AS INTRODUCED 
 
An Act relating to Medicaid payment to providers ; 
providing definition ; directing the Oklahoma Health 
Care Authority to review payment data for Medicaid 
providers; directing the Authority to provide pay ment 
to Medicaid providers during gap period ; providing 
for codification; providing an effective date; and 
declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 5029.1 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
As used in this act: 
1. "Gap period" means the period as of which the Medicaid 
program payment system is transitioned over to the managed care 
organizations; 
SECTION 2.     NEW LAW     A new sec tion of law to be codified 
in the Oklahoma Statutes as Section 5029.2 of Title 63, unless there 
is created a duplication in numbering, reads as follows:

A. The Oklahoma Health Care Authority shall examine payment 
information data for each service provider to whom the Authority has 
made Medicaid payments during the three (3) month payment period 
preceding the gap period. 
B. The Authority shall ensure payment to all Medicaid service 
providers in the Medicaid program for the 15 day period during the 
gap period in an amount equal to the average as calculated pursuant 
to the provisions of subsection A of this Section divided by the 
whole number two (2). 
SECTION 3.  This act shall become effective July 1, 2023. 
SECTION 4.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and approval.
