31	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33	54		SECTION 1. AMENDATORY 82 O.S. 2021, Section 1085.91, is
34	55		amended to read as follows:

36	56		Section 1085.91 In addition to the financial assistance program
37	57		programs established under Sections 1085.31 through 1085.49, 1085.51
38	58		through 1085.65, and 1085.71 through 1085.84A of Title 82 of the
39	59		Oklahoma Statutes this title pursuant to Section 39 of A rticle X of
40	60		the Oklahoma Constitution, it is the intention of the Legislature t o
41	61		establish a Flood Hazard Mitigation Financial Assistance Program.

52	97		situation which poses a repetitive threat to life, property, or
53	98		public safety from the effects of a flood disaster;

55	99		2. "Eligible entity" means any city, town, county, or the State
56	100		of Oklahoma, and any rural water or sewer district, ir rigation
57	101		district, public trust, master conservancy district, or other
58	102		political subdivision or any combination thereof;

60	103		3. "Board" means the Oklahoma Water Resources Board; and

62	104		4. "Department" means the Oklahoma Department of Civil
63	105		Emergency Management and Homeland Security.

65	106		SECTION 3. AMENDATORY 82 O.S. 2021, Section 1085.93, is
66	107		amended to read as follows:

68	108		Section 1085.93 A. In addition to other lawful purposes,
69	109		monies placed in the Statewide Water Development Revolving Fund,
70	110		exclusive of such amounts of interest derived from investment
71	111		deposits necessary to maintain the grant account at its maximum
72	112		amount as provided in Section 1085.40 of this title, may be used by
73	113		the Board for flood hazard mitigation projects pursuant to th e Flood
74	114		Hazard Mitigation Financial Ass istance Program.

76	142		B. Within the Water Resources Fund created pursuant to Section
77	143		1085.33 of Title 82 of the Oklahoma Statutes, there is hereby
78	144		created the "Flood Hazard Mitigation Account ". The account shall be
79	145		set apart as a permanent and perpetual accou nt not subject to fiscal
80	146		year limitations and shall consist of:

82	147		1. All monies appropriated to the account;
83		-
84	148		2. Interest income from deposits made to the Statewide Water
85	149		Development Revolving Fund for the purpose of f lood hazard
86	150		mitigation;

88	151		3. All income from the investment of monies held in the account
89	152		consistent with applicable bond resolutions or indentures ; and

91	153		4. Any other sums designated for deposit to the account from
92	154		any source, public or private.

94	155		C. The monies in the account shall be used by the Oklahoma
95	156		Department of Civil Emergency Management and the Oklahoma Water
96	157		Resources Board after receipt of recommendations from the State
97	158		Hazard Mitigation Team, to implement flood hazard mitigation
98	159		projects, including but not limited to providing grants o r loans to
99	160		eligible entities to:

101	161		1. Acquire land or a conservation easement from a willing
102	162		seller or grantor in order to mitigate flood hazards; or
103		-
104	163		2. Implement voluntary, incentive -based flood hazard mitigation
105	164		measures in order to facilitate compliance with state or national
106	165		regulations.

108	193		There is hereby created in the State Treasury a revolving f und
109	194		for the Oklahoma Water Resources Board to be designated the "Hazard
110	195		Mitigation Financial Assistance Fund ". The fund shall be a
111	196		continuing fund, not subject to fiscal year limitations, and shall
112	197		consist of all monies received by the Oklahoma Water Res ources Board
113	198		from appropriations, dedicated revenues, fees or other sources as
114	199		provided by law. All monies accruing to th e credit of said fund are
115	200		hereby appropriated and may be budgeted and expended by the Oklahoma
116	201		Water Resources Board for the purpose of providing loans and grants
117	202		for hazard mitigation. Expenditures from said fund shall be made
118	203		upon warrants issued by the State Treasurer against claims filed a s
119	204		prescribed by law with the Director of the O ffice of Management and
120	205		Enterprise Services for approval and payment.

122	206		B. In addition to other lawful purposes, monies placed i n the
123	207		Fund, exclusive of such amounts of int erest derived from investment
124	208		deposits necessary to maintain the grant account, may b e used by the
125	209		Board to implement hazard mitigation planning and projects,
126	210		including but not limited to , providing grants or loans to eligible

129	212		1. Develop a federal/state approved local/regional hazard
130	213		mitigation planning document;

139	246		D. C. Monies in, or investment income derived from, the Flood
140	247		Hazard Mitigation Account Financial Assistance Fund which is used to
141	248		match any grant funds provided by the Federal Emergency Man agement
142	249		Agency or any other federal age ncies shall be restricted and used
143	250		consistent with Federal Emergency Management Agency federal agencies
144	251		procedures or guidance or regulations promulgated thereunder for
145	252		flood hazard mitigation projects.

147	253		E. D. Monies in the Flood Hazard Mitigation Account Financial
148	254		Assistance Fund, or investment income deriv ed therefrom, shall be
149	255		used by the Oklahoma Water Resources Board and the Oklahoma
150	256		Department of Civil Emergency Management and Homeland Security in
151	257		carrying out their responsibilities as provided in a w ritten annual
152	258		joint operating agreement which shall i nclude, among other matters,
153	259		a budget for administering the Oklahoma Flood Hazard Mitigation
154	260		Program.

156	261		F. E. The monies placed in the Flood Hazard Mitigation Account
157	262		Financial Assistance Fund may be invested by the State Treasurer in
158	263		an adequately collateralized manner and as prescribed by Section
159	264		89.2 of Title 62 of the Oklahoma Statutes or pursuant to investment
160	265		contracts or agreements with entiti es maintaining a rating in the
161	266		top two categories by a na tionally recognized municipal bond rating

164	296		Board may transfer to the Flood Hazard Mitigation Account Financial

166	298		invested by the State Treasurer shall be available to implement
167	299		flood hazard mitigation projects.

169	300		G. F. The Board shall cause to be completed an annual aud it of
170	301		any expenditures from the Flood Hazard Mitigation Account Financial
171	302		Assistance Fund, and such audit cost shall be included in the budget
172	303		for administering the Oklahoma Flood Hazard Mitigation Program.

174	304		SECTION 4. AMENDATORY 82 O.S. 2021, Section 1085.94, is
175	305		amended to read as follows:

177	306		Section 1085.94 A. In addition to ot her powers and duties
178	307		provided by law, the Oklahoma Water Resources Board shall have the

207	359		the proceeds of investment certificates to eligible
208	360		entities for flood hazard mitigation pro jects upon
209	361		terms not inconsistent with the provisions of Section
210	362		1085.36 of Title 82 of the Oklahoma Statutes this
211	363		title; and

213	364		5. Enter into agreement s with the Oklahoma Department of Civil
214	365		Emergency Management and Homeland Security or other state or fe deral
215	366		agencies as deemed necessary by the Boar d to monitor and measure
216	367		flood hazard events.

236	408		SECTION 5. AMENDATORY 82 O.S. 2021, Section 1085.95, is
237	409		amended to read as follows:

239	410		Section 1085.95 A. Loans and grants unde r the Flood Hazard
240	411		Mitigation Financial Assistance Program may be used in conjunction
241	412		with other financial assistance available from the Okl ahoma Water
242	413		Resources Board.

244	414		B. If a flood hazard mitigation pr oject includes activities to
245	415		be conducted on private ly owned real property, the loan or g rant
246	416		agreement between the Board and the eligible entity th at receives
247	417		the grant shall contain a provis ion about any necessary
248	418		subagreements with the owners of the pro perty.
