64	65		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
65	66		SECTION 1. AMENDATORY 59 O.S. 2021, Se ction 1000.2, is
66	67		amended to read as follows:
67	68		Section 1000.2 A. The Construction Industries Board is hereby
68	69		re-created to continue until July 1, 2023, in accordance with the
69	70		provisions of the Oklahoma Sunset Law . The Board shall regulate the

97	99		construction inspectors, home inspectors, and the roofing
98	100		contractors and implement and administer the Oklahoma Uniform
99	101		Building Code Commission Act through the powers and dutie s set forth
100	102		in the Construction Industries Board Act and in the respective
101	103		licensing or registration acts for such trades, or as otherwise
102	104		provided by law.
103	105		B. 1. Beginning July 1, 2013, the Board shall be composed of
104	106		seven (7) members appointed by the Go vernor with the advice and
105	107		consent of the Senate, as follows:
106	108		a. two members shall have at least ten (10) years '
107	109		experience in the plumbing trade, of which one shall
108	110		be a plumbing contractor and one shall be a journeyman
109	111		plumber,
110	112		b. two members shall have at least ten (10) years '
111	113		experience in the electrical trade, of which one sh all
112	114		be an electrical contractor and one shall be a
113	115		journeyman electrician,
114	116		c. two members shall have at least ten (10) years '
115	117		experience in the mechanical trade, of which one shall
116	118		be a mechanical contractor an d one shall be a
117	119		mechanical journeyman, and
118	120		d. one member shall have at least ten (10) years '
119	121		experience as a building and construction inspector.

146	149		2. Members shall be appointed for staggered terms of four (4)
147	150		years, as designated by the Governor. Members shall continue in
148	151		office until a successor is appointed by the Governor. The Governor
149	152		shall fill all vacanci es and unexpired terms in the same manner as
150	153		the original appointment of the member whose position is to be
151	154		filled. A member may be removed by th e Governor at any time.
152	155		SECTION 2. AMENDATORY 59 O.S. 2021, Section 1000.3, is
153	156		amended to read as follows:
154	157		Section 1000.3 A. 1. The Construction Industries Board shall
155	158		organize on by September 1 each year, by electing from amon g its
156	159		members a chair and a vice -chair. The Board shall hold regularly
157	160		scheduled meetings at least once each quarter at a time and place
158	161		determined by the Board and may hold special meetings, emergency
159	162		meetings, or continued or reconvened meetings as foun d by the Board
160	163		to be necessary. A majority of the members of the Board shall
161	164		constitute a quorum for the transaction of business.
162	165		2. The chair shall preside at meetings of the Board, set the
163	166		agenda, sign orders and other required documents, coordinate Bo ard
164	167		activities, and perform such other duties as may be prescribed by
165	168		the Board or authorized by law.
166	169		3. The vice-chair shall perform the duties of the chair during
167	170		the absence or disability of the chai r and shall perform such other
168	171		duties as may be presc ribed by the Board or authorized by law.

195	199		4. The Construction Industries Board Administrator, at the
196	200		discretion of the Board , shall:
197	201		a. keep a record of all proceedings of the Board and
198	202		certify to actions of the Board,
199	203		b. oversee the receipt and deposit of all monies received
200	204		by the Board in the appro priate revolving funds,
201	205		c. submit, at the first regular meeting of the Board
202	206		after the end of each fiscal year, a full itemized
203	207		report of the receipts and di sbursements for the prior
204	208		fiscal year, showing the am ount of funds on hand, and
205	209		d. perform such other duties as are prescribed in the
206	210		Construction Industries Board Act or as may be
207	211		prescribed by the Board or required by law.
208	212		B. The Board shall act in acco rdance with the provisions of the
209	213		Oklahoma Open Meeting Act, the Oklahoma Open Records Act, and the
210	214		Administrative Procedures Act.
211	215		C. All members of the Board and such employees as de termined by
212	216		the Board shall be bonded as required by Sections 85.26 85.58Q
213	217		through 85.31 85.58V of Title 74 of the Oklahoma S tatutes.
214	218		D. The liability of any member or em ployee of the Board acting
215	219		within the scope of Board duties or employment shall be go verned by
216	220		The Governmental Tort Claims Act.
217	221		E. Members of the Board sha ll serve without compensation but
218	222		shall be reimbursed for all actual and necessary expenses incurre d

246	251		Travel Reimbursement Act.
247	252		SECTION 3. AMENDATORY 59 O.S. 2021, Sec tion 1000.4, is
248	253		amended to read as follows:
249	254		Section 1000.4 A. 1. Pursuant to and in comp liance with
250	255		Article I of the Administrative Procedures Act, the Construction
251	256		Industries Board shall have the power to adopt, amend, repeal , and
252	257		promulgate rules as may be necessary to regulate the plumbing,
253	258		electrical and, mechanical and roofing trades, building and
254	259		construction inspectors and, home inspectors, and implement and
255	260		administer the Oklahoma Uniform Building Code Commission Act . All
256	261		rules promulgated by t he Board shall be reviewed and approved as
257	262		provided in subsection F of Section 308 of Title 75 of the Oklahoma
258	263		Statutes Article I of the Administrative Procedures Act and the
259	264		Construction Industries Board Act .
260	265		2. The Board shall have the power to enforce the provisions of
261	266		the Construction Industries Board Ac t, The Plumbing License Law of
262	267		1955, the Oklahoma Inspectors Act, the Electrical License Act, the
263	268		Mechanical Licensing Act, the Home Inspection Licensing Act, the
264	269		Oklahoma Uniform Building Code Commissi on Act and the Roofing
265	270		Contractor Registration Act, as provided in the respective acts.
266	271		B. The Board shall have the following powers:
267	272		1. Exercise all incidental powers and duties which are
268	273		necessary to effectuate the provisions of The Plumbing License La w

296	302		the Mechanical Licensing Act, and the Oklahoma Uniform Building Code
297	303		Commission Act, the Home Inspection Licensing Act and the Roofing
298	304		Contractor Registration Act, including, but not limit ed to,
299	305		performing inspections of licenses, registratio ns, endorsements and
300	306		construction sites not otherwise subject to code inspection for
301	307		compliance with statewide adopted building codes applicable to the
302	308		trades licensed by the Board ;
303	309		2. Serve as a code variance and appeals board for the trades
304	310		and industries it regulates which do not have statuto ry code
305	311		variance and appeals boards;
306	312		3. Order or subpoena the attendance of witnesses, the
307	313		inspection of records and premises, and the production of relevant
308	314		books and papers for the investigation of m atters that may come
309	315		before the Board;
310	316		4. Initiate disciplinary proceedings, request prosec ution of
311	317		and initiate injunctive proceedings against any person who violates
312	318		any of the provisions of The Plumbing License Law of 1955, the
313	319		Oklahoma Inspectors Act, the Electrical License Act, the Mechanical
314	320		Licensing Act, and the Home Inspection Licensing Act and the Roofing
315	321		Contractor Registration Act ;
316	322		5. Maintain an administrative staff including, but not limited
317	323		to, a Construction Industries Board Administrator whose appointment
318	324		shall be made as provided in Section 1000.6 of this title;

345	352		6. Establish and levy administrative fines for violations of
346	353		law or rule in the trades and industries the Board licenses or
347	354		regulates or against any person or entity denying the Board or its
348	355		representatives access to a job site for purposes of enforcing any
349	356		of the provisions of The Plumbing License Law of 1955, the Oklahoma
350	357		Inspectors Act, the Electrical License Act, and the Mechanical
351	358		Licensing Act, or the Home Inspection Licensi ng Act and the Roofing
352	359		Contractor Registration Act; pr ovided, however, the Board is not
353	360		authorized to inspect or issue administrative violations or fines
354	361		for public utilities, public service corporations, intrastate gas
355	362		pipeline companies, gas gathering pi peline companies, gas processing
356	363		companies, rural elec tric associations, municipal utilities or their
357	364		subsidiaries, chemical plants, gas processing plants or petroleum
358	365		refineries where the entity uses their employees or contractors to
359	366		work on their own fac ilities or equipment;
360	367		7. Direct such other expenditur es as may be necessary in the
361	368		performance of its duties including, but not limited to,
362	369		expenditures for office space, equipment, furnishings and contracts
363	370		for legal services. All expenditures shall be made pursuant to the
364	371		Oklahoma Central Purchasing Act; and
365	372		8. Enforce provisions of the plum bing, electrical and
366	373		mechanical codes as adopted by the Oklahoma Uniform Building Code
367	374		Commission pursuant to the Oklahoma Uniform Building Code Commission
368	375		Act.

395	403		C. The Board shall account for all receipts and expendit ures of
396	404		the monies of the Board, inclu ding annually preparing and publishing
397	405		a statement of receipts and expenditures of the Board for each
398	406		fiscal year. The Board 's annual statement of receipts and
399	407		expenditures shall be audited by the State Auditor and In spector or
400	408		an independent accounting f irm in accordance with the provisions of
401	409		subsection B of Section 212 of Title 74 of the Oklahoma Statutes,
402	410		and the audit report shall be certified to the Governor o f this
403	411		state to be true and correct, under oath, by th e chair and vice-
404	412		chair of the Board. A copy of such certified report shall be
405	413		delivered to the chairs of the respective Senate and House of
406	414		Representatives Committees having authority over matters rela ting to
407	415		business, labor and construction industry lice nsing or regulation
408	416		not later than February 1 each year if it is not otherwise available
409	417		electronically on the website of the State Auditor and Inspector .
410	418		D. The Board shall account for all fines, pena lties and fees
411	419		assessed and collected pursuant to the Administrative Procedures Act
412	420		or any rule promulgated for regulation of any industry and trade
413	421		under the authority of the Construction Industries Board. All
414	422		fines, penalties and fees assessed for any v iolation of law or rule
415	423		shall be automatically reviewe d and brought before the entire Board
416	424		for consideration and vote not later than the last day of the
417	425		monthly quarter in which ninety (90) days from the date it was
418	426		imposed. The Construction Industries Board Administrator shall

445	454		present to the Board a writte n recommendation and summary for each
446	455		case in which an assessment of a fine, penalty or fee was imposed
447	456		after administrative proceedings. The Board shall consider the
448	457		recommendations for each case at t he next meeting date and at such
449	458		meeting shall either vote to affirm the recommendations or vote to
450	459		deny the recommendations and remand the case for further
451	460		administrative hearing, with or without instructions. No
452	461		administrative case shall be delayed or c ontinued by the Board after
453	462		being placed on an agenda for final Board review, except with th e
454	463		consent of all parties. The licensee or persons affected by the
455	464		imposition of an administrative fine, penalty or fee on final review
456	465		by the Board shall have all rights of appeal preserved pursuant to
457	466		the Administrative Procedures Act until final action by the Board.
458	467		E. The Construction Industries Board shall hear all appeals
459	468		timely made from an administrative ruling relating to an industry
460	469		and trade regulated by the Board; however, this appeal authority
461	470		shall not be in addition to the appeal process aut horized by the
462	471		Administrative Procedures Act. Any final order ruling by the Board
463	472		from an administrative hearing may be further appealed as authorized
464	473		by the Administrative Procedures Act. Any appeal to a district
465	474		court shall be to the district court District Court of Oklahoma
466	475		County. The district court, upon conclusion of an appeal from a
467	476		Board ruling, shall be authorized to award reasonable legal fees to
468	477		the prevailing party.

495	505		SECTION 4. AMENDATORY 59 O.S. 2021, Section 1000.6, is
496	506		amended to read as follows:
497	507		Section 1000.6 A. No later than January 1, 2002, and
498	508		thereafter, each time the position becomes vacant, the Construction
499	509		Industries Board shall hire a Construction Industries Board
500	510		Administrator. The Construction Industri es Board may, upon a
501	511		majority vote, terminate the employment of the Construction
502	512		Industries Board Administrator.
503	513		B. The Construction Industries Board Administrator shall assist
504	514		the Construction Industries Board in the performance of its duties
505	515		and shall report directly to the Board.
506	516		SECTION 5. AMENDATORY 59 O.S. 2021, Section 1000.21, is
507	517		amended to read as follows:
508	518		Section 1000.21 A. 1. There is here by created the Oklahoma
509	519		Uniform Building Code Commission within the Construction Industries
510	520		Board which. The Construction Industries Board is authorized to
511	521		administer the Oklah oma Uniform Building Code Commission Act and
512	522		exercise all incidental powers necessary and proper to implement and
513	523		enforce the provisions of the Oklahoma Uniform Building Code
514	524		Commission Act and the rules promulgated thereto. The Oklahoma
515	525		Uniform Building Code Commission shall consist of thirteen (13)
516	526		members, eleven of whom shall be appointed by the Governor with the
517	527		advice and consent of the Senate as follows:

545	556		statewide organization that represents resident ial
546	557		construction,
547	558		b. one member who is a general contractor from a
548	559		statewide organization that represents commercial

550	561		c. one member who is a contractor from a statewide
551	562		organization that represents electrical contractors,
552	563		d. one member who is a contractor from a statewide
553	564		organization that represents plumbing contractors ,
554	565		e. one member who is a contractor from a statewide
555	566		organization that represents heating and cooling

557	568		f. one member who is a licensed electrical engineer from
558	569		a state-recognized professional engineering firm,
559	570		g. one member who is a local -level regulator/inspector
560	571		who is a member of a statewide organization that is
561	572		exempt from taxation under federal law and designated
562	573		pursuant to the provisions of the Internal Revenue
563	574		Code, 26 U.S.C., Section 170(a), who has represented
564	575		municipalities and had st atutory functions for
565	576		municipalities for at least fifteen (15) years prior
566	577		to November 1, 2005,

593	605		h. one member who is a Certified Building Official
594	606		employed by a political subdiv ision,
595	607		i. one member who is a licensed architect from a
596	608		statewide organization that represents architects,
597	609		j. one member who is from the insurance industry with
598	610		knowledge of building codes and experience in property
599	611		loss mitigation, and
600	612		k. one member who is a licensed mechanical engineer from
601	613		a state-recognized professional engineeri ng firm.
602	614		2. The members shall be appoint ed for staggered terms of four
603	615		(4) years. The initial appointment of the members added by this act
604	616		shall be made within ninety (90) day s of the effective date of this
605	617		act. A full term of office for purposes of det ermining term limits
606	618		provided in subsecti on C of this section shall be the completion of
607	619		a full four-year term of appointment.
608	620		B. The remaining two members of the Commission sh all be the
609	621		State Fire Marshal, or a designee, and an appointee of the
610	622		Construction Industries Board.
611	623		C. Appointed members shall continue in office until a successor
612	624		is appointed by the Governor, notwithstanding the term limitations.
613	625		No appointed member s hall serve more than two consecutive full four -
614	626		year terms; provided, such a mem ber shall be eligible to serve until
615	627		a successor is appointed, and such member may be reappointed after a
616	628		two-year absence from the Commission. The Governor shall fill all

643	656		vacancies and unexpired terms in the same manner as the original
644	657		appointment of the member whose position is to be filled. No
645	658		initial appointment to a term of less than four (4) years or any
646	659		partial-term appointment to fill a vacancy or unexpired term of
647	660		another member shall be counted for purposes of determining term
648	661		limits. An appointed member may be removed by the Governor for
649	662		cause.
650	663		D. Whenever a member of the Commission is absent from more than
651	664		one-half (1/2) of all meetings of the governing body, regul ar and
652	665		special, held within any period of twelve (12) consecutive months,
653	666		the member shall thereupon cease to hold offic e by operation of law.
654	667		SECTION 6. AMENDATORY 59 O.S. 20 21, Section 1000.22, is
655	668		amended to read as follows:
656	669		Section 1000.22 1. A. The Oklahoma Uniform Building Code
657	670		Commission shall organize immediately after July 1, 2009, and
658	671		annually thereafter, by electing annually elect from among its
659	672		members a chair and a vice -chair. The Commission shall hold

661	674		and place determined by the Commission and may hold such spec ial
662	675		meetings, emergency meetings or continued or reconvened meetings as
663	676		found by the Commission to be necessary. A majority of the members
664	677		of the Commission shall constitute a quorum for the transaction of

692	706		2. B. The chair shall preside at meeti ngs of the Commission,

696	710		3. C. The vice-chair shall perform t he duties of the chair
697	711		during the absence or disability of the chair and shall perform such
698	712		other duties as may be prescribed by the Commission.
699	713		4. The Oklahoma Uniform Building Code Commission Chief
700	714		Executive Officer, at the discretion of the Commission, shall:
701	715		a. keep a record of all proceedings of the Commission and
702	716		certify to actions of the Commission,
703	717		b. oversee the receipt and deposit of all monies received
704	718		by the Commission in the appropriate revolving funds,
705	719		c. submit, at the first regular meeting of the Commission
706	720		after the end of each fiscal year, a fully itemized
707	721		report of the receipts and disbursements for the prior
708	722		fiscal year, showing the amount of funds on hand, and
709	723		d. perform such other duties as are prescri bed in this
710	724		act or as may be presc ribed by the Commission.
711	725		5. The Commission shall comply with the provisions of the
712	726		Oklahoma Open Meeting Act, the Oklahoma Open Records Act and the
713	727		Administrative Procedures Act.
714	728		6. D. All members of the Commission and such employees as
715	729		determined by the Commission shall be bonded as required by Sections

749	764		compensation, but shall be reimbursed for all actua l and necessary
750	765		expenses incurred in the performance of their duties in accordance
751	766		with the State Travel Reimbursement Act.
752	767		SECTION 7. AMENDATORY 59 O.S. 2021, Section 1000.23, is
753	768		amended to read as follows:
754	769		Section 1000.23 A. The Oklahoma Uniform Building Code
755	770		Commission shall have the power and the duty to review and adopt
756	771		prescribe standards and practices pursuant to this act by reviewing
757	772		and adopting all building codes for residential and commerc ial
758	773		construction to be used by all entities within this state. Codes
759	774		and standards adopted by the Commission shall be the minimum
760	775		standards for residential and commercial construction in this state.
761	776		B. All public projects shall abide by such minimum stan dards
762	777		and requirements; provid ed, nothing in the Oklahoma Unifo rm Building
763	778		Code Commission Act shall prevent or take away from state agencies
764	779		the authority to enact and enforce requirements containing higher

793	809		C. Municipalities and other political subdivisions shall abide
794	810		by such minimum standards and requirements; provided, nothing in the
795	811		Oklahoma Uniform Building Code Commission Act shall prevent or take
796	812		away from such municipalities and other political subdivisio ns the
797	813		authority to enact and enf orce requirements containing higher
798	814		standards and requirements than such minimum standards and
799	815		requirements.
800	816		D. The Oklahoma Uniform Building Code Commission shall have the
801	817		power and duty to establish a training and certification process for
802	818		all residential and commercial building code inspectors that
803	819		prescribes standards, practices and procedures for prelicensing
804	820		inspector training and other inspector training that enhances the
805	821		education of building and construction inspec tors; provided, the
806	822		training does not infringe upon the education requirements and
807	823		processes under the Oklahoma Inspectors Act. Prelicensing programs
808	824		prescribing the standards, practices and procedures for prelicensing
809	825		building inspectors for use by other state agencies and other
810	826		education providers, both public and private, may be developed
811	827		through the use of a technical comm ittee that develops any program
812	828		or curriculum, and recommends to the Construction Industries Board
813	829		proposed administrative rules set ting forth any standards and
814	830		procedures to be adopted pursuant to paragraph 1 of subsection A of

842	859		regional prelicensing training on a regional basis for the purpose
843	860		of training the county and mu nicipal inspectors in the Uniform
844	861		Building Code statewide building codes adopted pursuant to this act .
845	862		The regional training shall be offered at no cost to the participant
846	863		building and construction inspector trainee along with any books or
847	864		materials as may be determined necessary by the Board when fu nds are
848	865		available and shall be funded from the funds received pursuant to
849	866		Section 1000.25 of this title. Each inspector operating in this
850	867		state on behalf of any state agency or any municipal or county
851	868		office may complete participate in regional training and be issued a
852	869		certification for inspections by the Uniform Building Code
853	870		Commission on and after January 1, 2015 certificate of completion
854	871		for any training program established pursuant to this act; however,
855	872		any certificate of completion is subject to the continuing education
856	873		approval process of the licensing entity . The training and
857	874		certification applications standards, qualifications and application
858	875		procedures for the instructor, provider, if a nonstate gover nmental
859	876		entity, and the inspector trainee appl ications shall be promulgated
860	877		by administrative rules of the Commission Board. The Commission may
861	878		establish forms Forms and procedures may be established to implement
862	879		and administer the provisions of this sect ion.
863	880		SECTION 8. AMENDATORY 59 O.S. 2021, Section 1000.24, is
864	881		amended to read as follows:

891	909		Section 1000.24 A. 1. Beginning July 1, 2009, pursuant
892	910		Pursuant to and in compliance with Article I of the Administrative
893	911		Procedures Act, the Oklahoma Uniform Building Code Commission
894	912		Construction Industries Boa rd shall have the power to adopt, amend,
895	913		repeal and promulgate rules as may be necessary to perform the
896	914		duties required under the Oklahoma Uniform Building Code Commission
897	915		Act; provided that all rules pertaining to adoption of st atewide
898	916		building codes proposed after technical review and for the purpose
899	917		of revising and adopting the statewide building codes pursuant to
900	918		this act shall not be changed or altered by the Construction
901	919		Industries Board, so that the Oklahoma Uniform Buildin g Code
902	920		Commission retains a nd has the full, unaltered authority to review,
903	921		revise and adopt the statewide building codes , with any
904	922		administrative services needed in the administrative rules process
905	923		to be provided by administrative staff of the Construction
906	924		Industries Board. Rules authorized under this section shall not
907	925		become effective prior t o October 1, 2009.
908	926		2. Beginning October 1, 2009, the Commission shall have the
909	927		power to enforce the provisions of the O klahoma Uniform Building
910	928		Code Commission Act.
911	929		3. Any codes adopted by st ate agencies, municipalities or other
912	930		political subdivisions of the state prior to uniform codes being
913	931		adopted by the Oklahoma Uniform Building Code Commission, pursuant
914	932		to the provisions of, or rules promulgated pursuant to, the Oklahoma

942	961		in effect until uniform codes are adopted by the Oklahoma Uniform
943	962		Building Code Commission.
944	963		B. The Oklahoma Uniform Building Code C ommission shall have the
945	964		following powers:
946	965		1. Exercise all incidental po wers and duties which are
947	966		necessary to effectuate the provision s of the Oklahoma Uniform
948	967		Building Code Commission Act;
949	968		2. Adopt and have an official seal;
950	969		3. Maintain an administrat ive staff, including, but not limited
951	970		to, an Oklahoma Uniform Building Co de Commission Chief Executive
952	971		Officer;
953	972		4. Direct such other ex penditures as may be necessary in the
954	973		performance of its duties, including, but not limited to,
955	974		expenditures for office space, equipment, furnishings and contracts
956	975		for services. All expenditur es shall be made pursuant to the
957	976		Oklahoma Central Purchasing Ac t;
958	977		5. 2. Appoint technical committees to review and recommend for
959	978		adoption all building codes. The technical committee s shall review
960	979		and recommend building codes wi th any amendments for adopt ion by the
961	980		Commission, receive requests for advisory opinions f or
962	981		interpretation of any statewide building code adopted pursuant to
963	982		this act, evaluate the requests for appropriateness of need for an
964	983		advisory opinion, assign any r equests to the appropriate technical

993	1013		to an entity's previous interpretati on and, upon recommendation of a
994	1014		technical committee, issue advisory opin ions interpreting the
995	1015		adopted statewide code ; and
996	1016		6. 3. Create a website listing all building codes adopted by
997	1017		the Commission and any advisory opinions issued . The website shall
998	1018		provide a method for listing all codes adopted by a state agency,
999	1019		city or any other political subdivision of the state containing
1000	1020		higher standards and requirements than the codes adopted pursuant to
1001	1021		the Oklahoma Uniform Building Code Commission Act as require d in
1002	1022		Section 14-107 of Title 11 of the Oklahom a Statutes.
1003	1023		C. After October 1, 2009, the Commission The Construction
1004	1024		Industries Board shall account for all receipts and expenditures of
1005	1025		the monies of the Commission, including annually preparing and
1006	1026		publishing a statement of receipts and expenditures of the
1007	1027		Commission for each fi scal year. The Commission 's annual statement
1008	1028		of receipts and expenditures shall be audited by the State Auditor
1009	1029		and Inspector or an independent accounting firm, and the audit
1010	1030		report shall be certified to the Governor of this sta te to be true
1011	1031		and correct, under oath, by the chair and vice -chair of the
1012	1032		Commission Construction Industries Board.
1013	1033		SECTION 9. AMENDATORY 59 O.S. 2021, Section 1000.25, is

1041	1062		Section 1000.25 A. The Oklahoma Uniform Building Code
1042	1063		Commission shall establish recommend to the Construction Indust ries
1043	1064		Board a system of fees to be charged for the issuance and renewal of
1044	1065		any construction permits i ssued by any agency, municipality, or
1045	1066		other political subdivision o f this state.
1046	1067		B. This provision is subject to the following limitations:
1047	1068		1. No schedule of fees may be established or amended by the
1048	1069		Commission Board except during such times as the Legis lature is in
1049	1070		session; provided, the Commission Board may establish or amend a
1050	1071		schedule of fees at a time when the Legislature is not in session if
1051	1072		the fees or schedule of fees has been specifically authorized by the
1052	1073		Legislature pursuant to paragraphs 2 and 3 of this subsection . The
1053	1074		Commission must Board shall follow the procedures required by
1054	1075		Article I of the Administrative Procedures Act for adoption of rul es
1055	1076		in establishing or amending any such schedule of fees;
1056	1077		2. The Commission Board shall charge fees for building permits
1057	1078		and renewal of such permits issued by any sta te agency,
1058	1079		municipality, or other political subdivision of this state which
1059	1080		authorized work governed by codes within the purview of the
1060	1081		Commission Board only within the following ranges:
1061	1082		For issuance of permit not to exceed $5.00 $4.00
1062	1083		For renewal of permi t not to exceed $5.00
1063	1084		Fees shall be remitted to the Oklahoma Uniform Building Code
1064	1085		Commission Revolving Fund created pursuant to Section 1000.28 of
1065	1086

1092	1114		calendar month. The Oklahoma Uniform Buil ding Code Commission shall
1093	1115		report to the Governor, President Pro Tempore of the Senate an d the
1094	1116		Speaker of the House semiannually its collections for the six (6)
1095	1117		months preceding the report;
1096	1118		3. Fees shall be co llected by any state agency, municipality or
1097	1119		other political subdivision issuing construction permits within this
1098	1120		state. The fees shal l be deposited in an account created by the
1099	1121		collecting entity for that purpose;
1100	1122		4. The state agency , municipality or oth er political
1101	1123		subdivision shall remit the monie s in the account on a monthly basis
1102	1124		directly to the State Treasury for deposit in the Okl ahoma Uniform
1103	1125		Building Code Commission Revolving Fund created pursuant to Section
1104	1126		1000.28 of this title. Along with the deposits required by this
1105	1127		paragraph, each stat e agency, municipality or other political
1106	1128		subdivision shall also submit a report stating the total amount of
1107	1129		funds collected and the total number of fees imposed during the
1108	1130		preceding month. The report shall be made on computerized or manual
1109	1131		disposition reports as provided by rule of the Commission rules
1110	1132		promulgated pursuant to paragraph 1 of subsection A of Section
1111	1133		1000.24 of this title ;
1112	1134		5. Any state agency, municipality or other political
1113	1135		subdivision collecti ng and remitting fees pursuant to this section
1114	1136		may levy a fee up to fifty cents ($0.50) for every construction

1142	1165		into an account for the sole use of the state agency, muni cipality
1143	1166		or other political subdivision. The state agency, municip ality or
1144	1167		other political subdivision shall state the total amount of funds
1145	1168		collected and the total number of fees imposed to the State Treasury
1146	1169		in the report required by paragraph 4 of this subsection;
1147	1170		6. It shall be the responsibility of the state agency ,
1148	1171		municipality or other political subdivision to account for and
1149	1172		ensure the correctness a nd accuracy of payments made to the State
1150	1173		Treasury pursuant to this title;
1151	1174		7. Funds collected by a state agency, municip ality or other
1152	1175		political subdivision and remit ted to the State Treasury pursuant to
1153	1176		the Oklahoma Uniform Building Code Commission Act s hall be deposited
1154	1177		in the Oklahoma Uniform Building Code Commission Revolving Fund and
1155	1178		shall be used solely for the purpos es of the Oklahoma Uniform
1156	1179		Building Code Commission Act; provided that of the gross permit fees
1157	1180		charged, collected and received, ten pe rcent (10%) shall be paid
1158	1181		into the General Revenue Fund of the state ; and
1159	1182		8. Nothing in this act sh all prevent the Oklah oma Uniform
1160	1183		Building Code Commission from offe ring incentives for prompt
1161	1184		payment.

1191	1215		revolving fund for the Oklahoma Uniform Build ing Code Commission to
1192	1216		be designated the Oklahoma Uniform Building Code Commission
1193	1217		Revolving Fund. The fund shall be a continuous fund, not subject to
1194	1218		fiscal year limitations, and shall consist of all fees or payments
1195	1219		of any type received by the Commission Construction Industries Board
1196	1220		for the purposes outlined in the provisions of the Oklah oma Uniform
1197	1221		Building Code Commission Act . All monies accruing to the credit of
1198	1222		the fund are hereby appropriated and may b e budgeted and expended by
1199	1223		the Commission Board for the purpose of implementing and
1200	1224		administering the Oklahoma Uniform Building Code C ommission Act.
1201	1225		Expenditures from the fund shall be made upon warrants issued by the
1202	1226		State Treasurer against claims filed as prescribed by law with the
1203	1227		Director of the Office of Management and Enterprise Services for
1204	1228		approval and payment.
1205	1229		SECTION 11. REPEALER 59 O.S. 20 21, Sections 1000.26 and
1206	1230		1000.27, are hereby repealed.
1207	1231		SECTION 12. This act shall become effective November 1, 2023.
