5159 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5260 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.508, is
5361 amended to read as follows:
5462 Section 1210.508 A. 1. By no later than December 31, 2016,
5563 the State Board of Education shall adopt a statewide system of
5664 student assessments in c ompliance with the Elementary and Secondary
5765 Education Act of 1965 (ESEA) , as reauthorized and amended by P.L.
5866 No. 114-95, also known as the Every Student Succeeds Act (ESSA).
59-2. The statewide student assessment s ystem adopted by the B oard
60-pursuant to this subsection shall be aligned with the Oklahoma

94+2. The statewide student assessment system adopted by the B oard
95+pursuant to this subsection shall be aligned with the Oklahoma
8796 Academic Standards as ado pted by the Board and which prepare
8897 students for college and careers.
8998 B. 1. The Board shall issue a r equest for proposals for the
9099 selection of assessments to be administered to stude nts in grades
91100 three through twelve as a part of the statewide student as sessment
92101 system adopted by the Board pursuant to this section.
93102 2. The Board shall adopt assessments fr om the selected
94103 proposals that were submitted pursuant to pa ragraph 1 of this
95104 subsection. The adopted assessments shall be administered by the
96105 Board for a period that is in coordination with the six -year subject
97106 area textbook adoption cycle unless the ven dor does not fulfill the
98107 terms of the contract or fails to c omply with or violate s the terms
99108 of the contract. The Board shall administer the assessments
100109 beginning with the 2017 -2018 school year.
101110 C. The statewide student assessment system adopted by the B oard
102111 pursuant to this section shall include assessments that :
103112 1. Are aligned with the Oklahoma subject matter standards as
104113 adopted by the Board;
105114 2. Provide a measure of comparability among other states;
106115 3. Yield both norm-referenced scores and criterion -referenced
107116 scores;
108-4. Have a track record of statistical r eliability and accura cy;

144+4. Have a track record of statistical r eliability and accura cy;

138148 D. For the 2016-2017 school year, the Board shall administer
139149 assessments in:
140150 1. English Language Arts or Reading and Mathemati cs in grades
141151 three through eight and at least once in high school, during the
142152 grade span of nine through twelve;
143153 2. Science not less than once during each grade span of three
144154 through five, six th rough nine and ten through twelve; and
145155 3. United States His tory not less than on ce during the grade
146156 span of nine through twelve.
147157 E. 1. Beginning with the 2017-2018 school year, the statewide
148158 student assessment system shall include assessments in:
149159 a. English Language Arts and Mathematics in grades three
150160 through eight and at least onc e in high school, during
151161 the grade span of nine through twelve,
152162 b. Science not less than once during each grade span of
153163 three through five, six through nine and ten through
154164 twelve, and
155165 c. United States History, with an emphasis on civi cs, not
156166 less than once during the grade span of nine through
157167 twelve.
158-2. Beginning with the 2 017-2018 school year, the statewide

195+2. Beginning with the 2 017-2018 school year, the statewide
196+student assessment system may include:
186197 a. assessments in Reading an d Writing in certain grades
187198 as determined by the Board, and
188199 b. contingent upon the availability of funds, an
189200 additional nationally recognized college - and career-
190201 readiness assessment or assessments as recommended by
191202 the State Department of Education which will be
192203 administered to students in high school at no cost t o
193204 the student.
194205 3. a. Beginning with the 2023-2024 school year, the
195206 statewide student assessment system m ay include:
196207 (1) a retest of the nati onally recognized college -
197208 and career-readiness assessment administered
198209 pursuant to subparagraph b of paragraph 2 of th is
199210 subsection, or
200211 (2) nationally recognized, portable career-readiness
201212 assessments that lead to a National Career
202213 Readiness Certificate.
203214 b. The assessments described in this paragraph shall be
204215 available for students in the fall semester of their
205216 twelfth grade year and shall be administered at no
206217 cost to students.
207-F. 1. Beginning with students entering the ninth grade in the

245+F. 1. Beginning with students entering the ninth grade in the
246+2017-2018 school year, each student shall take the assessment or
247+assessments included in the statewide student assessment system
236248 adopted by the Board pursuant to subsection A of this section in
237249 order to graduate from a public high school with a standard diploma.
238250 All students shall take the assessment or assessments prior to
239251 graduation, unless otherwise exempt by law.
240252 2. Beginning with students entering the ninth grade in the
241253 2017-2018 school year, each student, in addition to taking the
242254 assessment or assessments includ ed in the statewide student
243255 assessment system adopted by the Board pursuant to subsection A of
244256 this section, shall meet any other high school graduation
245257 requirements adopted by the Board pursuant to Section 5 of Enrolled
246258 House Bill No. 3218 of the 2nd Sess ion of the 55th Oklahoma
247259 Legislature in order to graduat e from a public high school with a
248260 standard diploma.
249261 3. For students who start the ninth grade prior to or during
250262 the 2016-2017 school year, school districts shall adopt a plan that
251263 establishes the assessment or assessments those students are
252264 required to take in order to graduate from a public high school with
253265 a standard diploma. The plan may also include any or all of the
254266 other high school graduation requirements adopted by the Board
255267 pursuant to Section 5 of Enrolled House Bill No. 3218 of the 2nd
256268 Session of the 55th Oklahoma Legislature that those students will be
257-required to meet in order to graduate from a public high school with
258-a standard diploma.

296+required to meet in order to graduate from a public high school with
297+a standard diploma.
285298 4. The Board shall promulgate rules to ensure t hat students who
286299 transfer into an Oklahoma school distri ct from out-of-state after
287300 the junior year of high school shall not be denied the opportunity
288301 to be awarded a standard diploma due to differing testing
289302 requirements.
290303 G. In order to provide an indicat ion of the levels of
291304 competency attained by the student in a permanent record for
292305 potential future employers and instit utions of higher education,
293306 school districts shall report on the high school transcript of the
294307 student the highest-achieved score on the assessment or assessments
295308 included in the statewide stud ent assessment system adopted by the
296309 Board pursuant to subsecti on A of this section and any business- and
297310 industry-recognized endorsements attained.
298311 H. Students who do not perform at a proficiency le vel on
299312 assessments shall be remediated as established in the assessment
300313 requirements adopted by the Board pursuant to S ection 5 of Enrolled
301314 House Bill No. 3218 of the 2nd Session of the 55th Oklahoma
302315 Legislature, subject to the availability of funding.
303316 I. 1. All assessments required by this section shall meas ure
304317 academic competencies in correlation with the subject matte r
305318 standards adopted by the Board pursuant to Sections 11 -103.6 and 11-
306319 103.6a of this title and referred to as the Oklahoma Academic
307-Standards. The State Board of Education shall evaluate the s ubject
308-matter standards to ensure the competencies reflect high standards,

347+Standards. The State Board of Education shall evaluate the s ubject
348+matter standards to ensure the competencies reflect high standards,
335349 are specific, well-defined, measurable, challenging, and will
336350 prepare elementary students for next -grade-level course work an d
337351 secondary students for postsecondary studies at instit utions of
338352 higher education or technology center schools without the need for
339353 remediation. All subject matter standards shall reflect the goals
340354 as set forth in Section 11 -103.6 of this title and of im proving the
341355 state average ACT score.
342356 2. The State Department of Education shall annually evaluate
343357 the results of the a ssessments. The State Board of Education shall
344358 ensure that preliminary results for all statewide assessments are
345359 reported to districts n o later than June 20 of each year and are
346360 presented in a manner that yields detailed, diagnostic information
347361 for the purpose of guiding instruction and student remediation. As
348362 improvements are made to the assessments required by this section,
349363 the Board shall seek to increase the depth of knowledge assessed for
350364 each subject. The State Board of Education shall seek to ensu re
351365 that data yielded from the assessments required in this section are
352366 utilized at the school district level to inform instruction,
353367 professional development, school improvement and remediation for
354368 students.
355369 3. The Commission for Educational Quality and Ac countability
356370 shall determine the cut scores for the performance levels on all
357-statewide assessments. The Commission shall conduct an ong oing
358-review to compare the statewide assessment content and performance

398+statewide assessments. The Commission shall conduct an ong oing
399+review to compare the statewide assessment content and performance
385400 descriptors with those of other states. Upon r eceipt of the review,
386401 the Commission may adjust the cut scores as necessary.
387402 4. The State Board of Education, for the purposes of conduc ting
388403 reliability and validity studies, monitoring contra ctor adherence to
389404 professionally accepted testing standards, an d providing
390405 recommendations for testing program improvement, shall retain the
391406 services of an established, independent agency or organizat ion that
392407 is nationally recognized for its technical expe rtise in educational
393408 testing but is not engaged in the developm ent of aptitude or
394409 achievement tests for elementary or secondary level grades. These
395410 national assessment experts shall annually conduct studies of the
396411 reliability and validity of the statewide assessments administered
397412 pursuant to this section. Validity s tudies shall include studies of
398413 decision validity and concurrent validity.
399414 J. 1. The State Board of Education shall promulgate rules
400415 setting the assessment window dates for each statewide ass essment so
401416 that the assessments are administered according to r ecommended
402417 testing protocols, and so that the assessment results are reported
403418 back to school districts in a timely manner. The vendor sh all
404419 provide a final electronic data file of all school s ite, school
405420 district, and state results to the State Department of Education and
406421 the Office of Educational Quality and Accountability prior to August
407-20 of each year. The Department shall forward the final data files
408-for each school district and each scho ol site in that district to

450+for each school district and each scho ol site in that district to
435451 the school district. The Board sha ll ensure the contract with the
436452 vendor includes a provision that the vendor report assessment
437453 results directly to the Office of Education al Quality and
438454 Accountability at the same time it is rep orted to the Board.
439455 2. State, district, and site level results of all assessments
440456 required in this section shall be disaggregated by gender, race,
441457 ethnicity, disability status, migrant status, Englis h proficiency,
442458 and status as economically disadvantaged, except that such
443459 disaggregation shall not be required in a cas e in which the number
444460 of students in a category is insufficient to yield statistically
445461 reliable information or the results would reveal p ersonally
446462 identifiable information about an individual s tudent. Each school
447463 site shall notify the student 's parents of the school's performance
448464 levels in the Oklahoma School Testing Program as reported in the
449465 Oklahoma Educational Indicators Program at the end of each school
450466 year.
451467 K. The State Board of Educati on shall be responsible for the
452468 field-testing and validation of the statewide assessment system
453469 required in subsection A of this section.
454470 L. The State Board of Education shall develop, administer, an d
455471 incorporate as a part of the Oklahoma School Testing P rogram, other
456472 assessment programs or procedures, including appr opriate
457-accommodations for the assessment of students with disabilities as

500+accommodations for the assessment of students with disabilities as
484501 required by the Individuals with Disabilities Education Act (I DEA),
485502 20 U.S.C., Section 1400 et seq.
486503 M. For purposes of developing and administering alternate
487504 assessments for studen ts with the most significant cognitive
488505 disabilities, the State Board of Education shall not be subject to
489506 subsections D and E of Section 11-103.6a of this title.
490507 SECTION 2. This act shall become effective July 1, 2023.
491508 SECTION 3. It being immediately necessary for the preservation
492509 of the public peace, health or safety, an emergency is hereby
493510 declared to exist, by reason whereof thi s act shall take effect and
494511 be in full force from and after its passage and approval.
