4554 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4655 SECTION 1. AMENDATORY 74 O.S. 2021, Section 2221, is
4756 amended to read as follows:
4857 Section 2221. A. The Commission, through the Oklahoma Tourism
4958 and Recreation Department, is authorized to promote state-owned, -
5059 leased, or -operated facilities. The Department may uti lize
5160 specific promotion programs such as the provision of complimentary
5261 rooms, package-rate plans, group rates, guest in centive sales
5362 programs, entertainment of pro spective guests, employee-information
5463 programs, golf promotional programs as well as other s ales and
55-promotion programs considered acceptable in the hospitality
56-industry, in the travel industry, or the regional m agazine industry
57-are approved as necessary a dvertising and promotion expenses.

92+industry, in the travel industry, or the regional m agazine industry
93+are approved as necessary a dvertising and promotion expenses.
8494 B. In order to best carry out the duties and responsibil ities
8595 of the Department and to serve the people of the state in the
8696 promotion of tourism and tourism economic developmen t, the
8797 Department may enter into partnership s for promotional programs and
8898 projects with a private person, firm, corporation, organizati on or
8999 association. The Department may enter into contracts or agreements
90100 under terms to be mutually agreed upon to carr y out the promotional
91101 programs and projects, excluding the advertising contract by the
92102 Department which utilizes the Tourism Promotion T ax or acquisition
93103 of land or buildings. The contracts or agreements may be negotiated
94104 and shall not be subject to the p rovisions of the Oklahoma Central
95105 Purchasing Act or the Public Competitive Bidding Act of 1974.
96106 C. All contracts or agreements entered into as partnerships fo r
97107 promotional projects or programs by the Department shall be approved
98108 by the Commission.
99109 D. Pursuant to subsection A of this section, the D epartment
100110 shall create a state employee information and promotion program
101111 using the following procedures:
102112 1. All full-time state employees, excluding State Legislators,
103-who have been employed by the state for one (1) year or longer shall
104-be allowed to have two (2) consecutive nights of accommodation at a
105-state-operated lodge, room, or cabin per calendar year at a
106-discounted rate that covers a percentage of the operating costs of
107-said accommodation, including tax;

142+at a state-operated lodge, room, or cabin per calendar year at a

134145 2. State employees shall obtain approval from facility managers
135146 prior to use of the program;
136147 3. Facility managers shall not accept reservations for any
137148 dates when the facility could be expected to be fully occ upied;
138149 4. State employees shall be responsible for all other expenses
139150 including food, travel, cleaning costs, and accommodations in excess
140151 of those provided by the program; and
141152 5. State employees shall be provided a questionnaire to be
142153 completed upon the end of the stay, which shall be forwarded to the
143154 facility manager.
144155 E. The Department shall promulgate rules for the program,
145156 including seasonal requirements, specific costs per accommodation,
146157 and the number of el igible reservations per calendar year .
147158 SECTION 2. This act shall become effective November 1, 2023.
