 imprisonment.
156153 F. Any person responsible for the health, safet y or welfare of
157154 a child who shall willfully or maliciously engage in child sexual
158155 abuse, as defined in this section, to a child under twelve (12)
159156 years of age shall, upon conviction, be punished by imprisonment in
160157 the custody of the Department of Correctio ns for not less than
161158 twenty-five (25) years nor more than life imprisonment , and by a
162159 fine of not less than Five Hundred Dollars ($500.00) nor mor e than
163160 Five Thousand Dollars ($5,000.00).

200196 child sexual exploitation , as defined in this section, shall, upon
201197 conviction, be punished by imprisonment in the cus tody of the
202198 Department of Corrections not exceeding life imprisonment, or by
203199 imprisonment in a county jail not exceeding one (1) year, or by a
204200 fine of not less than Five Hundred Dollars ($500.00) nor more than
205201 Five Thousand Dollars ($5,000.00) , or both such fine and
206202 imprisonment except as provided in subsection I of this section for
207203 a child victim under tw elve (12) years of age. Except for persons
208204 sentenced to life or life without parole, any person sentenced to
209205 imprisonment for two (2) years or more for a violation of this
210206 subsection shall be req uired to serve a term of post-imprisonment
211207 supervision pursuant to subparagraph f of paragraph 1 of subsection
212208 A of Section 991a of Title 22 of the Oklahoma Statutes unde r
213209 conditions determined by the Department of Corrections. The jury

250245 J. Any person responsible for the health, safety or welfare of
251246 a child who shall willfully or maliciously engage in enabling child
252247 sexual exploitation, as defined in this section , shall, upon
253248 conviction, be punished by imprisonm ent in the custody of the
254249 Department of Corrections not exce eding life imprisonment, or by
255250 imprisonment in a county jail not exceeding one (1) year, or by a
256251 fine of not less than Five Hundred Dollars ($500.00) no r more than

259254 K. Notwithstanding any other provision of law, any person
260255 convicted of forcible anal or oral sodomy, rape, rape by
261256 instrumentation, or lewd molestation of a child under f ourteen (14)
262257 years of age subsequent to a prev ious conviction for any offense of
263258 forcible anal or oral sod omy, rape, rape by instrumentation, or lewd

291285 molestation of a child under fourteen (14) years of age shall be
292286 punished by death or by imprisonment for life without parole.
293287 L. Provided, however, th at nothing contained in this section
294288 shall prohibit any pare nt or guardian from using reasonable and
295289 ordinary force pursuant to Section 844 of this title.
296290 M. Consent shall not be a defense for any violation pr ovided
297291 for in this section.
298292 N. Notwithstanding the age requirements of other statutes
299293 referenced within this section, this section shall apply to any
300294 child under eighteen (18) years of age.
301295 O. As used in this secti on:
302296 1. "Child abuse" means:
303297 a. the willful or malicious harm or threatened harm or
304298 failure to protect from harm or threatened harm to the
305299 health, safety or welfare of a child under eighteen
306300 (18) years of age by a person responsible for a
307301 child's health, safety or welfare, or
308302 b. the act of willfully or maliciously injuring,
309303 torturing or maiming a child under eighteen (18) years
310304 of age by any person ;
311305 2. "Child neglect" means the willful or malicious neglect, as
312306 defined by Section 1 -1-105 of Title 10A of the Oklahoma Statutes, of
313307 a child under eighteen (18) years of age by a person responsibl e for
314308 a child's health, safety or welfare;

342335 3. "Child sexual abuse" means the willful or malicious sexual
343336 abuse of a child under eighteen (18) years of age by a person
344337 responsible for a child's health, safety or welfare and includes,
345338 but is not limited to:
346339 a. sexual intercourse,
347340 b. penetration of the vagina or anus, however slight, by
348341 an inanimate object or any part of the human body not
349342 amounting to sexual intercourse,
350343 c. sodomy,
351344 d. incest, or
352345 e. a lewd act or proposal, as defined in this section;
353346 4. "Child sexual exploitation" means the willful or malicious
354347 sexual exploitation of a child under eighteen (18) years of age by
355348 another and includes, but is not limited to:
356349 a. human trafficking, as provided for in Se ction 748 of
357350 this title, if the offense involv ed child trafficking
358351 for commercial sex,
359352 b. trafficking in children, as provided for in Section
360353 866 of this title, if the offense was committed for
361354 the sexual gratification of any person,
362355 c. procuring or causing the participation of a minor in
363356 child pornography, as provided for in Section 1021.2

393385 pornography, as provided for in Section 1024.2 of this

395387 e. engaging in or soliciting prostitution, a s provided
396388 for in Section 1029 of this title, if the offense
397389 involved child prostitution,
398390 f. publication, distribution or participation in the
399391 preparation of obscene material, as provided for in
400392 Section 1040.8 of this title, if the offense involved
401393 child pornography,
402394 g. aggravated possession of child pornography, as
403395 provided for in Section 1040.12a of this title,
404396 h. sale or distribution of obscene material, as provided
405397 for in Section 1040.13 of this title,
406398 i. soliciting sexual conduct or communication with a
407399 minor by use of technology, as provided for in Section
408400 1043.13a 1040.13a of this title,
409401 j. offering or transporting a child fo r purposes of
410402 prostitution, as provided for in Section 1087 of this
411403 title, and or
412404 k. child prostitution, as provided for in Section 1088 of

441432 5. "Enabling child abuse" means the causing, procuring or
442433 permitting of child abuse by a person responsible for a child's
443434 health, safety, or welfare causing, procuring, or permitting:
444435 a. the willful or malicious harm or threatened harm or
445436 failure to protect from harm or threat ened harm to the
446437 health, safety, or welfare of a child under eighteen
447438 (18) years of age, or
448439 b. the act of willfully or maliciously injuring,
449440 torturing, or maiming a child under eighteen (18)
450441 years of age by any person ;
451442 6. "Enabling child neglect " means the causing, procuring or
452443 permitting of child neglect by a person responsible for a child's
453444 health, safety, or welfare causing, procuring, or permitting child
454445 neglect as defined by Section 1-1-105 of Title 10A of the Oklahoma
455446 Statutes;
456447 7. "Enabling child sexual abuse" means the causing, procuring
457448 or permitting of child sexual abuse by a person responsible for a
458449 child's health, safety, or welfare causing, procuring, or permitting
459450 child sexual abuse as defined by Section 1-1-105 of Title 10A of the
460451 Oklahoma Statutes;
461452 8. "Enabling child sexual exploitation" means the causing,
462453 procuring or permitting of child sexual exploitation by a person
463454 responsible for a child's health, safety or welfare;

491481 9. "Incest" means marrying, committing adultery or fornicating
492482 sexual intercourse or penetration of the vagina or anus, however
493483 slight, by an inanima te object or any part of the human body not
494484 amounting to sexual intercourse with a child by a person responsible
495485 for the health, safety or welfare of a child who is within the
496486 degrees of consanguinity within which marriages are by the laws of
497487 this state declared incestuous and void;
498488 10. "Lewd act or proposal" means:
499489 a. making any oral, written or electronic or computer -
500490 generated lewd or indecent proposal to a child for the
501491 child to have unlawful sexual relations or sexual
502492 intercourse with any person,
503493 b. looking upon, touching, mauling or feeling the body or
504494 private parts of a child in a lewd or lascivious
505495 manner or for the purpose of sexual gratification,
506496 c. asking, inviting, en ticing or persuading any child to
507497 go alone with any person to a secluded, remote or
508498 secret place for a lewd or lascivious purpose,
509499 d. urinating or defecating upon a child or causing,
510500 forcing or requiring a child to defecate or urinate
511501 upon the body or priv ate parts of another person for
512502 the purpose of sexual gratif ication,
513503 e. ejaculating upon or in the presence of a child,

542531 look upon the body or private parts of another person
543532 for the purpose of sexual gr atification,
544533 g. causing, forcing or requiring any child to v iew any
545534 obscene materials, child pornography or materials
546535 deemed harmful to minors as such terms are defined in
547536 Sections 1024.1 and 1040.75 of this title,
548537 h. causing, exposing, forcing or requirin g a child to
549538 look upon sexual acts performed in the presence of the
550539 child for the purpose of sexual gratification, or
551540 i. causing, forcing or requiring a child to touch or feel
552541 the body or private parts of the child or another
553542 person for the purpose of sexual gratification;
554543 11. "Permit" means to authorize or allow for the care of a
555544 child by an individual when the person authorizing or allowing su ch
556545 care knows or reasonably should know that the child will be placed
557546 at risk of the conduct or harm proscribed b y this section;
558547 12. "Person responsible for a child's health, safety or
559548 welfare" for purposes of this section shall include, but not be
560549 limited to:
561550 a. the parent of the child,
562551 b. the legal guardian of the child,
563552 c. the custodian of the child,
564553 d. the foster parent of the child,

593581 the parent of the child cohabitates, who is at least
594582 three (3) years older than the child ,
595583 f. any other person eighteen (18) years of age or older
596584 residing in the home of the child, who is at least
597585 three (3) years older than the child,
598586 g. an owner, operator, agent, employee or volunteer of a
599587 public or private residential home, institution,
600588 facility or day treatment program, as defined in
601589 Section 175.20 of Title 10 of the Oklaho ma Statutes,
602590 that the child attended,
603591 h. an owner, operator, agent, employee or volunteer of a
604592 child care facility, as defined in Section 402 of
605593 Title 10 of the Oklahoma Statutes, that the child
606594 attended,
607595 i. an intimate partner of the parent of the child, as
608596 defined in Section 60.1 of Title 22 of the Oklahoma
609597 Statutes, or
610598 j. a person who has voluntarily accepted responsibility
611599 for the care or supervision of a child;
612600 13. "Sexual intercourse" means the actual penetration, however
613601 slight, of the vagina or anu s by the penis; and
614602 14. "Sodomy" means:

644631 b. penetration, however slight, of the vagina of a person
645632 responsible for a child's health, safety or welfare,
646633 by the mouth of a child,
647634 c. penetration, however slight, of the mouth of the
648635 person responsible for a child's health, safety or
649636 welfare by the penis of the child , or
650637 d. penetration, however slight, of the vagina of the
651638 child by the mouth of the person responsible for a
652639 child's health, safety or welfare.
653640 SECTION 2. This act shall be come effective November 1, 2023.
