33	149		BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:

35	150		SECTION 1. AMENDATORY 47 O.S. 2021, Section 11-314, is
36	151		amended to read as follows:

38	152		Section 11-314. A. This section shall be kn own and may be
39	153		cited as "Bernardo's Law" the "Bernardo-Mills Law".

41	154		B. The driver of a motor vehicle, upon approaching a stationary
42	155		authorized emergency vehicle, a Department of Transportation
43	156		maintenance vehicle, a T urnpike Authority maintenance vehicle, a
44	157		stationary vehicle that is displaying flashing lights or a licensed

49	187		1. If traveling on a highway that consists of two or more lanes
50	188		that carry traffic in the same direction of travel as that of the
51	189		driver, the driver shall proceed with due caution and shall, if
52	190		possible and with due regard to the road, weather, and traffic
53	191		conditions, change lanes into a lane that is not adjacent to the
54	192		stationary authorized emergency vehicle, a Department of
55	193		Transportation maintenance vehicle, a Turnpike Authority maintenance
56	194		vehicle, or licensed wrecker; or if the driver is not able to change
57	195		lanes or if to do so would be unsafe, the dr iver shall proceed with
58	196		due caution and reduce the speed of the motor vehicle to a safe
59		-	speed for the existing road, weather, and traffic conditio ns~~; and~~

	198	+	at least ten (10) miles per hour below the posted speed limit; and

73	236		licensed wrecker from the consequences of reckless disregard f or the
74	237		safety of all persons and property upon the highway.

76	238		D. Upon conviction for committing the offense of endangerment
77	239		of an emergency worker pursuant to subsection B of this section, if
78	240		no injury or death of an emergency worker resulted from the offens e,
79	241		and in addition to any other penalty autho rized by law, the person
80	242		shall be subject to a fine of:

82	243		1. One Thousand Dollars ($1,000.00) for a first offense; and
83		-
84	244		2. Two Thousand Five Hundred Dollars ($2,500.00) for a se cond
85	245		offense.

87	246		E. A person shall be deemed to commit the offense of aggravated
88	247		endangerment of an emergency worker upon conviction for any offense
89	248		pursuant to subsection B of this section when such offense results

	249	+	in the injury or death of an emergency worker. Upon conviction for
91	250		committing the offense of aggravated endangerment of an emergency
92	251		worker, in addition to any other penalty authorized by law, the
93	252		person shall be subject to a fine of not more than Five Thousand
94	253		Dollars ($5,000.00) if the offense resulted in i njury to an
95	254		emergency worker and not more than Ten Thousand Dollars ($10,000.00)
