	50	+	to sophomore year; modifying criteria of a one -year

50	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	60		SECTION 1. AMENDATORY 70 O.S. 2021, Section 8 -103.2, is
52	61		amended to read as foll ows:
53	62		Section 8-103.2 A. Except as otherwise provided, a student who
54	63		enrolls transfers, pursuant to the Education Open Transfer Act or
55	64		pursuant to Section 2 8-113 of this act title, in to a school
56	65		district in which the student is not a resident shall not be
57	66		eligible to participate in school -related extramural athletic
58	67		competition governed by the Oklahoma Secondary School Activities
59		-	Association for a period of one (1) year f rom on the first day of
60		-	attendance at the re ceiving school unless the transfer is fr om a
61		-	school district which does not o ffer the grade the student is
62		-	entitled to pursue if the student did not letter in the school -

91	101		B. A student who transfers prior to his or her sophomo re year
92	102		of high school, pursuant to the Education Open Transfer Act or
93	103		Section 8-113 of this title, shall be eligible to participa te in
94	104		school-related extramural athletic competition governed by the
95	105		Oklahoma Secondary School Activities Association on th e first day of
96	106		attendance at the receivi ng school.
97	107		C. If the student is granted an emergency transfer p ursuant to
98	108		Section 8-104 of this title, was granted a transfer for any reason
99	109		prior to January 1, 2000, or enrolls pursuant to the Education Open
100	110		Transfer Act and qualifies for a hardship waiv er pursuant to the
101	111		rules of the Oklahoma Secondary School Activi ties Association,
102	112		eligibility to participate in school -related extramural athle tic
103	113		competition shall be determined by the Oklahoma Secondary School
104	114		Activities Association. If the student does not meet the criteria
105	115		provided in subsection A or B of this sec tion and does not qualify
106	116		for a hardship waiver, the student shall not be eligibl e to
107	117		participate in school -related extramural athletic competition
108	118		governed by the Oklahoma Secondary School Ac tivities Association for
109		-	a period of one (1) year from the first day of attendance at the
110		-	receiving school.
111		-	SECTION 2. This act shall become effective November 1, 2023.
