Page 1, strike the title, enacting clause and entire bill and insert “An Act relating to teachers; requiring certain teachers who take and pass certain examination to be reimbursed certain amount; amending 70 O.S. 2021, Section 6-106.1, which relates to mentor teacher stipends; directing the allocation o f funds to school districts for certain purpose; directin g a mentor teacher to provide certain support to certain teachers; providing for codification; providing an effective date; and declaring an emergency . BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law t o be codified in the Oklahoma Statutes as Section 6-101.9 of Title 70, unless there is created a duplication in numb ering, reads as follo ws: A teacher who is certified pursuant to Section 6-122.3 or 6-187 of Title 70 of the Oklahoma Statutes and who, at the request of the employing school district, takes a nd passes a subject area competency examination required by Section 6-187 of Title 70 of the Oklahoma Statutes to earn certification and teach an additional subject in the school district shall be reimburs ed by the school district. The reimbursement shall be an amount equal to the cost of the subject area competency examination. SECTION 2. AMENDATORY 70 O.S. 2021, Section 6 -106.1, is amended to read as follows: ENGR. S. A. The funds shall be distributed by the Board to the school districts to provide a stipen d of not more than Five Hundred Dollars ($500.00) per year for each mentor teacher as defined in Section 6-182 of this title. In addition to the distribution of the five-hundred-dollar stipend, each district shall also receive the district’s contribution amount necessary to meet the Federal Insurance Contributions Act (F.I.C.A.) r equirements. B. A mentor teacher sha ll provide guidance, suppo rt, coaching, and assistance to a teacher in his or her first year of teaching at an employing school district, rega rdless of the length of time the teacher has been certified. SECTION 3. This act shall become eff ective July 1, 2023. SECTION 4. It being immediately necessary for the preservation of the public peace, health, or safety, an emergency is hereby declared to exist, by reason whereof thi s act shall take effect and be in full force from an d after its passage and approval. ” ENGR. Except as provided in subsection B of this sec tion, beginning July 1, 2023, the transfer of a student from one school site to another school site within the school district where the student resides shall be approved at any time in the year , unless the grade level of the receiving school site has reached capacity. If the capacity of a grade level is insufficient to enroll all eligible students, the school district shall select intra-district transfer students based on the preferences outlined in paragraph 1 of subsection B of this section and then in the order in which the intra-district transfer applications were received. The capacity of a school site shall be determined by the school district board o f education based on its policy adopted pursuant to subsection B of this section. A student may be granted a one-year intra-district transfer and may automatically continue to attend the school each school year to which the student transferred with the ap proval of the school district. At the end of each school year, a school district may deny continued intra-district transfer of the student for the reasons outlined in paragraphs 2 and 3 of subsection B of this section. Any sibling of a student who transf ers intra-district may attend the school site to which the student transferred, if the school district policy gives preference to sibling transfers regardless of capacity, and the sibling of the transferred student does not meet a basis for denial as outli ned in paragraphs 2 and 3 of subsection B of this section. B. Each school district board of education shall adop t a policy to determine the number o f intra-district transfer students the school district has the capacity to accept in each grade level for each school site within a school district no later than July 1, 2023. The policy shall be publicly posted on the school district website. The policy: 1. Shall include an enrollment preference and reserve capacity for: a. students who reside in the school site boundary, b. students who attended the school site the prior school year, and c. siblings of students who are already enrolled at the school site; 2. May include the acts and reasons outlined in Section 24- 101.3 of Title 70 of the Oklahoma Statutes as a basis for denial of an intra-district transfer; and 3. May include a history of absences as a basis for den ial of an intra-district transfer. For the purposes of this section, "history of absences" means ten or more absences in one semester that are not excused for the reasons provided in subsection B of ENGR. H. B. By the first day of January, April, July, and October of each year, the school district board of education shall establish the number of intra-district transfer students the school district has the capacity to accept in each grade level for each school site within the district. D. After establishing the number of intra-district transfer students the school district has the capacity to accept in each grade level for each school site , the board of education shall: 1. Publish in a prominen t place on the school district websi te the number of intra-district transfer students for each grade level for each school site within the school district which the district has the capacity to accept; and 2. Report to the State Department of Education th e number of intra-district transfer students for each grade level for each school site within the school district which the district has the capacity to accept. SECTION 6. This act shall be come effective July 1, 2023. SECTION 7. It being immediately necessar y for the preservation of the public peace, health or safety, an emergency is hereby ENGR. H. B.
