AS INTRODUCED
An Act relating to militia; authorizing the Gov ernor
to make certain decision relat ing to the Oklahoma
National Guard; moving certain asse ts to the Oklahoma
State Guard under certain circumstances; providing
for codification; and providing an effective date .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be co dified
in the Oklahoma Statutes as Section 23.1 of Title 44, unless there
is created a duplication in numb ering, reads as follows:
In the event that the President of the United States activat es
the Oklahoma National Guard for federal duty, the Governor sha ll
have the authority to accept o r decline the request. If the
Governor declines the request, all resources, offic ers, employees,
positions, and funds relating to the Oklahoma National Guard shall
be immediately transferred to the Oklahoma State Guard .
SECTION 2. This act shall become effective November 1, 2023.
