5548 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5649 SECTION 1. AMENDATORY 74 O.S. 2021, Section 314, is
5750 amended to read as follows:
5851 Section 314. The State Fire Marshal and or the chief of the
5952 fire department of every city , town or village district in which a
6053 fire department is established, and or the mayor of every
6154 incorporated village city or town in which no fire department
6255 exists, and or the sheriff of the county shall investiga te the
6356 cause, origin and circumstances of every fire occurring in such
6457 city, village, town district or county by which property has been
6558 destroyed or damaged, and shall especially m ake investigation as to
59+whether the cause of such fire was the result of carelessness or
60+design accidental or intentional. Said investigation shall begin
61+within two (2) days, not including Sundays, forty-eight (48) hours

93-whether the cause of such fire was the result of carelessness or
94-design accidental or intentional. Said investigation shall begin
95-within two (2) days, not including Sundays, forty-eight (48) hours
9688 of the occurrence of such fire , and the said Fire Marshal shall have
9789 the right to supervise and d irect such investigation whenever he
9890 deems it necessary or expedient. The officer ma king the
9991 investigation of fires, shall forthwith notify said Fire Marshal and
10092 shall within a week of the occ urrence of the fire furnish to the
10193 said Fire Marshal a written statement of all facts relating to the
10294 cause and origin of the fire, and such other i nformation as may be
10395 called for by blanks provided by said Marshal. The State Fire
10496 Marshal shall keep in hi s office a record of all fires occurring in
10597 the state, together with all facts, statistics and circumstances
10698 including the origin of the fires, whic h may be determined by the
10799 investigation provided by this act; such records shall a t all times
108100 be open to the public inspection, and such portions of it as the
109101 insurance commissioner may deem necessary shall be transcribed and
110102 forwarded to him within fifte en (15) days from the 1st day of
111103 January of each year . The officer making the investigation of fires
112104 shall within a week of the occurrence of the fire complete a written
113105 statement of all acts relating to the cause and origin of the fire
114106 and shall within forty-eight (48) hours of the occurrence of such
115107 fire report to the State Fi re Marshal all civilian and firef ighter
116108 injuries and fatalities resulting from the occurrence of such f ire.
109+SECTION 2. This act shall become effective November 1, 202 3.
