5754 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5855 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.545, is
5956 amended to read as follows :
6057 Section 1210.545 A. Except as otherwise provided, as part of
6158 the accountability system developed as provided for in Section
6259 1210.541 of this title, the State Board of Education shall prepare
6360 annual reports of the results of the Oklahoma School Testing Program
6461 which describe student achievement in the state, and each school
6562 site, pursuant to the Elementary and Secondary Education Act of 1965
63+(ESEA) as reauthorized by P.L. No. 114 -95, also known as the Every
64+Student Succeeds Act (ESSA), and any related fe deral regulations.

94-Student Succeeds Act (ESSA), and any related federal regulations.
9591 B. The Beginning with the 202 4-2025 school year, the annual
9692 report as required pursuant to subsection A of this section shall
9793 identify not assign school sites as having one of the following
9894 grades for each indicator, separately, and by a single overview
9995 grade of all indicators, defined according to rules of the State
10096 Board of Education:
10197 1. "A" means schools making excellent progress;
10298 2. "B" means schools making above average progress;
10399 3. "C" means schools making satisfactory progress;
104100 4. "D" means schools making less than satisfactory progress;
105101 and
106102 5. "F" means schools failing to make adequate progress or
107103 school districts any gra des.
108104 C. Each school that has students who are tested and included in
109105 the school grading system as provide d for in this section shall
110106 receive a school grade, except as follows:
111107 1. A school shall not receive a school grade if the number of
112108 students tested and included in the school grading system is less
113109 than the minimum sample size necessary for statistical r eliability
114110 and prevention of the unlawful release of personally identifiable
115111 student data. The State Board of Education is directed to establish
112+the lowest minimum sample size necessary to meet the requirements of
113+this paragraph; and

143-the lowest minimum sample size necessary to meet the requirements of
144-this paragraph; and
145140 2. The academic perf ormance of students who are enrolled full-
146141 time in an online program that is offered by a school district or
147142 charter school that is not the district of residence or is not
148143 located in the district of residence of the student shall be
149144 reported separately by t he school district or chart er school and
150145 shall not be included when determining the grade of the school site
151146 or charter school.
152147 D. The State Board of Education may adopt alternate systems of
153148 accountability for statewide virtual charter schools, alternativ e
154149 education programs as def ined in Section 1210.568 of this title, and
155150 schools serving only grades prekindergarten or kindergarten through
156151 two.
157152 E. D. The grade annual report of a school shall be based on a
158153 multimeasures approach to accountability , in accordance with the
159154 Elementary and Secondary Education Act of 1965 (ESEA) as
160155 reauthorized by P.L. No. 114 -95, also known as the Every Student
161156 Succeeds Act (ESSA) and any federal regulations , that include, but
162157 are not limited to, the following indicators:
163158 1. Statewide assessments, inclu ding the establishment of
164159 student performance bands;
165160 2. Graduation rates for high schools;
161+3. Statewide academic measures for elementary and middle
162+schools;
163+4. English language proficiency for English learners; and

195-4. English language proficiency for English learners; and
196190 5. At least one additional statewide measure of school quality
197191 or student success, including, but not limited to, school School
198192 climate, school safety, student engagement, educator engagement,
199193 and/or advanced coursework and postsecondary readiness .
200194 F. Of the indicators included in subsection E of this section,
201195 not less than seventy p ercent (70%) of the overview grade must be
202196 given to indicators 1, 2, 3 and 4 and, in the aggregate, with not
203197 more than thirty percent (30%) of the grade given to indicator 5.
204198 G. E. Further, the grade annual report of an elementary or
205199 middle school site shall include, but not be limited to, a measure
206200 of status for English language arts Language Arts (ELA), math and
207201 science, growth in ELA and math, and English Language Proficiency
208202 Assessment (ELPA) progress, and chronic absenteeism.
209203 H. F. The grade annual report of a high school site shall
210204 include, but not be limited to, a measure of status for English
211205 language arts Language Arts (ELA), math and science status, English
212206 Language Proficiency Assessment (ELPA) progress , graduation rate,
213207 chronic absenteeism, and postsecondary opportunities. For purposes
214208 of this section postse condary opportunities shall include Advanced
215209 Placement, International Baccalaureate, dual and concurrent
216210 enrollment, internships, mentorships and a pprenticeships, and
211+industry certifications. The Board shall adopt a time line for
212+moving from completion of such opportunities to crediting
213+achievement of such opportunities.

244-industry certifications. The Board shall adopt a time line for
245-moving from completion of such opportunities to crediting
246-achievement of such opportunities.
247240 I. G. The annual report shall identify the performa nce of each
248241 school as having improved, remained the same, or declined. This
249242 school improvement rating shall be based on a comparison of th e
250243 student and school performance data of the current year to the
251244 previous year data.
252245 J. H. The State Department of E ducation shall annually dev elop
253246 a school site report card to be delivered to parents throughout each
254247 school district. The annual report card shall be in accordance with
255248 the requirements of the Elementary and Secondary Education Act of
256249 1965 (ESEA), as reau thorized and amended by P.L . No. 114-95, also
257250 known as the Every Student Succeeds Act (ESSA) and includes the
258251 grade for the school, include information regarding school
259252 improvement, an explanation of school performance, and indicators of
260253 return on investment. The annual report card for each school site
261254 shall be published annually by the Department on its website, and
262255 every school district shall provide the school si te annual report
263256 card to the parent or guardian of each student enrolled in at the
264257 school site. In order to provide in formation regarding school
265258 performance for school report cards issued during the 2016 -2017 and
266259 2017-2018 school year, the Department shall include an explanation
267260 of the changes to the statewide system of student assessments as
261+required in Section 1210.508 of this title and how the transition in
262+assessments may impact school performance. The Department shall

304296 SECTION 2. This act shall become effective November 1, 2023.
