An Act relating to state government; amending 74 O.S. 
2021, Section 314, which relates to investigation of 
fires; modifying time period for start of 
investigation; and providing an effective date . 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    AMENDATORY     74 O.S. 2021, Section 314, is 
amended to read as follows: 
Section 314.  The State Fire Marshal and or the chief of the 
fire department of every city , town or village district in which a 
fire department is established, and or the mayor of every 
incorporated village city or town in which no fire department 
exists, and or the sheriff of the county shall investiga te the 
cause, origin and circumstances of every fire occurring in such 
city, village, town district or county by which property has been 
destroyed or damaged, and shall especially m ake investigation as to

whether the cause of such fire was the result of carelessness or 
design accidental or intentional.  Said investigation shall begin 
within two (2) days, not including Sundays, forty-eight (48) hours 
of the occurrence of such fire , and the said Fire Marshal shall have 
the right to supervise and direct such investigation whenever he 
deems it necessary or expedient.  The officer ma king the 
investigation of fires, shall forthwith notify said Fire Marshal and 
shall within a week of the occ urrence of the fire furnish to the 
said Fire Marshal a written statement of all facts relating to the 
cause and origin of the fire, and such other i nformation as may be 
called for by blanks provided by said Marshal.  The State Fire 
Marshal shall keep in hi s office a record of all fires occurring in 
the state, together with all facts, statistics and circumstances 
including the origin of the fires, whic h may be determined by the 
investigation provided by this act; such records shall a t all times 
be open to the public inspection, and such portions of it as the 
insurance commissioner may deem necessary shall be transcribed and 
forwarded to him within fifte en (15) days from the 1st day of 
January of each year .  The officer making the investigation of fires 
shall within a week of the occurrence of the fire complete a written 
statement of all acts relating to the cause and origin of the fire 
and shall within forty-eight (48) hours of the occurrence of such 
fire report to the State Fi re Marshal all civilian and firef ighter 
injuries and fatalities resulting from the occurrence of such fire.

SECTION 2.  This act shall become effective November 1, 202 3.
