33149 BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:

35150 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11-314, is
36151 amended to read as follows:

38152 Section 11-314. A. This section shall be kn own and may be
39153 cited as "Bernardo's Law" the "Bernardo-Mills Law".

41154 B. The driver of a motor vehicle, upon approaching a stationary
42155 authorized emergency vehicle, a Department of Transportation
43156 maintenance vehicle, a T urnpike Authority maintenance vehicle, a
44157 stationary vehicle that is displaying flashing lights or a licensed
45-wrecker that is displaying a flashing amber light, a combination red ENR. H. B. NO. 2684 Page 2

46185 or blue light or any combination of amber, red or blue lights,
47186 shall:

49187 1. If traveling on a highway that consists of two or more lanes
50188 that carry traffic in the same direction of travel as that of the
51189 driver, the driver shall proceed with due caution and shall, if
52190 possible and with due regard to the road, weather, and traffic
53191 conditions, change lanes into a lane that is not adjacent to the
54192 stationary authorized emergency vehicle, a Department of
55193 Transportation maintenance vehicle, a Turnpike Authority maintenance
56194 vehicle, or licensed wrecker; or if the driver is not able to change
57195 lanes or if to do so would be unsafe, the dr iver shall proceed with
58196 due caution and reduce the speed of the motor vehicle to a safe
59-speed for the existing road, weather, and traffic conditio ns; and
60-

198+at least ten (10) miles per hour below the posted speed limit; and
61199 2. If traveling on a highway other than a highway described in
62200 paragraph 1 of this subsection, the driver shall proceed with due

72235 maintenance vehicle, a Turnpike Authority maintenance vehicle, or
73236 licensed wrecker from the consequences of reckless disregard f or the
74237 safety of all persons and property upon the highway.

76238 D. Upon conviction for committing the offense of endangerment
77239 of an emergency worker pursuant to subsection B of this section, if
78240 no injury or death of an emergency worker resulted from the offens e,
79241 and in addition to any other penalty autho rized by law, the person
80242 shall be subject to a fine of:
81-
82243 1. One Thousand Dollars ($1,000.00) for a first offense; and
83-
84244 2. Two Thousand Five Hundred Dollars ($2,500.00) for a se cond
85245 offense.

87246 E. A person shall be deemed to commit the offense of aggravated
88247 endangerment of an emergency worker upon conviction for any offense
89248 pursuant to subsection B of this section when such offense results
90-in the injury or death of an emergency worker. Upon conviction for ENR. H. B. NO. 2684 Page 3
249+in the injury or death of an emergency worker. Upon conviction for
91250 committing the offense of aggravated endangerment of an emergency
92251 worker, in addition to any other penalty authorized by law, the
93252 person shall be subject to a fine of not more than Five Thousand
94253 Dollars ($5,000.00) if the offense resulted in i njury to an
95254 emergency worker and not more than Ten Thousand Dollars ($10,000.00)
96255 if the offense result ed in the death of an emergency worker.
256+F. No person shall be cited or convicted for endangerment of an
257+emergency worker or aggravated endangerment of an emergency worker,
258+for any act or omission otherwise constituting a n offense under

98-F. No person shall be cited or convicted for endangerment of an
99-emergency worker or aggravated endangerment of an emergency worker
100-for any act or omission otherwise constituting a n offense under
