4043 An Act relating to professions and occupations;
41-amending 59 O.S. 2021, Section s 1820.11, 1820.12, and
42-1820.13, which relate to the Fire Extinguisher
43-Licensing Act; lowering age qualification; removing
44-requirements for license application; modifying
44+amending 59 O.S. 2021, Section 1820.13, which relates
45+to the Fire Extinguisher Licensing Act ; modifying

5253 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53-SECTION 1. AMENDATORY 59 O.S. 2021, Section 1820.11, is
54+SECTION 1. AMENDATORY 59 O.S. 2021, Section 1820.1 3, is
5455 amended to read as follows:
55-Section 1820.11 A. Any person applying for a license to engage
56-in a fire extinguisher industry business pursu ant to the Fire
57-Extinguisher Licensing Act shall provide evidence to the F ire
58-Extinguisher Industry Committee that the individual within this
59-state having direct supervision over the function and local
60-operations of the fire extinguisher industry business or a branch
61-thereof has the following qualifications:
62-1. The individual i s at least twenty-one (21) eighteen (18)
63-years of age;
56+Section 1820.13 A. Upon making proper company application,
57+payment of the proper license fee and certification of approval by
58+the Fire Extinguisher Industry Committee, the State Fire Marshal
59+shall issue a license to the company applicant. Upon making proper
60+individual application, pay ment of the proper license fee and
61+submission of required documentation, th e State Fire Marshal shall
62+issue a license to the individual applicant . The license shall be
63+valid for a one-year term.

90-2. The individual has not been declared by any co urt of
91-competent jurisdiction incompetent by reason of mental defect or
92-disease;
93-3. The individual is not a habitual user of intoxicating
94-liquors or habit-forming drugs;
95-4. The individual has not been discharged from the Armed
96-Services of the United Stat es under other than honorable conditions;
97-and
98-5. The individual meets such o ther standards as may be
99-established by the State Fire Marshal Commission relating to
100-experience or knowledge of the fire extinguisher industry.
101-B. The applicant shall advise the Committee and furnish full
102-information on each individual described in subse ction A of this
103-section of any conviction of a felony crime which substant ially
104-relates to the occupation of an individual in a fire extinguisher
105-industry business and poses a rea sonable threat to public safety for
106-which a full pardon has not been granted. The applicant shall
107-furnish a recent photograph of a type prescribed by the Committee
108-and two classifiable sets of fingerprints of such individual.
109-C. As used in this section:
110-1. "Substantially relates" means the nature of criminal conduct
111-for which the person was convicted has a direct bearing on the
112-fitness or ability to p erform one or more of the duties or
113-responsibilities necessarily related to the occupation; and

140-2. "Poses a reasonable threat" means the nature of criminal
141-conduct for which the per son was convicted involved an act or threat
142-of harm against another and ha s a bearing on the fitness or ability
143-to serve the public or work with others in the occupation.
144-SECTION 2. AMENDATORY 59 O.S. 2021, Section 1820.12, is
145-amended to read as follows:
146-Section 1820.12 A. An application for a licens e shall include:
147-1. The address of the principal office of the applicant and the
148-address of each branch office located within this state;
149-2. The name of each business location unde r which the applicant
150-intends to do business as a licensee; and
151-3. A statement as to the extent and scope of the fire
152-extinguisher industry business of the applicant and all other
153-businesses in which the applicant is engaged in this state;
154-4. A recent photograph of the applicant of a type prescribed by
155-the State Fire Marshal C ommission if the applicant is a sole
156-proprietor, or a photograph of each officer and of each partner or
157-shareholder who owns a twenty -five percent (25%) or greater interest
158-in the applicant, if the applicant is an entity; and
159-5. Such other information, sta tements, or documents as may be
160-required by the State Fire Marshal Commission.
161-B. An applicant for an individual license shall provide such
162-documents, statements or other information a s may be required by the
163-State Fire Marshal Commission , including two classifiable sets of

190-fingerprints of the app licant. The fingerprints may be used for a
191-national criminal history record check as defined by Section 150.9
192-of Title 74 of the Oklahoma Sta tutes.
193-C. Fees for license a nd license renewal issued pursuant to the
194-Fire Extinguisher Licensing Act shall be ad opted by the State Fire
195-Marshal Commission pursuant to Section 1820.19 of Title 59 of the
196-Oklahoma Statutes this title. An applicant shall pa y the license
197-fee at the time the applicant makes application.
198-SECTION 3. AMENDATORY 59 O.S. 2021, Section 1820.13, is
199-amended to read as follows:
200-Section 1820.13 A. 1. Upon making a proper initial fire
201-extinguisher business application, payment of the proper license fee
202-and certification of appro val by the Fire Extinguisher Industry
203-Committee, the State Fire Marshal shall issue a an initial fire
204-extinguisher business license to the applicant. The fire
205-extinguisher business license shall be valid for a one-year term.
206-2. Upon making a proper initi al individual application,
207-individual renewal application or fire extinguisher business renewal
208-application, and payment of the proper license fee, the State Fire
209-Marshal shall issue al l initial individual licenses, individual
210-renewal licenses and fire extinguisher business renewal licenses.
211-These licenses shall be valid for a one-year term.
21291 B. Renewal of a license shall not p rohibit disciplinary
21392 proceedings for an act committed prior to the renewal.

24093 C. The State Fire Marshal Commission may adopt a system under
24194 which licenses expire on various dates through out the year. For any
24295 change in such expiration dates, license fees sh all be prorated on
24396 an appropriate periodic basis.
244-SECTION 4. This act shall become effective November 1, 2023.
