4040 An Act relating to schools; amending 70 O.S. 2021,
4141 Section 1-109, which relates to the length of the
4242 school year; allowing school district s to adopt a
4343 school-hours policy with specified minimum number of
4444 days beginning with certain school year ; establishing
4545 requirements for certain s chool-hours policy;
4646 requiring two public hearings prior to adoption;
4747 prescribing criteria and timing of hearings;
4848 mandating hearing prior to readoption of policy every
4949 three years; prohibiting eligibility of certain
5050 schools to adopt policy; providing exemptions from
5151 other requirements; allowing certain schools to close
5252 for inclement weather; providing an effective date;

6060 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6161 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1 -109, is
6262 amended to read as follows:
6363 Section 1-109. A. For all public schools in Oklahoma, school
6464 shall actually be in session and classroom instruction offered:
6565 1. For not less than one hundred eighty (180) days; or
6666 2. For not less than one thousand eighty (1,080) hours e ach

9696 3. Beginning with the 2021 -2022 school year, for not less than
9797 one thousand eighty (1,080) hours with a minimum of one hundred
9898 sixty-five (165) days of instruction each school year, if a district
9999 board of education adopts a school -hours policy and notifies the
100100 State Board of Education prior to October 15 of the applicable
101101 school year; or
102102 4. Beginning with the 2021-2022 2023-2024 school year, for not
103103 less than one thousand eighty (1,080) hours with a minimum of one
104104 hundred fifty-five (155) days of instruction each school year, if a
105105 district board of education adopts a s chool-hours policy, notifies
106106 the State Board of Education prior to October 15 of the applicable
107107 school year, and meets the requirements established by the State
108108 Board of Education pursuant to subsection H of this section.
109109 B. A school district may not count more than thirty (30) hours
110110 each school year that are used for attendance of professional
111111 meetings toward the one hundred eighty (180) days or one thousand
112112 eighty (1,080) hours of classroom instruction time required in
113113 subsection A of this section.
114114 C. Teachers off contract with an employing district shall not
115115 be required by the e mploying school district to attend professional
116116 meetings unless the teacher is paid additional compensation for the
117117 additional time. Teachers may be paid additional compensation for

144144 attending professional meetings in excess of their contract term.
145145 Subject to district board of education policy or collective
146146 bargaining agreement, additional paid professional days may be
147147 granted for individual teachers to attend or participate in
148148 professional meetings, staff development training, or National Board
149149 certification portfolio development as provided for in Section 6 -
150150 204.2 of this title.
151151 D. A school district may authorize parent -teacher conferences
152152 to be held during a regular school day. If authorized by the school
153153 district, parent-teacher conferences shall be co unted as classroom
154154 instruction time for no more than six (6) hours per semester, for a
155155 total of twelve (12) hours per school year.
156156 E. A school district may maintain school for le ss than a full
157157 school year only when conditions beyond the control of school
158158 authorities make the maintenance of the term impossible and the
159159 State Board of Education has been apprised and has expressed
160160 concurrence in writing.
161161 F. The State Board of Educati on shall establish criteria for an
162162 extended-day schedule for schools subject to paragraph 1 of
163163 subsection A of this section. The criteria shall:
164164 1. Prescribe a lengthened school day within limits determined
165165 not to be detrimental to quality instruction;

192192 2. Ensure that the schedule is equivalent in annual hours of
193193 instruction to the one-hundred-eighty-day school year specified in
194194 paragraph 1 of subsection A of this section; and
195195 3. Be consistent with the provisions of this section and
196196 Sections 1-111 and 1-112 of this title, but may result in fewer
197197 annual days of instruction.
198198 G. Notwithstanding the provisions of subsection F of this
199199 section, a school district board of education subject to paragraph 1
200200 of subsection A of this section may adopt and implement a n extended-
201201 day schedule subject to the following requirements:
202202 1. The annual number of hours of instruction shall equal or
203203 exceed one thousand eighty (1,080) hours, which is the equivalent of
204204 one hundred eighty (180) days of instruction as specified in
205205 subsection A of this section for six (6) hours each day as specified
206206 in Section 1-111 of this title;
207207 2. The annual number of days of instruction shall equal or
208208 exceed one hundred eighty (180) days as specified in subsection A of
209209 this section;
210210 3. The schedule adopted shall be consistent with the provisions
211211 of Sections 1-111 and 1-112 of this title, except that for not more
212212 than one (1) day per week, a school day shall consist of not less
213213 than five (5) hours devoted to academic instruction in a regular
214214 classroom setting;

241241 4. The district shall hold a public hearing prior to the
242242 adoption of an extended-day schedule authorized pursuant to this
243243 subsection; and
244244 5. The district shall document the impact on student
245245 achievement as determined by the academic performa nce data score and
246246 any other relevant factors that are a result of implementa tion of an
247247 extended-day schedule authorized pursuant to this subsection and
248248 provide an annual report to the State Board of Education of the
249249 results. If improvement in student ach ievement cannot be documented
250250 in the report, the district board of education shall revoke
251251 authorization as provided by this subsection. If the district does
252252 not revoke authorization after student achievement is not documented
253253 in the report, the State Boar d of Education may deny accreditation
254254 of any school in violation of this subs ection.
255255 H. Beginning with the 2021-2022 2023-2024 school year, a school
256256 district board of education may adopt a school -hours policy as
257257 provided for by paragraph 4 of subsection A of this s ection only if
258258 it meets or exceeds the minimum guidelines for stude nt performance
259259 and school district cost savings established by the State Board of
260260 Education. The State Board of Education shall promulgate rules,
261261 subject to approval by the Legislature, es tablishing the minimum
262262 guidelines for student performance and schoo l district cost savings
263263 the board holds two public hearings prior to the adoption of the
264264 school calendar.

291291 1. Notice for the public hearings shall be publicly posted
292292 twenty (20) days prior to the date of the hearings. The hearings
293293 shall include an opportunity for public comment and shall occur more
294294 than twenty-five (25) days apart.
295295 2. After adoption of a school -hours policy pursuant to this
296296 subsection, a school district board of education shall hold a public
297297 hearing prior to the readoption of the school-hours policy once
298298 every three (3) years from the date the school -hours policy was
299299 first adopted.
300300 3. A school district board of education that has a school site
301301 within its district which receives an A-F rating of "D" or lower
302302 from the State Department of Ed ucation for a period of three (3) or
303303 more consecutive years shall not be eligible to adopt a school -hours
304304 policy as provided in paragraph 4 of subsection A of this section .
305305 4. A school district board of education that adopts a school-
306306 hours policy as provi ded in paragraph 4 of subsection A of this
307307 section shall be exempt from complying with subsections F and G of
308308 this section.
309309 I. If subject to paragraph 2, 3, or 4 of subsection A of this
310310 section, a district board of education or designee may elect to
311311 close a school during the school day for incle ment weather purposes.
312312 In such an event, the number of hours incurred in classroom
313313 instruction time prior to school closure shall be counted toward the
314314 one thousand eighty (1,080) hours per year requirement.

341341 J. Nothing in this section shall be construed as affecting the
342342 right of an employing school district to require teachers as defined
343343 in Section 6-101.3 of this title to work in excess of t he one
344344 thousand eighty (1,080) hours required for student instruction. In
345345 addition, nothing in this section shall be construed to affect the
346346 Fair Labor Standards Act status of any school district employee.
347347 K. The provisions of this section shall not proh ibit the
348348 Oklahoma School for the Blind or the Oklahoma School for the Deaf
349349 from adopting an alternative school -hours policy if the Oklahoma
350350 School for the Blind or the Oklahoma School for the Deaf notifies
351351 and receives approval from the State Board of Educ ation prior to
352352 October 15 of the applicable school year.
353353 SECTION 2. This act shall become effective July 1, 2023.
354354 SECTION 3. It being immediately necessary for the preservation
355355 of the public peace, health or safety, an emergency is hereby
356356 declared to exist, by reason whereof thi s act shall take effect and
357357 be in full force from and after its pass age and approval.
