54 | 59 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

55 | 60 | | SECTION 1. AMENDATORY 63 O.S. 20 21, Section 2-402, is |
---|
56 | 61 | | amended to read as follows: |
---|
57 | 62 | | Section 2-402. A. 1. It shall be unlawful for any person |
---|
58 | 63 | | knowingly or intentionally to p ossess a controlled dangerous |
---|
59 | 64 | | substance unless such substance was obtained directly, or pursuant |
---|
60 | 65 | | to a valid prescription or order from a practitioner, while acting |
---|
61 | 66 | | in the course of his or her professional practice, or except as |
---|
62 | 67 | | otherwise authorized by this act. |
---|
91 | 97 | | Dangerous Substances Act pursuant to Section 2 -313 of this title in |
---|
92 | 98 | | an amount or within a time interval other than that permitt ed by |
---|
93 | 99 | | Section 2-313 of this title. |

94 | 100 | | 3. It shall be unlawful for any person or business to sell, |
---|
95 | 101 | | market, advertise or label any product containing ephedrine, its |
---|
96 | 102 | | salts, optical isomers, or salts of optical isomers, for the |
---|
97 | 103 | | indication of stimulation, mental alertness, weight loss, appetite |
---|
98 | 104 | | control, muscle development, energy or other indication which is not |
---|
99 | 105 | | approved by the pertinent federal OTC Final Monograph, Tentative |
---|
100 | 106 | | Final Monograph, or FDA-approved new drug application or its legal |
---|
101 | 107 | | equivalent. In determ ining compliance with this requirement, the |
---|
102 | 108 | | following factors shall be considered: |
---|
103 | 109 | | a. the packaging of the product, |
---|
104 | 110 | | b. the name of the product, and |
---|
105 | 111 | | c. the distribution and promotion of the product, |
---|
106 | 112 | | including verbal representations made at the point of |
---|
107 | 113 | | sale. |
---|
108 | 114 | | B. 1. Any person who violates this section is guilty of a |
---|
109 | 115 | | misdemeanor punishable by confinement for not more than one (1) year |
---|
110 | 116 | | and by a fine not exceeding One Thousand Dollars ($1, 000.00). |
---|
111 | 117 | | 2. Any person who is convicted, receives a deferred sentence, |
---|
112 | 118 | | or receives a suspended sentence for an offense provided for in this |
---|
141 | 148 | | section shall, upon conviction, be guilty of a misdemeanor |
---|
142 | 149 | | punishable as such terms are provided for in paragraph 1 of this |
---|
143 | 150 | | subsection. In addition, the person may be required to: |
---|
144 | 151 | | a. complete a substance abuse assessment or evaluation |
---|
145 | 152 | | and follow the recommendatio ns subsequent thereto, and |
---|
146 | 153 | | b. complete a drug diversion program for up to one (1) |
---|
147 | 154 | | year following the date of conviction as ordered by |
---|
148 | 155 | | the court. If the person refuses or fails to complete |
---|
149 | 156 | | the drug diversion program, the person may be subject |
---|
150 | 157 | | to the terms of punishment provided for in paragraph 1 |
---|
151 | 158 | | of this subsection. |
---|
152 | 159 | | 3. Any person who is convicted, receives a deferred sentence, |
---|
153 | 160 | | or receives a suspended sentence for an offense provided for in this |
---|
154 | 161 | | section, excluding the use of marijuana, and receives a third or |
---|
155 | 162 | | subsequent conviction within ten (10) years for an offense provided |
---|
156 | 163 | | for in this section shall, upon conviction, be guilty of a |
---|
157 | 164 | | misdemeanor punishable as such terms are provided for in paragraph 1 |
---|
158 | 165 | | of this subsection. In addition, the person may be required to: |
---|
159 | 166 | | a. complete a substance abuse assessment or evaluation |
---|
160 | 167 | | and follow the recommendations subsequent thereto, and |
---|
161 | 168 | | b. complete a drug diversion program for up to three (3) |
---|
162 | 169 | | years following the date of conviction as ordered by |
---|
