5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5653 SECTION 1. NEW LAW A new section of law to be codified
5754 in the Oklahoma Statutes as Section 1370.10 of Title 68, unless
5855 there is created a d uplication in numbering, reads as foll ows:
5956 A. Notwithstanding the provisions of Section 1370 of Title 68
6057 of the Oklahoma Statutes and in accordance with the provisions of
6158 this act, any county of this state may levy a sales tax not to
6259 exceed one percent (1 %) upon the gross proceeds or gross receipts
6360 derived from all sales in the county upon which a consumer 's sales
6461 tax is levied by the stat e, except as provided in paragraph 8 of
62+Section 1357 of Title 68 of the Oklaho ma Statutes, subject to the
63+following conditions:

92-Section 1357 of Title 68 of the Oklaho ma Statutes, subject to the
93-following conditions:
9490 1. The proceeds of such sales tax shall be used solely for the
9591 purpose of funding emergency medical services ; and
9692 2. Before a sales tax may be levied by the county, the
9793 imposition of the ta x shall first be approved by fifty percent (50%)
9894 of the registered voters of the county voting thereon at a special
9995 election called by resolution of the board of county commissioners .
10096 B. The board of county commissioners shall create a limited -
10197 purpose fund and deposit therein any revenue generated by any sales
10298 tax levied pursuant to the provisions of subsection A of this
10399 section. The fund shall be placed in an insured or collateralized
104100 interest-bearing account, and the interest which accru es to the fund
105101 shall be retained in the fund. Monies in the limited-purpose fund
106102 shall be expended only as accumulated and only for the purpose
107103 specifically described in paragraph 1 of subsection A of this
108104 section.
109105 C. As used in this section, "Emergency Medical Services " means
110106 any emergency medical services syste m which provides for the
111107 organization and appropriate design ation of personnel, facilities,
112108 and equipment for the effective and coordinated delivery of health
113109 care services primarily under emergen cy conditions within the voting
114110 county.
111+D. A proposition otherwise authorized by the provisions of
112+subsection A or subsection B of this section shall be placed before

142-D. A proposition otherwise authorized by the provisions of
143-subsection A or subsecti on B of this section shall be placed before
144139 the voters of the applicable county at an election to be held on the
145140 same date as:
146141 1. Any regularly scheduled federal, state or county election
147142 held in that county;
148143 2. A special election held in that county for a federal, state
149144 or county office; or
150145 3. A special election held in that county for another county
151146 proposition or a state question.
152147 SECTION 2. This act shall become effectiv e November 1, 2023.
