42	42	Care Authority to review payment data for Medicaid
43	43	providers; directing the Authority to provide pay ment
44	44	to Medicaid providers during gap period ; providing
45	45	for codification; providing an effective date; and

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 5029.1 of Title 63, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	As used in this act:
57	57	1. "Gap period" means the period as of which the Medicaid
58	58	program payment system is transitioned over to the managed care
59	59	organizations;
60	60	SECTION 2. NEW LAW A new sec tion of law to be codified
61	61	in the Oklahoma Statutes as Section 5029.2 of Title 63, unless there
62	62	is created a duplication in numbering, reads as follows:

89	89	A. The Oklahoma Health Care Authority shall examine payment
90	90	information data for each service provider to whom the Authority has
91	91	made Medicaid payments during the three (3) month payment period
92	92	preceding the gap period.
93	93	B. The Authority shall ensure payment to all Medicaid service
94	94	providers in the Medicaid program for the 15 day period during the
95	95	gap period in an amount equal to the average as calculated pursuant
96	96	to the provisions of subsection A of this Section divided by the
97	97	whole number two (2).
98	98	SECTION 3. This act shall become effective July 1, 2023.
99	99	SECTION 4. It being immediately necessary for the preservation
100	100	of the public peace, health or safety, an emergency is hereby
101	101	declared to exist, by reason whereof thi s act shall take effect and
102	102	be in full force from and after its passage and approval.
