49 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

50 | 53 | | SECTION 1. AMENDATORY 82 O.S. 2021, Section 1020.11, is |
---|
51 | 54 | | amended to read as follows: |

52 | 55 | | Section 1020.11 A. Regular Permit. A regular permit is an |
---|
53 | 56 | | authorization to put groundwat er to beneficial use for other than |
---|
54 | 57 | | domestic purposes. The regular permit shall be granted only after |
---|
55 | 58 | | completion of the hydrologic survey and determination of the maximum |
---|
56 | 59 | | annual yield for the appropriate basin or subbasin. It can be |
---|
57 | 60 | | revoked or canceled o nly as provided in Sections 1020.12 and 10 20.15 |
---|
58 | 61 | | of this title. |

59 | 62 | | B. Temporary Permit. |
---|

91 | 93 | | 2. Except as otherwise provided by this subsection, unle ss |
---|
92 | 94 | | requested by a majority of the surface owners of the land or by the |
---|
93 | 95 | | applicant, the water allocated by a tempora ry permit shall not be |
---|
94 | 96 | | less than two (2) acre-feet annually for each acre of land owned or |
---|
95 | 97 | | leased by the applicant in the basin or subbasin. If the applicant |
---|
96 | 98 | | presents clear and convincing evidence that allocations in excess of |
---|
97 | 99 | | two (2) acre-feet annually for each acre of land overlying the basin |
---|
98 | 100 | | or subbasin will not exhaust the water thereunder in less than |
---|
99 | 101 | | twenty (20) years, then the Board may issue temporary permits in |
---|
100 | 102 | | such basin or subbasin in such amounts in excess of said limitation |
---|
101 | 103 | | as will assure a minimum twenty-year life for such basin or |
---|
102 | 104 | | subbasin. |
---|
103 | 105 | | 3. A temporary permit must be revalidated annually during its |
---|
104 | 106 | | term. The permit shall laps e at expiration of its term or upon the |
---|
105 | 107 | | issuance of a regular permit, whichever shall occur first. It is |
---|
106 | 108 | | subject to revocation or cancellation as provided in Sections |
---|
107 | 109 | | 1020.12 and 1020.15 of this title. For temporary permit |
---|
108 | 110 | | revalidation purposes, water us e report forms shall be mailed by the |
---|
109 | 111 | | Board to each temporary permit holder. Timely return of the |
---|
110 | 112 | | completed, signed, and dated water use report form to the Board |
---|
139 | 140 | | revalidation is not prot ested and if the water use report form does |
---|
140 | 141 | | not show or reflect any permit -water use violations. |
---|
141 | 142 | | 4. If the revalidation of a permit is protested, the Board |
---|
142 | 143 | | shall immediately set a date for hearing and notify the applicant |
---|
143 | 144 | | and each protestant of the time a nd place of the hearing. At the |
---|
144 | 145 | | hearing, any interested person may appear and present evidence and |
---|
145 | 146 | | argument in support of or in opposition to the protest a nd |
---|
146 | 147 | | revalidation. At the hearing on the revalidation protest, matters |
---|
147 | 148 | | previously presented or consid ered and adjudicated shall not be |
---|
148 | 149 | | subject to reconsideration or readjudication. The protest issues |
---|
149 | 150 | | which may be entertained shall be limited to matters not previously |
---|
150 | 151 | | determined, including but not limited to: a material or substantial |
---|
151 | 152 | | change in conditions since issuance of the permit; evidence of the |
---|
152 | 153 | | applicant's noncompliance with any of the terms, provisions, or |
---|
153 | 154 | | conditions of the permit; or subsequent viol ations of the Oklahoma |
---|
154 | 155 | | Groundwater Law, or Board rules and regulations. |
---|
155 | 156 | | 5. Subject to compliance wit h all other and applicable |
---|
156 | 157 | | provisions of this chapter and rules and regulations of the Board, |
---|
157 | 158 | | all temporary permits "revalidated" by the Board prior to the |
---|
158 | 159 | | effective date of this act are hereby validated. |
---|
159 | 160 | | C. Special Permit. A special permit is an authori zation by the |
---|
160 | 161 | | Board in lieu of or in addition to a regular or temporary permit. |
---|
161 | 162 | | The special permit is granted to put groundwater to a beneficial use |
---|
190 | 190 | | under a regular or temporary permit. The water so authorized may be |
---|
191 | 191 | | used only for the purpose designated in the permit. The permit |
---|
192 | 192 | | shall be granted for a period not to exceed six (6) months a nd may |
---|
193 | 193 | | be renewed three (3) times. Successive special permits shall not be |
---|
194 | 194 | | granted for the same purp ose. It is subject to revocation or |
---|
195 | 195 | | cancellation upon failure to use the water for the purpose granted |
---|
196 | 196 | | or as provided in Sections 1020.12 and 1020.15 of t his title. |
---|
197 | 197 | | D. Except as provided in Section 1020.21 of this title, no |
---|
198 | 198 | | permits shall be issued to an applicant who is not the surface owner |
---|
199 | 199 | | of the land on which the well is to be located, or does not hold a |
---|
200 | 200 | | valid lease from such owner permitting withdrawal of water from such |
---|
201 | 201 | | basin or subbasin. |
---|
202 | 202 | | E. The Board shall modify its rules to establish a flat fee for |
---|
203 | 203 | | both regular and temporary permits. The fee may be the same for |
---|
204 | 204 | | both regular and temporary permits. The permit fees shall not |
---|
205 | 205 | | increase or decrease in proportion to the volume of water permitted |
---|
206 | 206 | | or for any other reason. |
---|
207 | 207 | | SECTION 2. This act shall become effective November 1, 2023. |
