184	222		B. 1. When determining the Minimum Salary Schedule, “fringe
185	223		benefits” shall mean all or part of retirement b enefits, excluding

191	256		Technology Education pursuant to Section 26-104 of Title 70 of the
192	257		Oklahoma Statutes.

194	258		2. If a school district intends to pr ovide retirement benefits
195	259		to a teacher such tha t the teacher’s salary would be less than the
196	260		amounts set forth in the minimum salary sc hedule specified in
197	261		subsection A of this section, the district shall be required to
198	262		provide written notification to the t eacher prior to his or her
199	263		employment or, if al ready employed by the district, no later than
200	264		thirty (30) days prior to the date the dis trict elects to provide
201	265		retirement benefits such that the teacher’s salary would be le ss
202	266		than the minimum salary schedule .

204	267		C. Any of the degrees referred to in this se ction shall be from
205	268		a college recognized by the State Board of Education. The Board
206	269		shall accept teaching experience from out-of-state school districts
207	270		that are accredited b y the State Board of Education or a ppropriate
208	271		state accrediting agency for the dis tricts. The Board shall accept
209	272		teaching experience from out-of-country schools that are accredited
210	273		or otherwise endorsed by the appropriate national or regional
211	274		accrediting or endorsement authority. Out -of-country certification
212	275		documentation in a languag e other than English shall be analyzed by
213	276		an educational credential evaluation service i n accordance with
214	277		industry standards and guidelines and approved by the State

215	305		Department of Education. The person seekin g to have credit granted
216	306		for out-of-country teaching experience shall be responsible for all
217	307		costs of the analysis by a credential eval uation service. The Board
218	308		shall accept teaching experience from primary and secondary schools
219	309		that are operated by the U nited States Department of Defense or are
220	310		affiliated with the United States Department of State.

224	311		D. For the purpose of state salary in crements and retirement,
225	312		no teacher shall be granted credit for more than five (5) yea rs of
226	313		active duty in the military s ervice or out-of-state or out-of-
227	314		country teaching experience as a certified teacher or its
228	315		equivalent. Nothing in this section shall p rohibit boards of
229	316		education from crediting more years of experience on district salary
230	317		schedules than those allowed for s tate purposes.

232	318		E. The State Board of Education shall recognize, for purposes
233	319		of certification and salary increments, all the years of experience
234	320		of a:
235		-
236	321		1. Certified teacher who teaches in the educational program of
237	322		the Department of Corrections, beginning with fiscal year 1981;
238		-
239	323		2. Vocational rehabili tation counselor under the Department of
240	324		Human Services if the counselor was employed as a certified teacher
241	325		by the State Department of Education when the Division of Vocatio nal
242	326		Rehabilitation was transferred from the State Board of Career and
243	327		Technology Education or the State Board of Education to the Oklahoma
244	328		Public Welfare Commission on Ju ly 1, 1968;

246	356		3. Vocational rehabilitation counselor which were completed
247	357		while employed by the Department of Human Servic es if such counselor
248	358		was certified as a teacher or was eligible for certification as a
249	359		teacher in Oklahoma;

251	360		4. Certified teacher which were completed while employed by the
252	361		Child Study Center located at University Hospita l, if the teacher
253	362		was certified as a teacher in Oklahoma; and

255	363		5. Certified school psychologist or psychometrist which were
256	364		completed while employed as a doctoral intern, psychological
257	365		assistant, or psychologist with any agency of the State of Oklahoma
258	366		if the experience primarily involved w ork with persons of school - or
259	367		preschool-age and if the person was, at the time the experience was
260	368		acquired, certified as, or eligible for certification as, a school
261	369		psychologist or psychometrist.

263	370		F. The provisions of th is section shall not apply to teach ers
264	371		who have entered into postretirement employ ment with a public school
265	372		in Oklahoma and are still receiving a monthly retirement benef it.

269	373		G. If a person employed as certified personnel, as defined in
270	374		Section 26-103 of Title 70 of the Oklahoma Statutes, b y a school
271	375		district during the 2022 -2023 school year was receiving a salary
272	376		above the step level indicated by the State Minimum Salary Schedule
273	377		for the 2022-2023 school year, the person shall receive a salary
274	378		increase amount equal to the amount indicated i n subsection A for
275	379		the step level indicated for the person, provided they remain

279	409		H. If a school district does not receive Foundation or S alary
280	410		Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
281	411		Oklahoma Statutes, funds shall be allocated by the State Board of
282	412		Education to implement the salary inc reases indicated in subsection
283	413		A of this section.

285	414		I. Persons employed as classroom instructional employees of
286	415		technology center school districts supervised by the State Board of
287	416		Career and Technology Education shall receive a salary increase
288	417		amount equal to the amount indicated in subsection A of this section
289	418		for the step level indicated for the person, provided they remain
290	419		employed by the same technology center school district, unless the
291	420		hours or the duties of the classroom instructional employees are
292	421		reduced proportionately.

294	422		J. Persons employed as correctional teachers or vocational
295	423		instructors by the Department of Corrections pursuant to Section
296	424		510.6a of Title 57 of the Oklahoma Statutes or persons employed as
297	425		teachers by the Office of Juvenile Affairs shall receive a salary
298	426		increase amount equal to the amount indicated in subsection A of
299	427		this section for the step level indicated for the person, provided
300	428		they remain employed by the same Department of Corrections or Office
301	429		of Juvenile Affairs facility, unless the hours or the duties of the

314	465		SECTION 2. REPEALER 70 O.S. 2021, Section 18-114.14, is
315	466		hereby repealed.

317	467		SECTION 3. This act shall become effective July 1, 2023.

319	468		SECTION 4. It being immediately necessary for the preservation
320	469		of the public peace, health, or safety, an emergency is hereby
321	470		declared to exist, by rea son whereof this act shall take effect and
322	471		be in full force from and after its passage and approval.
