35102 BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:

37103 SECTION 1. NEW LAW A new section of law to be codified
38104 in the Oklahoma Statutes as Section 991a-4.2 of Title 22, unless
39105 there is created a duplication in numb ering, reads as follows:

41106 A. 1. Any person who receives a suspended sentence that
42107 exceeds five (5) years pursuant to the provisions of Section 991a of
43108 this title for an offense not listed in Section 13.1 or subsection
44109 C, D, E, F, G, or J of Section 644 of Title 21 of the Oklahoma
45110 Statutes or Section 571 or 582 of Title 57 of the Oklahoma Statutes
46-shall, upon request, receiv e an early evaluation hearing after five ENR. H. B. NO. 2490 Page 2
111+shall, upon request, receiv e an early evaluation hearing after five
47112 (5) years to determine whether the le ngth of the suspended sentence
48113 should be modified.

50114 2. Any person who receives a split sentence pursuant to the
51115 provisions of Section 991a of Title 22 of the Oklahoma Statutes for
52116 an offense not listed i n Section 13.1 or subsection C, D, E, F, G,
53117 or J of Section 644 of Title 21 of the Oklahoma Statutes or Section
54118 571 or 582 of Title 57 of the Oklahoma Statutes and the suspended
55119 portion of the senten ce exceeds five (5) years shall, upon request,
56120 receive an early evaluation hearing after five (5) years of ser ving
57121 the suspended portion of the split sentence to determine whether the
58122 length of the split sentence should be modified.

60149 B. Upon an early evaluation hearing conducted pursuant to
61150 subsection A of this section, the court may modify the length of the
62151 suspended sentence or split sen tence when:
63-
64152 1. The person has completed all requireme nts of his or her
65153 probation, including treatment and rehabilitativ e programming;
66-
67154 2. The person had no criminal violations duri ng the term of
68155 probation;
69-
70156 3. The person has no pending revocation hearings ; and
71-
72157 4. The district attorney does not object on behalf of the state
73158 or the victim or victims of the offense. Any such objection shall
74159 be made in writing, specify on behalf of wh om the objection is made,
75160 and include the specific reason or reasons for the objection.

77161 C. A person may request an early evaluation hearing one (1)
78162 year earlier than prescribed in subsection A of this section and the
79163 court may modify the length of the su spended sentence or split
80164 sentence when:

82165 1. The person received a high school or high school equivalency
83166 diploma, any college -level degree, or a vocational, technical, or
84167 career training certific ation or degree while serving his or her
85168 sentence, or when the person has maintained consistent employment
86169 throughout his or her probation period;

88170 2. The person has completed all requirements of his or her
89171 probation, including treatment and rehabilitative programming;

91198 3. The person had no criminal violations du ring the term of

101205 D. Written notice shall be made to the appropriate district
102206 attorney within fifteen (15) days of the filing of a request
103207 pursuant to subsection A or C of this section. The district
104208 attorney shall have forty -five (45) days from the date the no tice
105209 was received to object or ot herwise respond. The Court may, upon
106210 request of the district attorney, grant a single fifteen-day
107211 extension to object or otherwise respond.

109212 E. An offender may only request one early evaluation he aring in
110213 a case pursuant to subsection A of this section without prior
111214 approval from the district attorney.

113215 F. No person shall be prohibited from an early evaluation
114216 hearing as a condition of a plea a greement or imposed sentence if
115217 otherwise qualified pur suant to subsection A of this section.

117218 G. The President Pro Tempore of the Senate, the Speaker of the
118219 House of Representati ves, or the Governor may request the District
119220 Attorneys Council to provide a list of early termination
120221 applications made and copies of any objections or other responses to

122249 be made no later than July 31 and shall be fulfilled no later than

349+B. The early evaluation hearing shall be conducted by the court
350+which imposed the original suspended sentence.
351+C. The early evaluation hearing shall not be conducted until
352+the person has served at least five (5) years of th e suspended
353+sentence. Provided, a person who receives a high school diploma or
354+high school equivalency diploma, any college -level degree, or a
355+vocational, technical, or career training certification or degree
356+while serving his or her suspended sentence, m ay request an early
357+evaluation hearing after having served at least four (4) years of
358+the suspended sentence.
359+D. At the early evaluation hearing, the court may modify the
360+length of the suspended sentence when the court is satisfied that
361+the best interests of the public will not be j eopardized. Provided,
362+the court shall be pro hibited from modifying the length of the
363+suspended sentence when the district attorney or victim of the crime
364+objects to the modification.
365+E. A person may only receive one early eval uation hearing in a
366+case without prior approval from the district attorne y.
367+SECTION 4. This act shall become effective November 1, 2023.
