6465 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6566 SECTION 1. AMENDATORY 59 O.S. 2021, Se ction 1000.2, is
6667 amended to read as follows:
6768 Section 1000.2 A. The Construction Industries Board is hereby
6869 re-created to continue until July 1, 2023, in accordance with the
6970 provisions of the Oklahoma Sunset Law . The Board shall regulate the

99101 Building Code Commission Act through the powers and dutie s set forth
100102 in the Construction Industries Board Act and in the respective
101103 licensing or registration acts for such trades, or as otherwise
102104 provided by law.
103105 B. 1. Beginning July 1, 2013, the Board shall be composed of
104106 seven (7) members appointed by the Go vernor with the advice and
105107 consent of the Senate, as follows:
106108 a. two members shall have at least ten (10) years '
107109 experience in the plumbing trade, of which one shall
108110 be a plumbing contractor and one shall be a journeyman
109111 plumber,
110112 b. two members shall have at least ten (10) years '
111113 experience in the electrical trade, of which one sh all
112114 be an electrical contractor and one shall be a
113115 journeyman electrician,
114116 c. two members shall have at least ten (10) years '
115117 experience in the mechanical trade, of which one shall
116118 be a mechanical contractor an d one shall be a
117119 mechanical journeyman, and
118120 d. one member shall have at least ten (10) years '
119121 experience as a building and construction inspector.

146149 2. Members shall be appointed for staggered terms of four (4)
147150 years, as designated by the Governor. Members shall continue in
148151 office until a successor is appointed by the Governor. The Governor
149152 shall fill all vacanci es and unexpired terms in the same manner as
150153 the original appointment of the member whose position is to be
151154 filled. A member may be removed by th e Governor at any time.
152155 SECTION 2. AMENDATORY 59 O.S. 2021, Section 1000.3, is
153156 amended to read as follows:
154157 Section 1000.3 A. 1. The Construction Industries Board shall
155158 organize on by September 1 each year, by electing from amon g its
156159 members a chair and a vice -chair. The Board shall hold regularly
157160 scheduled meetings at least once each quarter at a time and place
158161 determined by the Board and may hold special meetings, emergency
159162 meetings, or continued or reconvened meetings as foun d by the Board
160163 to be necessary. A majority of the members of the Board shall
161164 constitute a quorum for the transaction of business.
162165 2. The chair shall preside at meetings of the Board, set the
163166 agenda, sign orders and other required documents, coordinate Bo ard
164167 activities, and perform such other duties as may be prescribed by
165168 the Board or authorized by law.
166169 3. The vice-chair shall perform the duties of the chair during
167170 the absence or disability of the chai r and shall perform such other
168171 duties as may be presc ribed by the Board or authorized by law.

195199 4. The Construction Industries Board Administrator, at the
196200 discretion of the Board , shall:
197201 a. keep a record of all proceedings of the Board and
198202 certify to actions of the Board,
199203 b. oversee the receipt and deposit of all monies received
200204 by the Board in the appro priate revolving funds,
201205 c. submit, at the first regular meeting of the Board
202206 after the end of each fiscal year, a full itemized
203207 report of the receipts and di sbursements for the prior
204208 fiscal year, showing the am ount of funds on hand, and
205209 d. perform such other duties as are prescribed in the
206210 Construction Industries Board Act or as may be
207211 prescribed by the Board or required by law.
208212 B. The Board shall act in acco rdance with the provisions of the
209213 Oklahoma Open Meeting Act, the Oklahoma Open Records Act, and the
210214 Administrative Procedures Act.
211215 C. All members of the Board and such employees as de termined by
212216 the Board shall be bonded as required by Sections 85.26 85.58Q
213217 through 85.31 85.58V of Title 74 of the Oklahoma S tatutes.
214218 D. The liability of any member or em ployee of the Board acting
215219 within the scope of Board duties or employment shall be go verned by
216220 The Governmental Tort Claims Act.
217221 E. Members of the Board sha ll serve without compensation but
218222 shall be reimbursed for all actual and necessary expenses incurre d

247252 SECTION 3. AMENDATORY 59 O.S. 2021, Sec tion 1000.4, is
248253 amended to read as follows:
249254 Section 1000.4 A. 1. Pursuant to and in comp liance with
250255 Article I of the Administrative Procedures Act, the Construction
251256 Industries Board shall have the power to adopt, amend, repeal , and
252257 promulgate rules as may be necessary to regulate the plumbing,
253258 electrical and, mechanical and roofing trades, building and
254259 construction inspectors and, home inspectors, and implement and
255260 administer the Oklahoma Uniform Building Code Commission Act . All
256261 rules promulgated by t he Board shall be reviewed and approved as
257262 provided in subsection F of Section 308 of Title 75 of the Oklahoma
258263 Statutes Article I of the Administrative Procedures Act and the
259264 Construction Industries Board Act .
260265 2. The Board shall have the power to enforce the provisions of
261266 the Construction Industries Board Ac t, The Plumbing License Law of
262267 1955, the Oklahoma Inspectors Act, the Electrical License Act, the
263268 Mechanical Licensing Act, the Home Inspection Licensing Act, the
264269 Oklahoma Uniform Building Code Commissi on Act and the Roofing
265270 Contractor Registration Act, as provided in the respective acts.
266271 B. The Board shall have the following powers:
267272 1. Exercise all incidental powers and duties which are
268273 necessary to effectuate the provisions of The Plumbing License La w

296302 the Mechanical Licensing Act, and the Oklahoma Uniform Building Code
297303 Commission Act, the Home Inspection Licensing Act and the Roofing
298304 Contractor Registration Act, including, but not limit ed to,
299305 performing inspections of licenses, registratio ns, endorsements and
300306 construction sites not otherwise subject to code inspection for
301307 compliance with statewide adopted building codes applicable to the
302308 trades licensed by the Board ;
303309 2. Serve as a code variance and appeals board for the trades
304310 and industries it regulates which do not have statuto ry code
305311 variance and appeals boards;
306312 3. Order or subpoena the attendance of witnesses, the
307313 inspection of records and premises, and the production of relevant
308314 books and papers for the investigation of m atters that may come
309315 before the Board;
310316 4. Initiate disciplinary proceedings, request prosec ution of
311317 and initiate injunctive proceedings against any person who violates
312318 any of the provisions of The Plumbing License Law of 1955, the
313319 Oklahoma Inspectors Act, the Electrical License Act, the Mechanical
314320 Licensing Act, and the Home Inspection Licensing Act and the Roofing
315321 Contractor Registration Act ;
316322 5. Maintain an administrative staff including, but not limited
317323 to, a Construction Industries Board Administrator whose appointment
318324 shall be made as provided in Section 1000.6 of this title;

345352 6. Establish and levy administrative fines for violations of
346353 law or rule in the trades and industries the Board licenses or
347354 regulates or against any person or entity denying the Board or its
348355 representatives access to a job site for purposes of enforcing any
349356 of the provisions of The Plumbing License Law of 1955, the Oklahoma
350357 Inspectors Act, the Electrical License Act, and the Mechanical
351358 Licensing Act, or the Home Inspection Licensi ng Act and the Roofing
352359 Contractor Registration Act; pr ovided, however, the Board is not
353360 authorized to inspect or issue administrative violations or fines
354361 for public utilities, public service corporations, intrastate gas
355362 pipeline companies, gas gathering pi peline companies, gas processing
356363 companies, rural elec tric associations, municipal utilities or their
357364 subsidiaries, chemical plants, gas processing plants or petroleum
358365 refineries where the entity uses their employees or contractors to
359366 work on their own fac ilities or equipment;
360367 7. Direct such other expenditur es as may be necessary in the
361368 performance of its duties including, but not limited to,
362369 expenditures for office space, equipment, furnishings and contracts
363370 for legal services. All expenditures shall be made pursuant to the
364371 Oklahoma Central Purchasing Act; and
365372 8. Enforce provisions of the plum bing, electrical and
366373 mechanical codes as adopted by the Oklahoma Uniform Building Code
367374 Commission pursuant to the Oklahoma Uniform Building Code Commission
368375 Act.

395403 C. The Board shall account for all receipts and expendit ures of
396404 the monies of the Board, inclu ding annually preparing and publishing
397405 a statement of receipts and expenditures of the Board for each
398406 fiscal year. The Board 's annual statement of receipts and
399407 expenditures shall be audited by the State Auditor and In spector or
400408 an independent accounting f irm in accordance with the provisions of
401409 subsection B of Section 212 of Title 74 of the Oklahoma Statutes,
402410 and the audit report shall be certified to the Governor o f this
403411 state to be true and correct, under oath, by th e chair and vice-
404412 chair of the Board. A copy of such certified report shall be
405413 delivered to the chairs of the respective Senate and House of
406414 Representatives Committees having authority over matters rela ting to
407415 business, labor and construction industry lice nsing or regulation
408416 not later than February 1 each year if it is not otherwise available
409417 electronically on the website of the State Auditor and Inspector .
410418 D. The Board shall account for all fines, pena lties and fees
411419 assessed and collected pursuant to the Administrative Procedures Act
412420 or any rule promulgated for regulation of any industry and trade
413421 under the authority of the Construction Industries Board. All
414422 fines, penalties and fees assessed for any v iolation of law or rule
415423 shall be automatically reviewe d and brought before the entire Board
416424 for consideration and vote not later than the last day of the
417425 monthly quarter in which ninety (90) days from the date it was
418426 imposed. The Construction Industries Board Administrator shall

445454 present to the Board a writte n recommendation and summary for each
446455 case in which an assessment of a fine, penalty or fee was imposed
447456 after administrative proceedings. The Board shall consider the
448457 recommendations for each case at t he next meeting date and at such
449458 meeting shall either vote to affirm the recommendations or vote to
450459 deny the recommendations and remand the case for further
451460 administrative hearing, with or without instructions. No
452461 administrative case shall be delayed or c ontinued by the Board after
453462 being placed on an agenda for final Board review, except with th e
454463 consent of all parties. The licensee or persons affected by the
455464 imposition of an administrative fine, penalty or fee on final review
456465 by the Board shall have all rights of appeal preserved pursuant to
457466 the Administrative Procedures Act until final action by the Board.
458467 E. The Construction Industries Board shall hear all appeals
459468 timely made from an administrative ruling relating to an industry
460469 and trade regulated by the Board; however, this appeal authority
461470 shall not be in addition to the appeal process aut horized by the
462471 Administrative Procedures Act. Any final order ruling by the Board
463472 from an administrative hearing may be further appealed as authorized
464473 by the Administrative Procedures Act. Any appeal to a district
465474 court shall be to the district court District Court of Oklahoma
466475 County. The district court, upon conclusion of an appeal from a
467476 Board ruling, shall be authorized to award reasonable legal fees to
468477 the prevailing party.

495505 SECTION 4. AMENDATORY 59 O.S. 2021, Section 1000.6, is

497507 Section 1000.6 A. No later than January 1, 2002, and
498508 thereafter, each time the position becomes vacant, the Construction
499509 Industries Board shall hire a Construction Industries Board
500510 Administrator. The Construction Industri es Board may, upon a
501511 majority vote, terminate the employment of the Construction
502512 Industries Board Administrator.
503513 B. The Construction Industries Board Administrator shall assist
504514 the Construction Industries Board in the performance of its duties
505515 and shall report directly to the Board.
506516 SECTION 5. AMENDATORY 59 O.S. 2021, Section 1000.21, is
507517 amended to read as follows:
508518 Section 1000.21 A. 1. There is here by created the Oklahoma
509519 Uniform Building Code Commission within the Construction Industries
510520 Board which. The Construction Industries Board is authorized to
511521 administer the Oklah oma Uniform Building Code Commission Act and
512522 exercise all incidental powers necessary and proper to implement and
513523 enforce the provisions of the Oklahoma Uniform Building Code
514524 Commission Act and the rules promulgated thereto. The Oklahoma
515525 Uniform Building Code Commission shall consist of thirteen (13)
516526 members, eleven of whom shall be appointed by the Governor with the

545556 statewide organization that represents resident ial

547558 b. one member who is a general contractor from a

593605 h. one member who is a Certified Building Official
594606 employed by a political subdiv ision,
595607 i. one member who is a licensed architect from a
596608 statewide organization that represents architects,
597609 j. one member who is from the insurance industry with
598610 knowledge of building codes and experience in property
599611 loss mitigation, and
600612 k. one member who is a licensed mechanical engineer from
601613 a state-recognized professional engineeri ng firm.
602614 2. The members shall be appoint ed for staggered terms of four
603615 (4) years. The initial appointment of the members added by this act
604616 shall be made within ninety (90) day s of the effective date of this
605617 act. A full term of office for purposes of det ermining term limits
606618 provided in subsecti on C of this section shall be the completion of
607619 a full four-year term of appointment.
608620 B. The remaining two members of the Commission sh all be the
609621 State Fire Marshal, or a designee, and an appointee of the
610622 Construction Industries Board.
611623 C. Appointed members shall continue in office until a successor
612624 is appointed by the Governor, notwithstanding the term limitations.
613625 No appointed member s hall serve more than two consecutive full four -
614626 year terms; provided, such a mem ber shall be eligible to serve until
615627 a successor is appointed, and such member may be reappointed after a
616628 two-year absence from the Commission. The Governor shall fill all

644657 appointment of the member whose position is to be filled. No
645658 initial appointment to a term of less than four (4) years or any
646659 partial-term appointment to fill a vacancy or unexpired term of
647660 another member shall be counted for purposes of determining term
648661 limits. An appointed member may be removed by the Governor for
649662 cause.
650663 D. Whenever a member of the Commission is absent from more than
651664 one-half (1/2) of all meetings of the governing body, regul ar and
652665 special, held within any period of twelve (12) consecutive months,
653666 the member shall thereupon cease to hold offic e by operation of law.
654667 SECTION 6. AMENDATORY 59 O.S. 20 21, Section 1000.22, is
655668 amended to read as follows:
656669 Section 1000.22 1. A. The Oklahoma Uniform Building Code
657670 Commission shall organize immediately after July 1, 2009, and
658671 annually thereafter, by electing annually elect from among its
659672 members a chair and a vice -chair. The Commission shall hold
660673 regularly scheduled meetings at least once each quarter at a time
661674 and place determined by the Commission and may hold such spec ial
662675 meetings, emergency meetings or continued or reconvened meetings as
663676 found by the Commission to be necessary. A majority of the members

711725 5. The Commission shall comply with the provisions of the
712726 Oklahoma Open Meeting Act, the Oklahoma Open Records Act and the
713727 Administrative Procedures Act.

800816 D. The Oklahoma Uniform Building Code Commission shall have the
801817 power and duty to establish a training and certification process for
802818 all residential and commercial building code inspectors that
803819 prescribes standards, practices and procedures for prelicensing
804820 inspector training and other inspector training that enhances the
805821 education of building and construction inspec tors; provided, the
806822 training does not infringe upon the education requirements and
807823 processes under the Oklahoma Inspectors Act. Prelicensing programs
808824 prescribing the standards, practices and procedures for prelicensing
809825 building inspectors for use by other state agencies and other
810826 education providers, both public and private, may be developed
811827 through the use of a technical comm ittee that develops any program
812828 or curriculum, and recommends to the Construction Industries Board
813829 proposed administrative rules set ting forth any standards and
814830 procedures to be adopted pursuant to paragraph 1 of subsection A of

842859 regional prelicensing training on a regional basis for the purpose
843860 of training the county and mu nicipal inspectors in the Uniform
844861 Building Code statewide building codes adopted pursuant to this act .
845862 The regional training shall be offered at no cost to the participant
846863 building and construction inspector trainee along with any books or
847864 materials as may be determined necessary by the Board when fu nds are
848865 available and shall be funded from the funds received pursuant to
849866 Section 1000.25 of this title. Each inspector operating in this
850867 state on behalf of any state agency or any municipal or county
851868 office may complete participate in regional training and be issued a
852869 certification for inspections by the Uniform Building Code
853870 Commission on and after January 1, 2015 certificate of completion
854871 for any training program established pursuant to this act; however,
855872 any certificate of completion is subject to the continuing education
856873 approval process of the licensing entity . The training and
857874 certification applications standards, qualifications and application
858875 procedures for the instructor, provider, if a nonstate gover nmental
859876 entity, and the inspector trainee appl ications shall be promulgated
860877 by administrative rules of the Commission Board. The Commission may
861878 establish forms Forms and procedures may be established to implement
862879 and administer the provisions of this sect ion.
863880 SECTION 8. AMENDATORY 59 O.S. 2021, Section 1000.24, is

891909 Section 1000.24 A. 1. Beginning July 1, 2009, pursuant
892910 Pursuant to and in compliance with Article I of the Administrative
893911 Procedures Act, the Oklahoma Uniform Building Code Commission
894912 Construction Industries Boa rd shall have the power to adopt, amend,
895913 repeal and promulgate rules as may be necessary to perform the
896914 duties required under the Oklahoma Uniform Building Code Commission
897915 Act; provided that all rules pertaining to adoption of st atewide
898916 building codes proposed after technical review and for the purpose
899917 of revising and adopting the statewide building codes pursuant to
900918 this act shall not be changed or altered by the Construction
901919 Industries Board, so that the Oklahoma Uniform Buildin g Code
902920 Commission retains a nd has the full, unaltered authority to review,
903921 revise and adopt the statewide building codes , with any
904922 administrative services needed in the administrative rules process
905923 to be provided by administrative staff of the Construction
906924 Industries Board. Rules authorized under this section shall not
907925 become effective prior t o October 1, 2009.
908926 2. Beginning October 1, 2009, the Commission shall have the
909927 power to enforce the provisions of the O klahoma Uniform Building
910928 Code Commission Act.
911929 3. Any codes adopted by st ate agencies, municipalities or other
912930 political subdivisions of the state prior to uniform codes being
913931 adopted by the Oklahoma Uniform Building Code Commission, pursuant
914932 to the provisions of, or rules promulgated pursuant to, the Oklahoma

944963 B. The Oklahoma Uniform Building Code C ommission shall have the
945964 following powers:
946965 1. Exercise all incidental po wers and duties which are
947966 necessary to effectuate the provision s of the Oklahoma Uniform
948967 Building Code Commission Act;
949968 2. Adopt and have an official seal;
950969 3. Maintain an administrat ive staff, including, but not limited
951970 to, an Oklahoma Uniform Building Co de Commission Chief Executive
952971 Officer;
953972 4. Direct such other ex penditures as may be necessary in the
954973 performance of its duties, including, but not limited to,
955974 expenditures for office space, equipment, furnishings and contracts
956975 for services. All expenditur es shall be made pursuant to the
957976 Oklahoma Central Purchasing Ac t;
958977 5. 2. Appoint technical committees to review and recommend for
959978 adoption all building codes. The technical committee s shall review
960979 and recommend building codes wi th any amendments for adopt ion by the
961980 Commission, receive requests for advisory opinions f or
962981 interpretation of any statewide building code adopted pursuant to
963982 this act, evaluate the requests for appropriateness of need for an
964983 advisory opinion, assign any r equests to the appropriate technical

9971017 the Commission and any advisory opinions issued . The website shall
9981018 provide a method for listing all codes adopted by a state agency,
9991019 city or any other political subdivision of the state containing
10001020 higher standards and requirements than the codes adopted pursuant to
10011021 the Oklahoma Uniform Building Code Commission Act as require d in
10021022 Section 14-107 of Title 11 of the Oklahom a Statutes.
10031023 C. After October 1, 2009, the Commission The Construction
10041024 Industries Board shall account for all receipts and expenditures of
10051025 the monies of the Commission, including annually preparing and
10061026 publishing a statement of receipts and expenditures of the
10071027 Commission for each fi scal year. The Commission 's annual statement
10081028 of receipts and expenditures shall be audited by the State Auditor
10091029 and Inspector or an independent accounting firm, and the audit
10101030 report shall be certified to the Governor of this sta te to be true
10111031 and correct, under oath, by the chair and vice -chair of the
10121032 Commission Construction Industries Board.
10131033 SECTION 9. AMENDATORY 59 O.S. 2021, Section 1000.25, is

10411062 Section 1000.25 A. The Oklahoma Uniform Building Code
10421063 Commission shall establish recommend to the Construction Indust ries
10431064 Board a system of fees to be charged for the issuance and renewal of
10441065 any construction permits i ssued by any agency, municipality, or
10451066 other political subdivision o f this state.
10461067 B. This provision is subject to the following limitations:
10471068 1. No schedule of fees may be established or amended by the
10481069 Commission Board except during such times as the Legis lature is in
10491070 session; provided, the Commission Board may establish or amend a
10501071 schedule of fees at a time when the Legislature is not in session if
10511072 the fees or schedule of fees has been specifically authorized by the
10521073 Legislature pursuant to paragraphs 2 and 3 of this subsection . The
10531074 Commission must Board shall follow the procedures required by
10541075 Article I of the Administrative Procedures Act for adoption of rul es
10551076 in establishing or amending any such schedule of fees;
10561077 2. The Commission Board shall charge fees for building permits
10571078 and renewal of such permits issued by any sta te agency,
10581079 municipality, or other political subdivision of this state which
10591080 authorized work governed by codes within the purview of the
10601081 Commission Board only within the following ranges:
10611082 For issuance of permit not to exceed $5.00 $4.00
10621083 For renewal of permi t not to exceed $5.00
10631084 Fees shall be remitted to the Oklahoma Uniform Building Code
10641085 Commission Revolving Fund created pursuant to Section 1000.28 of
10651086

10921114 calendar month. The Oklahoma Uniform Buil ding Code Commission shall
10931115 report to the Governor, President Pro Tempore of the Senate an d the
10941116 Speaker of the House semiannually its collections for the six (6)
10951117 months preceding the report;
10961118 3. Fees shall be co llected by any state agency, municipality or
10971119 other political subdivision issuing construction permits within this
10981120 state. The fees shal l be deposited in an account created by the
10991121 collecting entity for that purpose;
11001122 4. The state agency , municipality or oth er political
11011123 subdivision shall remit the monie s in the account on a monthly basis
11021124 directly to the State Treasury for deposit in the Okl ahoma Uniform
11031125 Building Code Commission Revolving Fund created pursuant to Section
11041126 1000.28 of this title. Along with the deposits required by this
11051127 paragraph, each stat e agency, municipality or other political
11061128 subdivision shall also submit a report stating the total amount of
11071129 funds collected and the total number of fees imposed during the
11081130 preceding month. The report shall be made on computerized or manual
11091131 disposition reports as provided by rule of the Commission rules
11101132 promulgated pursuant to paragraph 1 of subsection A of Section
11111133 1000.24 of this title ;
11121134 5. Any state agency, municipality or other political
11131135 subdivision collecti ng and remitting fees pursuant to this section
11141136 may levy a fee up to fifty cents ($0.50) for every construction
11151137

11461169 in the report required by paragraph 4 of this subsection;
11471170 6. It shall be the responsibility of the state agency ,
11481171 municipality or other political subdivision to account for and
11491172 ensure the correctness a nd accuracy of payments made to the State
11501173 Treasury pursuant to this title;
11511174 7. Funds collected by a state agency, municip ality or other
11521175 political subdivision and remit ted to the State Treasury pursuant to
11531176 the Oklahoma Uniform Building Code Commission Act s hall be deposited
11541177 in the Oklahoma Uniform Building Code Commission Revolving Fund and
11551178 shall be used solely for the purpos es of the Oklahoma Uniform
11561179 Building Code Commission Act; provided that of the gross permit fees
11571180 charged, collected and received, ten pe rcent (10%) shall be paid
11581181 into the General Revenue Fund of the state ; and
11591182 8. Nothing in this act sh all prevent the Oklah oma Uniform
11601183 Building Code Commission from offe ring incentives for prompt
11611184 payment.

11901214 Section 1000.28 There is hereby created in the State Treasury a
11911215 revolving fund for the Oklahoma Uniform Build ing Code Commission to
11921216 be designated the Oklahoma Uniform Building Code Commission
11931217 Revolving Fund. The fund shall be a continuous fund, not subject to
11941218 fiscal year limitations, and shall consist of all fees or payments
11951219 of any type received by the Commission Construction Industries Board
11961220 for the purposes outlined in the provisions of the Oklah oma Uniform
11971221 Building Code Commission Act . All monies accruing to the credit of
11981222 the fund are hereby appropriated and may b e budgeted and expended by
11991223 the Commission Board for the purpose of implementing and
12001224 administering the Oklahoma Uniform Building Code C ommission Act.
12011225 Expenditures from the fund shall be made upon warrants issued by the
12021226 State Treasurer against claims filed as prescribed by law with the
12031227 Director of the Office of Management and Enterprise Services for
12041228 approval and payment.
12051229 SECTION 11. REPEALER 59 O.S. 20 21, Sections 1000.26 and
12061230 1000.27, are hereby repealed.
12071231 SECTION 12. This act shall become effective November 1, 2023.
