82132 SECTION 1. NEW LAW A new section of law to be codified
83133 in the Oklahoma Statutes as Section 3-82A of Title 2, unless there

86135 A. The following fees shall be paid to t he State Board of

138227 A. An applicator's license shall be issued only after
139228 satisfactory completion of the certification standards by the per son
140229 who shall be the certified applica tor under the license. Temporary
141230 certified applicators do not qualify as the certified applicator for
142231 a license, nor may they act as a certified applicator. The Board
143232 shall deny the application for certification, recer tification,
144233 issuance, or renewal of a certificate or licens e for a failure to
145234 show proper qualification under the rules or for violati ons of any
146235 provisions of this section. A certificate in any category shall be
147236 valid for five (5) years unless suspended, c anceled, or revoked by
148237 the Board or until recertification is required for the category, and
149238 may be renewed after successful completio n of recertification
150239 requirements. The Board may require certified applicators to be
151240 recertified once in a five-year period.

153268 B. A certified service technici an identification shall be
154269 issued upon application and completion of certification standards
155270 determined by the Board. Temporary certified applicators may
156271 qualify as a certified se rvice technician. No person shall act, do
157272 business as, or advertise as a se rvice technician unless the person
158273 has met all the qualifications and standards as required by the
159274 Board. The service technicians' identification shall be issued in
160275 the name of the licensed entity. The licensee shall ensure t hat the
161276 service technician id entification is returne d to the Board upon
162277 termination of the employee. A service technician iden tification
163278 shall be valid for a period of five (5) years unless suspended,
164279 canceled, or revoked by the Board, until recertificatio n is required
165280 by the Board, or until the service te chnician leaves the employ of
166281 the licensed entity. The Oklahoma Department of Agriculture, Food,
167282 and Forestry may issue a service technician identification upon
168283 completion of the following:

170284 1. A determination is made by the Departm ent that the applicant
171285 has successfully completed the written examination ;
172-
173286 2. The licensed entity provides a completed service technician
174287 identification application form at the ti me of testing; and
175-
176288 3. All appropriate fees are paid at the time of testing.

178289 C. Each license, except for private applicators, shall expire
179290 on dates established by the Depart ment in administrative rules and
180291 may be renewed for the ensuing calendar year, wit hout penalty or

182320 Board on a date established by the Department. If the application
183321 is not received by the due date, a penalty of twice the amount of
184322 the renewal fee shall be charged for r enewal of the license. If the
185323 application is not recei ved within thirty (30 ) days following the
186324 due date, an additional one-hundred-dollar penalty shall be paid
187325 prior to license renewal. All private applicator licenses are in
188326 effect for five (5) years an d may be renewed by applicati on after
189327 completion of a continuing education p rogram or written exam
190328 approved by the Board.

192329 SECTION 3. NEW LAW A new section of law to b e codified
193330 in the Oklahoma Statutes as Section 3-82C of Title 2, unless there
194331 is created a duplication in numbering, reads as follows:

196332 A. The Board shall not issue a commercial applicator's license
197333 until the applicant has furnished evidence of an insuranc e policy or
198334 certificate by an insurer or broker authorized to do business in
199335 this state insuring the commercial applicator and any agents a gainst
200336 liability resulting from the operations of the commercial
201337 applicator. The insurance shall not be applied to d amage or injury
202338 to agricultural crops, plants, or land being worked upon by the
203339 commercial applicator.

205340 B. The amount of liability shall not be less than that set by
206341 the Board for each property damage arising out of actual use of any
207342 pesticide. The liability shall be maintained at not less than that

208370 sum at all times during the licensin g period. The Board shall be
209371 notified fifteen (15) days prio r to any reduction in liability.

211372 C. If the furnished liability becomes unsatisfactory, the
212373 applicant shall immed iately execute new liability upon notice from
213374 the Board. If new liability is not immediately obtained, the Board
214375 shall, upon notice, cancel the license. It shall be unlawful for
215376 the person to engage in the business of applying pesticides until
216377 the liability is brought into compliance and the license reinstated.

218378 SECTION 4. NEW LAW A new section of law to be codified
219379 in the Oklahoma Statutes as Section 3-82D of Title 2, unless there
220380 is created a duplication in numbering, reads as follows:

222381 A. Prior to filing an action against an applicator for damages
223382 to growing crops or plants, any person alleging damages to growing
224383 crops or plants shall:

226384 1. Within ninety (90) calendar days of the date that the
227385 alleged damages occurred or prior to the time that twenty-five
228386 percent (25%) of the allegedly damaged crops or plants are
229387 harvested, whichever occurs first, file a written complaint
230388 statement with the D epartment regarding the alleged damages; and

232389 2. Between the date of filing of the written complaint pursuant
233390 to paragraph 1 of this subsection and the date harvesting or
234391 destruction of the allegedly damaged crops or plants occurs, allow
235392 the applicator and the representatives of the applicator reasonable
236393 access to the property to inspect and take samples of the allegedly

237421 damaged crops or plants during reasonable hours. The
238422 representatives of the applicator may include, but not be limited
239423 to, crop consultants, bondsmen, and insurers. Nothing in this
240424 paragraph shall limit in any way the harvesting or destruction of
241425 the allegedly damaged crops or plants in the ordinary course of
242426 business and practice.

244427 B. Any person failing to comply with subsection A of this
245428 section shall be barred from filing an action for damages against
246429 the applicator.

248430 SECTION 5. NEW LAW A new section of law to be codified
249431 in the Oklahoma Statutes as Section 3-82E of Title 2, unless there
250432 is created a duplication in num bering, reads as follows:

252433 A. It shall be unlawful for any person to sell, offer for sale,
253434 or distribute within this sta te any restricted use pesticide without
254435 first obtaining a restricted use pesticide dealer's permit issued by
255436 the Board.

257437 B. A permit may be issued by the Board in any category of
258438 pesticide sales if the applicant qualifies under the provisions of
259439 this section and the applicant is limited to the category of
260440 pesticide sales named on the pe rmit. The Board may establish
261441 categories of pesticide sales as necessary.

263442 C. The permit shall be issued only upon application on a form
264443 prescribed by the Board and the appl ication shall contain

268473 D. Each business location engaged in the sale or dis tribution
269474 of restricted use pesticides shall require a separate permit.

271475 E. The annual permit fee for a restricted use pesticide dealer
272476 permit shall be Fifty Dollars ($50.00) for each location.

274477 F. The Board may require a certified applicator to be present
275478 at any location where designated restricted use pesticide sales
276479 occur.

278480 SECTION 6. NEW LAW A new section of law to be codified

282483 A. Every pesticide or device distributed, sold, or offered for
283484 sale within this state or delivered for transportation or
284485 transported in intrastate or interstate commerce shall be registered
285486 with the Board.

287487 B. The registrant shall file with the Board a statement
288488 including, but not limited to:

290489 1. The name and address of the r egistrant and the name and
291490 address of the person whose nam e shall appear on the label, if other
292491 than the registrant;

296520 3. A complete copy of the labeling accompanying the pesticide
297521 or device and a statement of all cl aims to be made for it, and
298522 directions for use; and

300523 4. If requested by the Board, a full description of the tests
301524 made and the results upon which the claims are based. In renewing a
302525 registration, a statement shall be required only with respect to
303526 information which is different from the information furnished when
304527 the pesticide or device was last registered.

306528 C. Each registrant shall pay to the Board an annual
307529 registration fee of Two Hundred Ten Dollars ($210.00) for each
308530 pesticide or device label registere d. These fees shall be used by
309531 the Oklahoma Department of Agriculture, Food, and Forestry for
310532 purposes of administeri ng pesticide management programs. A portion
311533 of these fees, in the amount of Three Hundred Thousand Dollars
312534 ($300,000.00) annually, shall be dedicated for conducting programs
313535 for unwanted pesticide disposal. This amount shall be deposited
314536 into the State Department of Agriculture Unwanted Pestic ide Disposal
315-Fund and shall be dedicated for this use only. ENR. H. B. NO. 1966 Page 8

317538 D. The Board may require the submissi on of the complete formula
318539 of any pesticide. Trade secrets and formulations submi tted by the
319540 registrant may be kept c onfidential. If it appears to the Board
320541 that the composition of the pesticide is adequate to warrant the

323571 this section, then the pesticide shall be registered.

325572 E. If it does not appear to the Board that the pesticide or
326573 device is adequate to warrant the proposed cl aims for it or if the
327574 pesticide or device, its labeli ng, and other material requir ed to be
328575 submitted do not comply wit h the provisions of this section, it
329576 shall notify the applicant of the deficiencies in the pesticide,
330577 device, labeling, or other material required and afford the
331578 applicant an opportunity to m ake the necessary corrections . If the
332579 applicant claims, in writi ng, that the corrections are not necessa ry
333580 and requests in writing a hearing regarding the registration of the
334581 pesticide or device, the Bo ard shall provide an opportunity for a
335582 hearing before refusing to issue the regist ration. In order to
336583 protect the public, the Board may at any time cancel th e
337584 registration of a product or device. In no event, shall
338585 registration of a pesticide or device b e considered as a defense or
339586 excuse for the commission o f any offense prohibited u nder this
340587 section.

342588 F. The Board may require that pesticides be distinctivel y
343589 colored or discolored to protect the public health.

345590 G. Registration shall not be required in th e case of a
346591 pesticide shipped from one plant or place with in this state to
347592 another plant or place within this state th at is operated by the
348593 same person.

385677 A. As used in this section:

387678 1. "Establishment" means any site where a pesticide product,
388679 active ingredient, or device is produced within the state;
389-
390680 2. "Produce" means to manufacture, prepare, propagate,
391681 compound, or process any pesticide or to package, repackage, label,
392682 relabel, or otherwise change the container of any pesticide or
393683 device; and
394-
395684 3. "Producer" means any per son who produces, manufactures,
396685 prepares, compounds, pr opagates, or processes any active ingredient,
397686 pesticide, or device as used in producing a pesticide.

399687 B. It shall be unlawful for any person to produce within this
400688 state any pesticide, active ingredien t, or device without first
401689 obtaining a pesticide producer establishment permit issued by the
402690 Board.

404691 C. The permit shall be issued only upon application on a form

410724 the Board in writing wi thin thirty (30) calendar days of the change.

412725 D. The producer shall file a statement with the Board including
413726 but not limited to:

415727 1. The name and address of the company;

417728 2. The name and address of the establishment as well as the
418729 physical location, if d ifferent than the mailing address;
419-
420730 3. The name of any pesticide , active ingredient, or device; and
421-
422731 4. The name and address and other pertinent contact information
423732 for the responsible party.

425733 E. All permits for pesticide producer establishments shall be
426734 issued for a period of one (1) year and shall be renewed annually .
427735 All permits shall expire on June 30 each year and may be renewed
428736 without penalty if a prope rly completed application is filed with
429737 the Board not later than the fifteenth day of the month fi rst
430738 following the date of expiration. If the application is not
431739 received by that date, a penalty of twice the amount of the renewal
432740 fee shall be charged for renewal of the permit.

434741 F. Each pesticide producer establishment location engaged in
435742 the production of pesticides, active ingredients or devices shall
436743 require a separate permit.

7371286 purposes of administering pesticide management p rograms. A portion
7381287 of these fees, in the amount of Three Hundred Thousand Dollars
7391288 ($300,000.00) annually, shall be dedicated for conducting programs
7401289 for unwanted pesticide disposal . This amount shall be deposited
7411290 into the State Department of Agriculture Unwanted Pesticide Disposal
7421291 Fund and shall be dedicated for this use only.

7441292 4. The Board may require the submission of the complete formula
7451293 of any pesticide. Trade secrets and formulations sub mitted by the
7461294 registrant may be kept confidential. If it appears to the Board
7471295 that the composition of the pesticide is adequate to warrant the
7481296 proposed claims and if the pesticide, its labeling, and other
7491297 material required to be submitted comply with the requirements of
7501298 this section, then the pesticide shall be regis tered.

8731533 10. Every producer shall keep accurate records pertaining to
8741534 pesticide, active ingredient, or device production and distribut ion
8751535 as required by the Board. The records of the producer shall be kept
8761536 intact at the principal pro ducing location in this state for at
8771537 least two (2) years after the date of pr oduction and distribution
8781538 and copies shall be furnished to any authorized agent of the Board,
8791539 immediately upon request in person, at any time during the regular
8801540 business hours of the producer. Copies of records shall be
8811541 furnished to any authorized agent o f the Board within seven (7)
8821542 working days of a written request, in summary form , by mail, fax,
8831543 email, website, or any other electronic media customarily used.

8851544 N. COMPLAINT RESOLUTION - Upon receipt of a written complaint,
8861545 the Board shall notify the perso n filing the complaint in writing of
8871546 its receipt and status within two (2) worki ng days. The person whom
8881547 the complaint is filed against shall also be notified within two (2)
8891548 working days. Notification that a complaint has been filed may also
8901549 be given to the landowner or operator when appropriate. The
8911550 resolution of a complaint is th e completion of the appropriate
8921551 administrative, jurisdictional, or legal remedies to the extent
8931552 possible by the Department. The complainant shall be notified in
8941553 writing within seven (7) working days after resolution of the
8951554 complaint.
