4045 An Act relating to public health and safety; ame nding
4146 63 O.S. 2021, Section 2-402, which relates to the
4247 Uniform Controlled Dangerous Substances Act;
4348 providing separate penalties for unlawfully
4449 possessing controlled dangerous substances;
4550 authorizing the referral of violations to certain
4651 courts; authorizing municipalities to adopt

5459 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5560 SECTION 1. AMENDATORY 63 O.S. 20 21, Section 2-402, is
5661 amended to read as follows:
5762 Section 2-402. A. 1. It shall be unlawful for any person
5863 knowingly or intentionally to p ossess a controlled dangerous
5964 substance unless such substance was obtained directly, or pursuant
6065 to a valid prescription or order from a practitioner, while acting
6166 in the course of his or her professional practice, or except as
6267 otherwise authorized by this act.
63-2. It shall be unlawful for any person to purchase any
64-preparation excepted from the provisions of the Unifo rm Controlled

95+2. It shall be unlawful for any person to purchase any
96+preparation excepted from the provisions of the Unifo rm Controlled
9197 Dangerous Substances Act pursuant to Section 2 -313 of this title in
9298 an amount or within a time interval other than that permitt ed by
9399 Section 2-313 of this title.
94100 3. It shall be unlawful for any person or business to sell,
95101 market, advertise or label any product containing ephedrine, its
96102 salts, optical isomers, or salts of optical isomers, for the
97103 indication of stimulation, mental alertness, weight loss, appetite
98104 control, muscle development, energy or other indication which is not
99105 approved by the pertinent federal OTC Final Monograph, Tentative
100106 Final Monograph, or FDA-approved new drug application or its legal
101107 equivalent. In determ ining compliance with this requirement, the
102108 following factors shall be considered:
103109 a. the packaging of the product,
104110 b. the name of the product, and
105111 c. the distribution and promotion of the product,
106112 including verbal representations made at the point of
107113 sale.
108114 B. 1. Any person who violates this section is guilty of a
109115 misdemeanor punishable by confinement for not more than one (1) year
110116 and by a fine not exceeding One Thousand Dollars ($1, 000.00).
111117 2. Any person who is convicted, receives a deferred sentence,
112118 or receives a suspended sentence for an offense provided for in this
113-section, excluding the use of marijuana, and receives a second
114-conviction within ten (10) years for an offense provided for in this

146+section, excluding the use of marijuana, and receives a second
147+conviction within ten (10) years for an offense provided for in this
141148 section shall, upon conviction, be guilty of a misdemeanor
142149 punishable as such terms are provided for in paragraph 1 of this
143150 subsection. In addition, the person may be required to:
144151 a. complete a substance abuse assessment or evaluation
145152 and follow the recommendatio ns subsequent thereto, and
146153 b. complete a drug diversion program for up to one (1)
147154 year following the date of conviction as ordered by
148155 the court. If the person refuses or fails to complete
149156 the drug diversion program, the person may be subject
150157 to the terms of punishment provided for in paragraph 1
151158 of this subsection.
152159 3. Any person who is convicted, receives a deferred sentence,
153160 or receives a suspended sentence for an offense provided for in this
154161 section, excluding the use of marijuana, and receives a third or
155162 subsequent conviction within ten (10) years for an offense provided
156163 for in this section shall, upon conviction, be guilty of a
157164 misdemeanor punishable as such terms are provided for in paragraph 1
158165 of this subsection. In addition, the person may be required to:
159166 a. complete a substance abuse assessment or evaluation
160167 and follow the recommendations subsequent thereto, and
161168 b. complete a drug diversion program for up to three (3)
162169 years following the date of conviction as ordered by
163-the court. If the person refuses or fails to complete
164-the drug diversion program, the person may be subject

193201 C. Violations under this section shall be referred to the state
194-or to a municipal court of record for prosecution. The offense may
195-be prosecuted in a municipal court n ot of record if the court has

197-in subparagraphs a and b of paragraph s 2 and 3 of subsection B of
198-this section as a component of a sentence, deferred sente nce, or
199-suspended sentence. Municipal courts may adopt ordinances
200-consistent with the provisions of this section.

205210 Section 1-2530.9 of this title.
206211 SECTION 2. This act shall become effective November 1, 2023.
