100 | 171 | | 6. “Sell” means to transfer or exchange for value, to expose, |

101 | 172 | | display, or offer for sale or exchange, or to procure, store, keep |
---|
102 | 173 | | or have on hand or in one ’s possession or control for the purpose of |
---|

104 | 175 | | 7. “Vendor” means any person or entity who sel ls food out of a |

105 | 176 | | mobile vending unit. |

155 | 225 | | C. Any person who drives a food vending vehicle shall hold a |

156 | 226 | | current driver license to drive the fo od vending vehicle. |

157 | 227 | | D. The applicant shall complete the application form and abide |
---|
158 | 228 | | by any request for information required by this act made by th e |
---|

160 | 230 | | E. The Department or designee shall confirm completeness of the |
---|
161 | 231 | | application, collect the license fee, and conduct a health |
---|

196 | 265 | | G. Upon receipt of a complete, approved application, fees, and |

197 | 266 | | a passed initial health inspection, the Department shall issue a |
---|
198 | 267 | | mobile vendor license to the applicant. The license shall be valid |
---|
199 | 268 | | for one (1) year from the date of issuance. |
---|
200 | 269 | | H. Licenses are not transfe rable, and a license shall not |
---|
201 | 270 | | authorize activities of any person other than the person to whom it |
---|
202 | 271 | | is issued. |
---|
203 | 272 | | I. The Commissioner may promulgate rules to allow for a mobile |
---|
204 | 273 | | unit to keep an existing license when purchasing a different mo bile |
---|
205 | 274 | | unit for the purposes of the existing lic ense. The licensee shall |
---|
206 | 275 | | submit to a health inspection of the new vehicle prior to beginning |
---|
207 | 276 | | operations. |
---|
208 | 277 | | J. It is the responsibility of the licensee to submit a renewal |
---|
209 | 278 | | application annually, at least fourteen (14) days prior to the |
---|
210 | 279 | | expiration date of the license. While an application for renewal is |
---|
211 | 280 | | pending with the Department, a licensee may continue mobile food |
---|
212 | 281 | | vending operations until the expiration date of the license. |

---|
244 | 312 | | and regulations governing operations in the jurisdiction where the |
---|
245 | 313 | | vendor is operating including but not limited to all fire codes, |
---|
246 | 314 | | zoning codes, occupational tax codes , and any other applicable state |
---|
247 | 315 | | and local authority codes and laws not in conflict w ith the |
---|
248 | 316 | | provisions of this act. |
---|
249 | 317 | | B. A mobile food vendor may opera te in the following locations: |
---|
250 | 318 | | 1. On public property, as long as the vending vehicle is not |
---|
251 | 319 | | parked within twenty (20) feet of an intersection. A mobile vendor |
---|
252 | 320 | | may operate from legal parking spaces on the public right -of-way |
---|
253 | 321 | | including metered spaces upon payment of appropriate fees. When |
---|
254 | 322 | | operating on public property, a mobile vendor is subject to the same |
---|
255 | 323 | | parking rules, restrictions, and obligations that a commercial |
---|
256 | 324 | | vehicle would be subject to if not used by a mobile food vendor; and |
---|
257 | 325 | | 2. On private property located in an industrial, commercial, or |
---|
258 | 326 | | institutional zoning district if the vendor has permission of the |
---|
259 | 327 | | property owner or designee. |
---|
260 | 328 | | C. A mobile food vendor shall not operate in any manner which |
---|
261 | 329 | | will interfere with or obstruct the free passage of pedestrians or |
---|
262 | 330 | | vehicles along any street, sidewalk, or parkway. |
---|
263 | 331 | | D. When operating, a mobile foo d vendor shall: |

297 | 364 | | 4. Provide a waste receptacle for customers which is cl early |

298 | 365 | | visible and request its use by customers; |
---|
299 | 366 | | 5. Remove and dispose of all refus e within twenty-five (25) |
---|
300 | 367 | | feet of the vendor’s operating area at the conclusion of operation; |
---|
301 | 368 | | 6. Submit to any required health inspections; |
---|
302 | 369 | | 7. Display the mobile food vendor license in a conspicuous |
---|
303 | 370 | | location for public view ; and |
---|
304 | 371 | | 8. Display the food vending vehicle ’s most recent inspection |
---|
305 | 372 | | report inside the food vending vehicle and provide such inspection |
---|
306 | 373 | | report to the Department or designee upo n request. |
---|
307 | 374 | | E. The State Commissioner of Health may promulgate rules to |
---|
308 | 375 | | enforce the provisions of this act. Rules adopted shall not: |
---|
309 | 376 | | 1. Require a mobile food vendor that does not prepare food to |
---|
310 | 377 | | have a handwashing sink in the food vending vehicle; |
---|
311 | 378 | | 2. Require a mobile food vendor to associat e with a commissary |
---|
312 | 379 | | if the vendor carries all the equipment necessary to comply with |
---|
313 | 380 | | health and safety standards and all applicable regulations; |
---|
314 | 381 | | 3. Limit the number of m obile food vendor licenses issued; |

353 | 419 | | routine or complaint health inspections conducted by the Department |

354 | 420 | | or designee unless the Department is investigating a reported |

355 | 421 | | foodborne illness. |

398 | 463 | | 1. A Mobile Food Type I Vendor may only serve unopened, |
---|
399 | 464 | | prepackaged food items and bottled or canned beverages. Type I |
---|
400 | 465 | | vendors shall be inspected p rior to initial licensure, upon receipt |
---|
401 | 466 | | of a complaint, and as necessary for follow-up inspections due to |
---|
402 | 467 | | cited violations. |
---|
403 | 468 | | 2. A Mobile Food Type II Vendor may serve any food item or |
---|
404 | 469 | | beverage a Type I Vendor may serve , hot or cold items, or unpackaged |
---|
405 | 470 | | food, as long as the vendor is not cooking with raw meat. Type II |
---|
406 | 471 | | Vendors may assemble food in the mobile unit. Typ e II Vendors shall |
---|
407 | 472 | | be inspected prior to initial licensure, once per year for a routine |
---|
408 | 473 | | inspection, upon receipt of a complaint, and as necessary for |
---|
409 | 474 | | follow-up inspections due to cited violations. |
---|
410 | 475 | | 3. A Mobile Food Type III Vendor may serve any food item or |
---|
411 | 476 | | beverage in accordance with applicable laws and regulations. Type |
---|
412 | 477 | | III Vendors shall be inspected prior to initial licensure, twice per |
---|
413 | 478 | | year for routine inspections, upon receipt of a complaint, and as |
---|
414 | 479 | | necessary for follow-up inspections due to cited violations. |
---|
415 | 480 | | D. The State Commissioner of Health shall specify |
---|

656 | 716 | | vendors who meet the exceptions provided in subsection A of this |

657 | 717 | | section shall not be required to obtain a three -day license or a |

659 | 719 | | 4. The Commissioner shall provide by rule a multiseasonal |

660 | 720 | | license for snow cone stands that sell hot beverages in addition to |

661 | 721 | | snow cones. A snow cone stand that does n ot sell hot beverages |

662 | 722 | | shall be considered a seasonal food establishment. |
