50101 SECTION 1. NEW LAW A new section of law to be codified
51102 in the Oklahoma Statutes as Section 18-114.15 of Title 70, un less

194258 2. If a school district intends to pr ovide retirement benefits
195259 to a teacher such tha t the teacher’s salary would be less than the
196260 amounts set forth in the minimum salary sc hedule specified in
197261 subsection A of this section, the district shall be required to
198262 provide written notification to the t eacher prior to his or her
199263 employment or, if al ready employed by the district, no later than
200264 thirty (30) days prior to the date the dis trict elects to provide
201265 retirement benefits such that the teacher’s salary would be le ss
202266 than the minimum salary schedule .

204267 C. Any of the degrees referred to in this se ction shall be from
205268 a college recognized by the State Board of Education. The Board
206269 shall accept teaching experience from out-of-state school districts
207270 that are accredited b y the State Board of Education or a ppropriate
208271 state accrediting agency for the dis tricts. The Board shall accept
209272 teaching experience from out-of-country schools that are accredited
210273 or otherwise endorsed by the appropriate national or regional
211274 accrediting or endorsement authority. Out -of-country certification
212275 documentation in a languag e other than English shall be analyzed by
213276 an educational credential evaluation service i n accordance with
214277 industry standards and guidelines and approved by the State

215305 Department of Education. The person seekin g to have credit granted
216306 for out-of-country teaching experience shall be responsible for all
217307 costs of the analysis by a credential eval uation service. The Board
218308 shall accept teaching experience from primary and secondary schools
219309 that are operated by the U nited States Department of Defense or are
220310 affiliated with the United States Department of State.

224311 D. For the purpose of state salary in crements and retirement,
225312 no teacher shall be granted credit for more than five (5) yea rs of
226313 active duty in the military s ervice or out-of-state or out-of-
227314 country teaching experience as a certified teacher or its
228315 equivalent. Nothing in this section shall p rohibit boards of
229316 education from crediting more years of experience on district salary
230317 schedules than those allowed for s tate purposes.

232318 E. The State Board of Education shall recognize, for purposes
233319 of certification and salary increments, all the years of experience
234320 of a:

236321 1. Certified teacher who teaches in the educational program of
237322 the Department of Corrections, beginning with fiscal year 1981;

239323 2. Vocational rehabili tation counselor under the Department of
240324 Human Services if the counselor was employed as a certified teacher
241325 by the State Department of Education when the Division of Vocatio nal
242326 Rehabilitation was transferred from the State Board of Career and
243327 Technology Education or the State Board of Education to the Oklahoma
244328 Public Welfare Commission on Ju ly 1, 1968;

246356 3. Vocational rehabilitation counselor which were completed
247357 while employed by the Department of Human Servic es if such counselor
248358 was certified as a teacher or was eligible for certification as a
249359 teacher in Oklahoma;

251360 4. Certified teacher which were completed while employed by the
252361 Child Study Center located at University Hospita l, if the teacher
253362 was certified as a teacher in Oklahoma; and

255363 5. Certified school psychologist or psychometrist which were
256364 completed while employed as a doctoral intern, psychological
257365 assistant, or psychologist with any agency of the State of Oklahoma
258366 if the experience primarily involved w ork with persons of school - or
259367 preschool-age and if the person was, at the time the experience was
260368 acquired, certified as, or eligible for certification as, a school
261369 psychologist or psychometrist.

263370 F. The provisions of th is section shall not apply to teach ers
264371 who have entered into postretirement employ ment with a public school
265372 in Oklahoma and are still receiving a monthly retirement benef it.

269373 G. If a person employed as certified personnel, as defined in
270374 Section 26-103 of Title 70 of the Oklahoma Statutes, b y a school
271375 district during the 2022 -2023 school year was receiving a salary
272376 above the step level indicated by the State Minimum Salary Schedule
273377 for the 2022-2023 school year, the person shall receive a salary
274378 increase amount equal to the amount indicated i n subsection A for
275379 the step level indicated for the person, provided they remain

279409 H. If a school district does not receive Foundation or S alary
280410 Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
281411 Oklahoma Statutes, funds shall be allocated by the State Board of
282412 Education to implement the salary inc reases indicated in subsection
283413 A of this section.

285414 I. Persons employed as classroom instructional employees of
286415 technology center school districts supervised by the State Board of
287416 Career and Technology Education shall receive a salary increase
288417 amount equal to the amount indicated in subsection A of this section
289418 for the step level indicated for the person, provided they remain
290419 employed by the same technology center school district, unless the
291420 hours or the duties of the classroom instructional employees are
292421 reduced proportionately.

294422 J. Persons employed as correctional teachers or vocational
295423 instructors by the Department of Corrections pursuant to Section
296424 510.6a of Title 57 of the Oklahoma Statutes or persons employed as
297425 teachers by the Office of Juvenile Affairs shall receive a salary
298426 increase amount equal to the amount indicated in subsection A of
299427 this section for the step level indicated for the person, provided
300428 they remain employed by the same Department of Corrections or Office
301429 of Juvenile Affairs facility, unless the hours or the duties of the

314465 SECTION 2. REPEALER 70 O.S. 2021, Section 18-114.14, is
315466 hereby repealed.

317467 SECTION 3. This act shall become effective July 1, 2023.

319468 SECTION 4. It being immediately necessary for the preservation
320469 of the public peace, health, or safety, an emergency is hereby
321470 declared to exist, by rea son whereof this act shall take effect and
322471 be in full force from and after its passage and approval.
