4242 certain contract requirements; prohibiting
4343 governmental entities from contracting with companies
4444 unless contracts contain certain written
4545 verification; stating specific s of written
4646 verification; provid ing an exception for specific
4747 governmental entities; requiring the Directo r of the
4848 Office of Management and Enterprise Services to
4949 provide oversight and advice to governmenta l

5656 BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law to be codified
5858 in the Oklahoma Statutes as Section 1289.31 of Title 21, unless
5959 there is created a duplication in numb ering, reads as follows:
6060 A. As used in this section:
6161 1. “Ammunition” means a loaded cartridge or shot shell, case,
6262 primer, projectile, wadding , or propellant powder;
6363 2. “Company” means a for-profit organization, associ ation,
6464 corporation, partnership, joint venture, limited partnership,
6565 limited liability partner ship, or limited liability company,

9292 including a wholly owned subsidiary, majority -owned subsidiary,
9393 parent company, or an affiliate of thos e entities or associati ons
9494 that exists to make a profit. The term does not include a sole
9595 proprietorship;
9696 3. “Discriminate against a firearm entity or firearm trade
9797 association” means, with respect to the entity or association, to:
9898 a. refuse to engage in the trade of any goods or se rvices
9999 with the entity or association based solely on its
100100 status as a firearm entity or firearm trade
101101 association which includes the lawful products and
102102 services provided by and lawful practices of firearm
103103 entities and firearm trade associations,
104104 b. refrain from continuing an existing b usiness
105105 relationship with the entity or association based
106106 solely on its status as a firearm entity or firearm
107107 trade association which includes the lawful pro ducts
108108 and services provided by and lawful practices of
109109 firearm entities and firearm trade associations, or
110110 c. terminate an existing business rel ationship with the
111111 entity or association based solely on its status as a
112112 firearm entity or firearm trade association which
113113 includes the lawful pro ducts and services provided by
114114 and lawful practices of firearm entities and firearm
115115 trade associations.

142142 The term does not include the policies of a vendor, merchant, retail
143143 seller, or platform that restric t or prohibit the listing or selling
144144 of ammunition, firearms, or firearm accessories. The term also does
145145 not include a company ’s refusal to engage in the trade of any good s
146146 or services, decision to refrain from continuing an existing
147147 business relationship, or decision to terminate an existing business
148148 relationship to comply with federal, state , or local laws, policies,
149149 or regulations or a directive by a regulatory agency, o r for any
150150 traditional business reason that is specific to the customer or
151151 potential customer and not based sol ely on the status of an entit y
152152 or association as a firearm entity or firearm trade association
153153 which includes the lawful pro ducts and services pro vided by and
154154 lawful practices of firearm entities and firearm trade associations;
155155 4. “Firearm” means a weapon that expels a pr ojectile by the
156156 action of explosive or expanding gas es;
157157 5. “Firearm accessory” means a device specifically designed or
158158 adapted to enable an individual to wear, carry, store, or moun t a
159159 firearm on the indivi dual or on a conveyance and an item used in
160160 conjunction with or mount ed on a firearm that is not essentia l to
161161 the basic function of the firearm. The term includes a detachable
162162 firearm magazine;
163163 6. “Firearm entity” means:

190190 a. a firearm, firearm accessor y or ammunition
191191 manufacturer, distributor, who lesaler, supplier, or
192192 retailer, and
193193 b. a gun range;
194194 7. “Firearm trade associatio n” means any person, corporation,
195195 unincorporated association, federation, business league, or business
196196 organization that:
197197 a. is not organized or operated for profit and for which
198198 none of its net earning inures to the benefit of any
199199 private shareholder or individual,
200200 b. has two or more firearm entities as memb ers, and
201201 c. is exempt from federal income ta xation under Section
202202 501(a), Internal Revenue Code of 1986, as an
203203 organization described by Section 501(c) of that code;
204204 8. “Governmental entity” means any branch, department, agency
205205 or instrumentality of state government, or any official o r other
206206 person acting under color of state law, or any polit ical subdivision
207207 of this state;
208208 9. “Sole-source provider” means a supplier who provides goods
209209 or services of a unique nature or goods or services that are solely
210210 available through the supplier and the supplier is the o nly
211211 practicable source to prov ide such goods or services; and
212212 10. “Contract” means a promise or set of promises cons tituting
213213 an agreement between the parties that gives each a legal duty to the

240240 other and also the right to seek a remedy for the breach of th ose
241241 duties, but does not include an agreement related to investment
242242 services.
243243 B. The provisions of this section shall apply only to a
244244 contract that:
245245 1. Is between a governmental entity and a company wit h at least
246246 ten (10) full-time employees; and
247247 2. Has a value of at least One Hundred Thous and Dollars
248248 ($100,000.00) that is paid wholly or partly from public funds of the
249249 governmental entity.
250250 C. Except as provided by su bsection D of this section, a
251251 governmental entity may not enter in a contract with a com pany for
252252 the purchase of goods or services unless the contract contains a
253253 written verification from the company that it:
254254 1. Does not have a practice, p olicy, guidance, or directive
255255 that discriminates against a firearm entity or firearm trade
256256 association; and
257257 2. Will not discriminate during the term of the contract
258258 against a firearm entity or firearm trade association.
259259 D. The provisions of subsection C of this section shall not
260260 apply to a governmental entity that:
261261 1. Contracts with a sole-source provider; or

288288 2. Does not receive a bid from a company that is able to
289289 provide the written ver ification required by subsection C of th is
290290 section.
291291 E. The Central Purchasing Division of the O ffice of Management
292292 and Enterprise Services shall have the authority and responsibility
293293 of reviewing state gove rnmental contracts to confirm that the
294294 requirements of subsection C of this section have been satisfied.
295295 SECTION 2. This act shall become effective No vember 1, 2023.
