40	40	An Act relating to schools; defining terms; requiring
41	41	school district board of educatio n to permit a
42	42	private school student to enroll on a part-time
43	43	basis; granting preference to private school students
44	44	who meet residency requirements; providing for
45	45	promulgation of rules; providing for codification;
46	46	providing an effective date; and declaring an
47	47	emergency.

52	52	BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 1-114.3 of Title 70, unless
55	55	there is created a duplication in numbering, reads as follows:
56	56	A. As used in this section:
57	57	1. "Private school student" means any student who is enrolled
58	58	in a private school or receiving education by other means pursuant
59	59	to Section 10-105 of Title 70 of the Oklahoma Statutes; and
60	60	2. "Part-time basis" means a student who is enrolled in one or
61	61	more courses, services, or activities of a public school on a less
62	62	than full-time basis.

89	89	B. The board of education of a school district shall permit , in
90	90	the same manner as public school students pursuant to Section 1-114
91	91	of Title 70 of the Oklahoma Statutes, the enrollment of a private
92	92	school student on a part -time basis. Preference shall be given to
93	93	part-time students who are otherwise eligible for full -time
94	94	enrollment in the school district due to residency requirements.
95	95	C. The State Board of Ed ucation may promulgate rules to
96	96	implement the provisions of this section.
97	97	SECTION 2. This act shall become effective July 1, 2023.
98	98	SECTION 3. It being immediately ne cessary for the preservation
99	99	of the public peace, health or safety, an emergency is hereby
100	100	declared to exist, by reason whereof thi s act shall take effect and
101	101	be in full force from and after its passage and approval.
