6154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6255 SECTION 1. AMENDATORY 28 O.S. 2021, Section 153, as
6356 amended by Section 2, Chapter 237, O.S.L. 2022 (28 O.S. Supp. 2022,
6457 Section 153), is amended to read as follows:
6558 Section 153. A. The clerks of the courts shall collect as
6659 costs in every criminal c ase for each offense of which the defendant
6760 is convicted, irrespect ive of whether or not the sentence is
6861 deferred, the following flat char ges and no more, except for
62+standing and parking violations and for charges otherwise provided

204194 B. In addition to the amount collected pursuant to paragraphs 2

206196 ($6.00) shall be assessed a nd credited to the Law Library Fund

208198 Statutes.
209199 C. In addition to the amount c ollected pursuant to su bsection A
210200 of this section, the sum of Twenty Dollars ($20.00) shall be
211201 assessed and collected in every traffic case for each offense other
212202 than for driving under the influence of alcohol or other
213203 intoxicating substance; the sum of T hirty Dollars ($30.00) shall be
214204 assessed and collected in every misdemeanor case for each of fense;
215205 the sum of Thirty Dollars ($30.00) shall be assessed and collected
216206 in every misdemeanor case for each offense for driving under the
217207 influence of alcohol or o ther intoxicating subst ance; the sum of
218208 Fifty Dollars ($50.00) shall be assessed and collect ed in every
219209 felony case for each offense; and the sum of Fifty Dollars ($50.00)
220210 shall be assessed and collected in every felony case for each
211+offense for driving un der the influence of al cohol or other
212+intoxicating substance.

250239 D. In addition to the amounts collected pursuant to sub sections
251240 A and B of this section, the sum of Twenty-five Dollars ($25.00)
252241 shall be assessed and credited to the Okl ahoma Court Information
253242 System Revolving Fund created pursuant to Section 1315 of Title 20
254243 of the Oklahoma Statutes .
255244 E. In addition to the a mount collected pursuant to paragraphs 1
256245 through 6 of subsecti on A of this section, the sum of Ten Dollars
257246 ($10.00) shall be assessed and credited to the Sheriff ’s Service Fee
258247 Account in the county in which the conviction occurred for the
259248 purpose of enhancing existing or providing additional courthouse
260249 security.
261250 F. In addition to the amounts collected pursuant to para graphs
262251 1 through 6 of subsection A of this sec tion, the sum of Three
263252 Dollars ($3.00) shall be assessed and credited to the Office of the
264253 Attorney General Victim Services Unit.
265254 G. In addition to the amou nts collected pursuant to paragraphs
266255 1 through 6 of subsection A of this sec tion, the sum of Three
267256 Dollars ($3.00) shall be assessed and credited to the Child Abuse
268257 Multidisciplinary Account . This fee shall not be used for purposes
269258 of hiring or employing any law enforcement officers.
270259 H. In addition to the amount collected pursua nt to paragraphs 5
271260 and 6 of subsection A of this section, the sum of Fifteen Dollars
261+($15.00) shall be assessed in eve ry misdemeanor or felony case for
262+each offense of driving unde r the influence of alcohol or other

299-($15.00) shall be assessed in eve ry misdemeanor or felony case for
300-each offense of driving unde r the influence of alcohol or other
301289 intoxicating substance and credited to t he Oklahoma Impaired Dr iver
302290 Database Revolving Fund created pursuant to Section 11-902d of Title
303291 47 of the Oklahoma St atutes.
304292 I. Prior to conviction, parties in criminal cases shall not be
305293 required to pay, advance, or post securit y for the issuance or
306294 service of process to obtain compu lsory attendance of witnesses.
307295 J. The amounts to be assessed as court costs upon filing of a
308296 case shall be those amounts above-stated in paragraph 3 or 4 of
309297 subsection A and subsection s B, C, D and E of this section.
310298 K. The fees collected pursuant to this section shall be
311299 deposited into the court fund, except the following :
312300 1. A court clerk issuing a misdemeanor warrant is entitled to
313301 ten percent (10%) of the sheriff’s service fee, provided for in
314302 paragraph 9 of subsection A of this sec tion, collected on a warrant
315303 referred to the contractor for the misdemeanor warrant noti fication
316304 program governed by Sections 514.4 and 514.5 of Title 19 of the
317305 Oklahoma Statutes. This ten-percent sum shall be deposited into the
318306 issuing Court Clerk’s Revolving Fund, created pursuant to Section
319307 220 of Title 19 of the Oklahoma Statutes, of the court clerk issuing
320308 the warrant with the balance of the sheriff’s service fee to be
321309 deposited into the Sheriff ’s Service Fee Account, created pursuant
322310 to the provisions of Section 514.1 of Title 19 of the Oklahoma
311+Statutes, of the sheriff in the county in which service is made or
312+attempted. Otherwise, the sheriff’s service fee, when co llected,

350-Statutes, of the sheriff in the county in which service is made or
351-attempted. Otherwise, the sheriff’s service fee, when co llected,
352339 shall be deposited in i ts entirety into the Sheriff ’s Service Fee
353340 Account of the sheriff in the county in which service is made or
354341 attempted;
355342 2. The sheriff’s fee provided for in Section 153.2 of this
356343 title;
357344 3. The witness fees paid by the dis trict attorney pursuant to
358345 the provisions of Section 82 of this title which, if collect ed by
359346 the court clerk, shall be transferred to the district attorney’s
360347 office in the county where witness attendance was required. Fees
361348 transferred pursuant to this par agraph shall be deposited in the
362349 district attorney’s maintenance and operating expense account;
363350 4. The fees provided for in subsection C of this section shall
364351 be forwarded to the District Attorneys Council Revolving Fund to
365352 defray the costs of prosecutio n; and
366353 5. The following amounts of the fees provided for in paragraphs
367354 2, 3, 5 and 6 of subsection A of this section, when collected, shall
368355 be deposited in the Trauma Care Ass istance Revolving Fund, created
369356 pursuant to the provisions of Section 1 -2530.9 of Title 63 of the
370357 Oklahoma Statutes:
371358 a. Ten Dollars ($10.00) of the Ninety -eight-Dollar fee
372359 provided for in paragraph 2 of subsection A of this

401387 b. Ten Dollars ($10.00) of the Ninety-three-Dollar fee
402388 provided for in paragraph 3 of subsection A o f this

404390 c. One Hundred Dollars ($100.00) of the Four -Hundred-
405391 Thirty-three-Dollar fee provided for in paragraph 5 of
406392 subsection A of this section, and
407393 d. One Hundred Dollars ($100.00) of the Four-Hundred-
408394 Thirty-three-Dollar fee provided for in par agraph 6 of
409395 subsection A of this section .
410396 L. As used in this section, “convicted” means any final
411397 adjudication of guilt, whether pursuant to a plea of guilty or nolo
412398 contendere or otherw ise, and any deferred judgment or suspended
413399 sentence.
414400 M. A court clerk may accept in payment for any fee, fine,
415401 forfeiture payment, cost, penalty assessm ent or other charge or
416402 collection to be assessed or c ollected by a court clerk pursuant to
417403 this section a nationally recognized credit card or debit card or
418404 other electronic payment method as provided in paragraph 1 of
419405 subsection B of Section 151 of this t itle.
420406 N. Upon receipt of payment of fines and cos ts for offenses
421407 charged prior to July 1, 1992, the court clerk shall apportion and
422408 pay Thirteen Dollars ($13.00) per conviction to the court fund.
423409 SECTION 2. This act shall become effective July 1, 2023.
