103 | 105 | | B. 1. Beginning July 1, 2013, the Board shall be composed of |
---|
104 | 106 | | seven (7) members appointed by the Go vernor with the advice and |
---|
105 | 107 | | consent of the Senate, as follows: |

106 | 108 | | a. two members shall have at least ten (10) years ' |
---|
107 | 109 | | experience in the plumbing trade, of which one shall |
---|
108 | 110 | | be a plumbing contractor and one shall be a journeyman |
---|

110 | 112 | | b. two members shall have at least ten (10) years ' |
---|
111 | 113 | | experience in the electrical trade, of which one sh all |

112 | 114 | | be an electrical contractor and one shall be a |

307 | 313 | | inspection of records and premises, and the production of relevant |

308 | 314 | | books and papers for the investigation of m atters that may come |

309 | 315 | | before the Board; |

310 | 316 | | 4. Initiate disciplinary proceedings, request prosec ution of |

311 | 317 | | and initiate injunctive proceedings against any person who violates |

357 | 364 | | subsidiaries, chemical plants, gas processing plants or petroleum |
---|
358 | 365 | | refineries where the entity uses their employees or contractors to |
---|
359 | 366 | | work on their own fac ilities or equipment; |

360 | 367 | | 7. Direct such other expenditur es as may be necessary in the |

404 | 412 | | chair of the Board. A copy of such certified report shall be |
---|
405 | 413 | | delivered to the chairs of the respective Senate and House of |
---|
406 | 414 | | Representatives Committees having authority over matters rela ting to |
---|
407 | 415 | | business, labor and construction industry lice nsing or regulation |
---|
408 | 416 | | not later than February 1 each year if it is not otherwise available |
---|
409 | 417 | | electronically on the website of the State Auditor and Inspector . |
---|
410 | 418 | | D. The Board shall account for all fines, pena lties and fees |
---|
411 | 419 | | assessed and collected pursuant to the Administrative Procedures Act |
---|
412 | 420 | | or any rule promulgated for regulation of any industry and trade |
---|
413 | 421 | | under the authority of the Construction Industries Board. All |
---|
414 | 422 | | fines, penalties and fees assessed for any v iolation of law or rule |
---|
415 | 423 | | shall be automatically reviewe d and brought before the entire Board |
---|
416 | 424 | | for consideration and vote not later than the last day of the |
---|

---|
451 | 460 | | administrative hearing, with or without instructions. No |
---|
452 | 461 | | administrative case shall be delayed or c ontinued by the Board after |
---|
453 | 462 | | being placed on an agenda for final Board review, except with th e |
---|
454 | 463 | | consent of all parties. The licensee or persons affected by the |
---|
455 | 464 | | imposition of an administrative fine, penalty or fee on final review |
---|
456 | 465 | | by the Board shall have all rights of appeal preserved pursuant to |
---|
457 | 466 | | the Administrative Procedures Act until final action by the Board. |
---|
458 | 467 | | E. The Construction Industries Board shall hear all appeals |
---|
459 | 468 | | timely made from an administrative ruling relating to an industry |
---|
460 | 469 | | and trade regulated by the Board; however, this appeal authority |
---|
461 | 470 | | shall not be in addition to the appeal process aut horized by the |
---|
462 | 471 | | Administrative Procedures Act. Any final order ruling by the Board |
---|
463 | 472 | | from an administrative hearing may be further appealed as authorized |
---|
464 | 473 | | by the Administrative Procedures Act. Any appeal to a district |
---|
465 | 474 | | court shall be to the district court District Court of Oklahoma |
---|
466 | 475 | | County. The district court, upon conclusion of an appeal from a |
---|
467 | 476 | | Board ruling, shall be authorized to award reasonable legal fees to |
---|
468 | 477 | | the prevailing party. |

1152 | 1175 | | political subdivision and remit ted to the State Treasury pursuant to |
