3354 SECTION 1. AMENDATORY 82 O.S. 2021, Section 1085.91, is

56100 of Oklahoma, and any rural water or sewer district, ir rigation

76142 B. Within the Water Resources Fund created pursuant to Section
77143 1085.33 of Title 82 of the Oklahoma Statutes, there is hereby
78144 created the "Flood Hazard Mitigation Account ". The account shall be
79145 set apart as a permanent and perpetual accou nt not subject to fiscal
80146 year limitations and shall consist of:

82147 1. All monies appropriated to the account;
83-
84148 2. Interest income from deposits made to the Statewide Water
85149 Development Revolving Fund for the purpose of f lood hazard
86150 mitigation;

88151 3. All income from the investment of monies held in the account
89152 consistent with applicable bond resolutions or indentures ; and

91153 4. Any other sums designated for deposit to the account from
92154 any source, public or private.

94155 C. The monies in the account shall be used by the Oklahoma
95156 Department of Civil Emergency Management and the Oklahoma Water
96157 Resources Board after receipt of recommendations from the State
97158 Hazard Mitigation Team, to implement flood hazard mitigation
98159 projects, including but not limited to providing grants o r loans to
99160 eligible entities to:

101161 1. Acquire land or a conservation easement from a willing
102162 seller or grantor in order to mitigate flood hazards; or

104163 2. Implement voluntary, incentive -based flood hazard mitigation
105164 measures in order to facilitate compliance with state or national
106165 regulations.

108193 There is hereby created in the State Treasury a revolving f und
109194 for the Oklahoma Water Resources Board to be designated the "Hazard
110195 Mitigation Financial Assistance Fund ". The fund shall be a
111196 continuing fund, not subject to fiscal year limitations, and shall
112197 consist of all monies received by the Oklahoma Water Res ources Board
113198 from appropriations, dedicated revenues, fees or other sources as
114199 provided by law. All monies accruing to th e credit of said fund are
115200 hereby appropriated and may be budgeted and expended by the Oklahoma
116201 Water Resources Board for the purpose of providing loans and grants
117202 for hazard mitigation. Expenditures from said fund shall be made
118203 upon warrants issued by the State Treasurer against claims filed a s
119204 prescribed by law with the Director of the O ffice of Management and
120205 Enterprise Services for approval and payment.

143250 consistent with Federal Emergency Management Agency federal agencies
144251 procedures or guidance or regulations promulgated thereunder for
145252 flood hazard mitigation projects.

147253 E. D. Monies in the Flood Hazard Mitigation Account Financial
148254 Assistance Fund, or investment income deriv ed therefrom, shall be
149255 used by the Oklahoma Water Resources Board and the Oklahoma
150256 Department of Civil Emergency Management and Homeland Security in
151257 carrying out their responsibilities as provided in a w ritten annual
152258 joint operating agreement which shall i nclude, among other matters,
153259 a budget for administering the Oklahoma Flood Hazard Mitigation
154260 Program.

156261 F. E. The monies placed in the Flood Hazard Mitigation Account
157262 Financial Assistance Fund may be invested by the State Treasurer in
158263 an adequately collateralized manner and as prescribed by Section
159264 89.2 of Title 62 of the Oklahoma Statutes or pursuant to investment
160265 contracts or agreements with entiti es maintaining a rating in the
161266 top two categories by a na tionally recognized municipal bond rating

163295 Water Act or regulations promulgated thereunder regulations. The
164296 Board may transfer to the Flood Hazard Mitigation Account Financial
165297 Assistance Fund income derived from investment of the fund. Monies
166298 invested by the State Treasurer shall be available to implement
167299 flood hazard mitigation projects.

169300 G. F. The Board shall cause to be completed an annual aud it of
170301 any expenditures from the Flood Hazard Mitigation Account Financial
171302 Assistance Fund, and such audit cost shall be included in the budget
172303 for administering the Oklahoma Flood Hazard Mitigation Program.

174304 SECTION 4. AMENDATORY 82 O.S. 2021, Section 1085.94, is

178307 provided by law, the Oklahoma Water Resources Board shall have the

245415 be conducted on private ly owned real property, the loan or g rant
