4040 An Act relating to schools; defining terms; requiring
4141 school district board of educatio n to permit a
4242 private school student to enroll on a part-time
4343 basis; granting preference to private school students
4444 who meet residency requirements; providing for
4545 promulgation of rules; providing for codification;
4646 providing an effective date; and declaring an
4747 emergency.

5252 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. NEW LAW A new section of law to be codified
5454 in the Oklahoma Statutes as Section 1-114.3 of Title 70, unless
5555 there is created a duplication in numbering, reads as follows:
5656 A. As used in this section:
5757 1. "Private school student" means any student who is enrolled
5858 in a private school or receiving education by other means pursuant
5959 to Section 10-105 of Title 70 of the Oklahoma Statutes; and
6060 2. "Part-time basis" means a student who is enrolled in one or
6161 more courses, services, or activities of a public school on a less
6262 than full-time basis.

8989 B. The board of education of a school district shall permit , in
9090 the same manner as public school students pursuant to Section 1-114
9191 of Title 70 of the Oklahoma Statutes, the enrollment of a private
9292 school student on a part -time basis. Preference shall be given to
9393 part-time students who are otherwise eligible for full -time
9494 enrollment in the school district due to residency requirements.
9595 C. The State Board of Ed ucation may promulgate rules to
9696 implement the provisions of this section.
9797 SECTION 2. This act shall become effective July 1, 2023.
9898 SECTION 3. It being immediately ne cessary for the preservation
9999 of the public peace, health or safety, an emergency is hereby
100100 declared to exist, by reason whereof thi s act shall take effect and
101101 be in full force from and after its passage and approval.
