61	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
62	55		SECTION 1. AMENDATORY 28 O.S. 2021, Section 153, as
63	56		amended by Section 2, Chapter 237, O.S.L. 2022 (28 O.S. Supp. 2022,
64	57		Section 153), is amended to read as follows:
65	58		Section 153. A. The clerks of the courts shall collect as
66	59		costs in every criminal c ase for each offense of which the defendant
67	60		is convicted, irrespect ive of whether or not the sentence is
68	61		deferred, the following flat char ges and no more, except for
	62	+	standing and parking violations and for charges otherwise provided
	63	+	for by law, which fee s hall cover docketing of the case, filing of

204	194		B. In addition to the amount collected pursuant to paragraphs 2

206	196		($6.00) shall be assessed a nd credited to the Law Library Fund
207	197		pursuant to Section 1201 e t seq. of Title 20 of the Oklahoma
208	198		Statutes.
209	199		C. In addition to the amount c ollected pursuant to su bsection A
210	200		of this section, the sum of Twenty Dollars ($20.00) shall be
211	201		assessed and collected in every traffic case for each offense other
212	202		than for driving under the influence of alcohol or other
213	203		intoxicating substance; the sum of T hirty Dollars ($30.00) shall be
214	204		assessed and collected in every misdemeanor case for each of fense;
215	205		the sum of Thirty Dollars ($30.00) shall be assessed and collected
216	206		in every misdemeanor case for each offense for driving under the
217	207		influence of alcohol or o ther intoxicating subst ance; the sum of
218	208		Fifty Dollars ($50.00) shall be assessed and collect ed in every
219	209		felony case for each offense; and the sum of Fifty Dollars ($50.00)
220	210		shall be assessed and collected in every felony case for each
	211	+	offense for driving un der the influence of al cohol or other
	212	+	intoxicating substance.

250	239		D. In addition to the amounts collected pursuant to sub sections
251	240		A and B of this section, the sum of Twenty-five Dollars ($25.00)
252	241		shall be assessed and credited to the Okl ahoma Court Information
253	242		System Revolving Fund created pursuant to Section 1315 of Title 20
254	243		of the Oklahoma Statutes .
255	244		E. In addition to the a mount collected pursuant to paragraphs 1
256	245		through 6 of subsecti on A of this section, the sum of Ten Dollars
257	246		($10.00) shall be assessed and credited to the Sheriff ’s Service Fee
258	247		Account in the county in which the conviction occurred for the
259	248		purpose of enhancing existing or providing additional courthouse
260	249		security.
261	250		F. In addition to the amounts collected pursuant to para graphs
262	251		1 through 6 of subsection A of this sec tion, the sum of Three
263	252		Dollars ($3.00) shall be assessed and credited to the Office of the
264	253		Attorney General Victim Services Unit.
265	254		G. In addition to the amou nts collected pursuant to paragraphs
266	255		1 through 6 of subsection A of this sec tion, the sum of Three
267	256		Dollars ($3.00) shall be assessed and credited to the Child Abuse
268	257		Multidisciplinary Account . This fee shall not be used for purposes
269	258		of hiring or employing any law enforcement officers.
270	259		H. In addition to the amount collected pursua nt to paragraphs 5
271	260		and 6 of subsection A of this section, the sum of Fifteen Dollars
	261	+	($15.00) shall be assessed in eve ry misdemeanor or felony case for
	262	+	each offense of driving unde r the influence of alcohol or other

299		-	($15.00) shall be assessed in eve ry misdemeanor or felony case for
300		-	each offense of driving unde r the influence of alcohol or other
301	289		intoxicating substance and credited to t he Oklahoma Impaired Dr iver
302	290		Database Revolving Fund created pursuant to Section 11-902d of Title
303	291		47 of the Oklahoma St atutes.
304	292		I. Prior to conviction, parties in criminal cases shall not be
305	293		required to pay, advance, or post securit y for the issuance or
306	294		service of process to obtain compu lsory attendance of witnesses.
307	295		J. The amounts to be assessed as court costs upon filing of a
308	296		case shall be those amounts above-stated in paragraph 3 or 4 of
309	297		subsection A and subsection s B, C, D and E of this section.
310	298		K. The fees collected pursuant to this section shall be
311	299		deposited into the court fund, except the following :
312	300		1. A court clerk issuing a misdemeanor warrant is entitled to
313	301		ten percent (10%) of the sheriff’s service fee, provided for in
314	302		paragraph 9 of subsection A of this sec tion, collected on a warrant
315	303		referred to the contractor for the misdemeanor warrant noti fication
316	304		program governed by Sections 514.4 and 514.5 of Title 19 of the
317	305		Oklahoma Statutes. This ten-percent sum shall be deposited into the
318	306		issuing Court Clerk’s Revolving Fund, created pursuant to Section
319	307		220 of Title 19 of the Oklahoma Statutes, of the court clerk issuing
320	308		the warrant with the balance of the sheriff’s service fee to be
321	309		deposited into the Sheriff ’s Service Fee Account, created pursuant
322	310		to the provisions of Section 514.1 of Title 19 of the Oklahoma
	311	+	Statutes, of the sheriff in the county in which service is made or
	312	+	attempted. Otherwise, the sheriff’s service fee, when co llected,

350		-	Statutes, of the sheriff in the county in which service is made or
351		-	attempted. Otherwise, the sheriff’s service fee, when co llected,
352	339		shall be deposited in i ts entirety into the Sheriff ’s Service Fee
353	340		Account of the sheriff in the county in which service is made or
354	341		attempted;
355	342		2. The sheriff’s fee provided for in Section 153.2 of this
356	343		title;
357	344		3. The witness fees paid by the dis trict attorney pursuant to
358	345		the provisions of Section 82 of this title which, if collect ed by
359	346		the court clerk, shall be transferred to the district attorney’s
360	347		office in the county where witness attendance was required. Fees
361	348		transferred pursuant to this par agraph shall be deposited in the
362	349		district attorney’s maintenance and operating expense account;
363	350		4. The fees provided for in subsection C of this section shall
364	351		be forwarded to the District Attorneys Council Revolving Fund to
365	352		defray the costs of prosecutio n; and
366	353		5. The following amounts of the fees provided for in paragraphs
367	354		2, 3, 5 and 6 of subsection A of this section, when collected, shall
368	355		be deposited in the Trauma Care Ass istance Revolving Fund, created
369	356		pursuant to the provisions of Section 1 -2530.9 of Title 63 of the
370	357		Oklahoma Statutes:
371	358		a. Ten Dollars ($10.00) of the Ninety -eight-Dollar fee
372	359		provided for in paragraph 2 of subsection A of this

401	387		b. Ten Dollars ($10.00) of the Ninety-three-Dollar fee
402	388		provided for in paragraph 3 of subsection A o f this
403	389		section,
404	390		c. One Hundred Dollars ($100.00) of the Four -Hundred-
405	391		Thirty-three-Dollar fee provided for in paragraph 5 of
406	392		subsection A of this section, and
407	393		d. One Hundred Dollars ($100.00) of the Four-Hundred-
408	394		Thirty-three-Dollar fee provided for in par agraph 6 of
409	395		subsection A of this section .
410	396		L. As used in this section, “convicted” means any final
411	397		adjudication of guilt, whether pursuant to a plea of guilty or nolo
412	398		contendere or otherw ise, and any deferred judgment or suspended
413	399		sentence.
414	400		M. A court clerk may accept in payment for any fee, fine,
415	401		forfeiture payment, cost, penalty assessm ent or other charge or
416	402		collection to be assessed or c ollected by a court clerk pursuant to
417	403		this section a nationally recognized credit card or debit card or
418	404		other electronic payment method as provided in paragraph 1 of
419	405		subsection B of Section 151 of this t itle.
420	406		N. Upon receipt of payment of fines and cos ts for offenses
421	407		charged prior to July 1, 1992, the court clerk shall apportion and
422	408		pay Thirteen Dollars ($13.00) per conviction to the court fund.
423	409		SECTION 2. This act shall become effective July 1, 2023.
