51123 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52124 SECTION 1. NEW LAW A new section of law to be codified
53125 in the Oklahoma Statutes as Section 1 -1151 of Title 63, unless there
54126 is created a duplicati on in numbering, reads as follows:
55127 This act shall be known an d may be cited as the “Mobile Food
56128 Vendor Act”.
57129 SECTION 2. NEW LAW A new section of law to be codified
58130 in the Oklahoma Statutes as Section 1 -1152 of Title 63, unless there
59131 is created a duplication in numb ering, reads as follows:
60132 As used in this act:
61133 1. “Customer” means any person with whom a mobile food vendor
62134 conducts his or her mobile vending business, or any person who sto ps
63135 to contemplate conducting such business with a mobile food vendor;

91162 2. “Department” means the State Department of Health;
92163 3. “Food vending vehicle ” means any mobile unit used to sell
93164 food and beverages by a mobile food vendor;
94165 4. “Mobile food vendor” means any person who dispenses food or
95166 beverages from a food vending vehicle for consumption;
96167 5. “Prepackaged food” means any commercially labeled and
97168 processed food prepackaged to prevent direc t human contact with the
98169 food product upon distribu tion from the manufacturer, a food
99170 facility, or other approved source;
100171 6. “Sell” means to transfer or exchange for value, to expose,
101172 display, or offer for sale or exchange, or to procure, store, keep
102173 or have on hand or in one ’s possession or control for the purpose of
103174 selling; and
104175 7. “Vendor” means any person or entity who sel ls food out of a
105176 mobile vending unit.
106177 SECTION 3. NEW LAW A new section of law to be codified
107178 in the Oklahoma Statutes as Section 1 -1153 of Title 63, unless there
108179 is created a duplication in numbering, reads as follows:
109180 All mobile food vendors must obtain a mobil e food vending
110181 license from the State Department of Health. A separate mobile food
111182 vendor license shall be required for every food vending vehicle used
112183 by a mobile food vendor.

143213 A. The State Department of Health shal l make a mobile food
144214 vendor license application available to applicants on the
145215 Department’s website.
146216 B. The Department shall require the following information in a
147217 mobile food vendor application:
148218 1. The name, permanent address, telephone number, and emai l
149219 address of the applicant;
150220 2. Information pertaining to the nature of the food or
151221 beverages to be offere d by the applicant; and
152222 3. A list of the vehicle descriptions and license plate numbers
153223 for all vehicles directly related to the mobile food vending
154224 business.
155225 C. Any person who drives a food vending vehicle shall hold a
156226 current driver license to drive the fo od vending vehicle.
157227 D. The applicant shall complete the application form and abide
158228 by any request for information required by this act made by th e
159229 Department.
160230 E. The Department or designee shall confirm completeness of the
161231 application, collect the license fee, and conduct a health
162232 inspection prior to issuing a mobile food vend or license.

190259 F. The State Commissioner of Health may establish a reasona ble
191260 schedule of fees not to exceed:
192261 1. Two Hundred Dollars ($200.00) for an initial mobile food
193262 vendor license; and
194263 2. One Hundred Seventy-five Dollars ($175.00) for annual
195264 renewal of a mobile food vendor license.
196265 G. Upon receipt of a complete, approved application, fees, and
197266 a passed initial health inspection, the Department shall issue a
198267 mobile vendor license to the applicant. The license shall be valid
199268 for one (1) year from the date of issuance.
200269 H. Licenses are not transfe rable, and a license shall not
201270 authorize activities of any person other than the person to whom it
202271 is issued.
203272 I. The Commissioner may promulgate rules to allow for a mobile
204273 unit to keep an existing license when purchasing a different mo bile
205274 unit for the purposes of the existing lic ense. The licensee shall
206275 submit to a health inspection of the new vehicle prior to beginning
207276 operations.
208277 J. It is the responsibility of the licensee to submit a renewal
209278 application annually, at least fourteen (14) days prior to the
210279 expiration date of the license. While an application for renewal is
211280 pending with the Department, a licensee may continue mobile food
212281 vending operations until the expiration date of the license.

243311 A. Mobile food vendors shall follow all state and local l aws
244312 and regulations governing operations in the jurisdiction where the
245313 vendor is operating including but not limited to all fire codes,
246314 zoning codes, occupational tax codes , and any other applicable state
247315 and local authority codes and laws not in conflict w ith the
248316 provisions of this act.
249317 B. A mobile food vendor may opera te in the following locations:
250318 1. On public property, as long as the vending vehicle is not
251319 parked within twenty (20) feet of an intersection. A mobile vendor
252320 may operate from legal parking spaces on the public right -of-way
253321 including metered spaces upon payment of appropriate fees. When
254322 operating on public property, a mobile vendor is subject to the same
255323 parking rules, restrictions, and obligations that a commercial
256324 vehicle would be subject to if not used by a mobile food vendor; and
257325 2. On private property located in an industrial, commercial, or
258326 institutional zoning district if the vendor has permission of the
259327 property owner or designee.
260328 C. A mobile food vendor shall not operate in any manner which
261329 will interfere with or obstruct the free passage of pedestrians or
262330 vehicles along any street, sidewalk, or parkway.
263331 D. When operating, a mobile foo d vendor shall:

291358 1. Maintain a food vending vehicle in good operating order and
292359 visual appearance including the removal of any graffiti that is not
293360 part of the overall desig n or art featured on the vehicle;
294361 2. Park so that its service window faces the sid ewalk or away
295362 from the street if the vehicle is par ked along a street;
296363 3. Serve customers through a service window;
297364 4. Provide a waste receptacle for customers which is cl early
298365 visible and request its use by customers;
299366 5. Remove and dispose of all refus e within twenty-five (25)
300367 feet of the vendor’s operating area at the conclusion of operation;
301368 6. Submit to any required health inspections;
302369 7. Display the mobile food vendor license in a conspicuous
303370 location for public view ; and
304371 8. Display the food vending vehicle ’s most recent inspection
305372 report inside the food vending vehicle and provide such inspection
306373 report to the Department or designee upo n request.
307374 E. The State Commissioner of Health may promulgate rules to
308375 enforce the provisions of this act. Rules adopted shall not:
309376 1. Require a mobile food vendor that does not prepare food to
310377 have a handwashing sink in the food vending vehicle;
311378 2. Require a mobile food vendor to associat e with a commissary
312379 if the vendor carries all the equipment necessary to comply with
313380 health and safety standards and all applicable regulations;
314381 3. Limit the number of m obile food vendor licenses issued;

342408 4. Require a mobile food vendor to obtain any addi tional
343409 permits from a local authority, unless the mobile food vendor seeks
344410 to operate in a local, public park;
345411 5. Require a mobile food vendor to install a Global Positioning
346412 System (GPS) tracking device on the food vending vehicle;
347413 6. Require a mobile f ood vendor to stay in constant motion
348414 except for when serving cu stomers;
349415 7. Require a mobile food vendor to maintain insurance that
350416 names a local authority as an additi onal insured unless the vendor
351417 is attending an event sponsored by the local authority; or
352418 8. Require a mobile food vendor to submit to inspections beyond
353419 routine or complaint health inspections conducted by the Department
354420 or designee unless the Department is investigating a reported
355421 foodborne illness.
356422 SECTION 6. NEW LAW A new section of law to be codified
357423 in the Oklahoma Statutes as Sect ion 1-1156 of Title 63, unless there
358424 is created a duplication in numbering, reads as follows:
359425 A. Mobile food vendors shall adhere to all laws and regulations
360426 of the Oklahoma Administr ative Code pertaining to the preparation
361427 and handling of food.
362428 B. Any person preparing food or beve rages in a food vending
363429 vehicle shall hold a current food handler certification recognized
364430 by this state. At all times at least one person working in a foo d
365431 vending vehicle must hold a current food handler certification

393458 recognized by this state. Evidence of such certification shall be
394459 presented at initial licensure and renewal .
395460 C. Upon receipt of a complete lic ense application, the State
396461 Department of Health shall classify a mobile food vendor into one of
397462 the three classifications described in this subsection.
398463 1. A Mobile Food Type I Vendor may only serve unopened,
399464 prepackaged food items and bottled or canned beverages. Type I
400465 vendors shall be inspected p rior to initial licensure, upon receipt
401466 of a complaint, and as necessary for follow-up inspections due to
402467 cited violations.
403468 2. A Mobile Food Type II Vendor may serve any food item or
404469 beverage a Type I Vendor may serve , hot or cold items, or unpackaged
405470 food, as long as the vendor is not cooking with raw meat. Type II
406471 Vendors may assemble food in the mobile unit. Typ e II Vendors shall
407472 be inspected prior to initial licensure, once per year for a routine
408473 inspection, upon receipt of a complaint, and as necessary for
409474 follow-up inspections due to cited violations.
410475 3. A Mobile Food Type III Vendor may serve any food item or
411476 beverage in accordance with applicable laws and regulations. Type
412477 III Vendors shall be inspected prior to initial licensure, twice per
413478 year for routine inspections, upon receipt of a complaint, and as
414479 necessary for follow-up inspections due to cited violations.
415480 D. The State Commissioner of Health shall specify
416481 classification qualifications in rule. If a mobile food vendor

444508 elects to expand the scope of the vendor’s service in a manner which
445509 would affect the classification type of the food vending vehicle ,
446510 the mobile vendor shall notify the Department. The Department shall
447511 update the classification status of the food vending vehicle if
448512 applicable and notify the mobile food vendor of the
449513 reclassification. Failure to report a change in service which would
450514 affect the classification type of a food vending vehicle may result
451515 in the suspension or revocation of the mobile food vendor license.
452516 E. Health inspections shall be conducted by the Department or
453517 designee. Upon completion of an inspection, the Department or
454518 designee shall issue a copy of the inspection report , which the
455519 mobile food vendor shal l post inside the food vending vehicle.
456520 F. Licensed mobile food vendors shall present to the county
457521 health department assigned to them for inspections. The State
458522 Department of Health shall assign inspections to the county health
459523 department closest to the licensee ’s home unless otherwise agre ed
460524 upon by the Department and licensee. Routine inspection frequency
461525 shall be based on the mobile food vendor ’s classification under
462526 subsection C of this section .
463527 SECTION 7. NEW LAW A new section of law to be codified

493556 A. The State Department of Health may investigate a food
494557 vending vehicle upon reasonable suspicio n the mobile food vendor has
495558 violated the law or upon receipt of a health or safety complaint.
496559 B. If requested by the Department, a mobile vendor under
497560 investigation or receiving a follow-up inspection by the Department
498561 for noncompliance during previous inspections shall present the food
499562 vending vehicle within five (5) calendar days to the county health
500563 department location specified by the Department.
501564 C. Failure to cooperate with an investigation by the Department
502565 may result in suspension or revocation of a license.
503566 D. Nothing in this act shall be construed t o impede the
504567 Department or a local authority in any investigatio n of a reported
505568 foodborne illness.
506569 SECTION 8. AMENDATORY 63 O.S. 2021, Section 1 -1118, is
507570 amended to read as follows:
508571 Section 1-1118. A. It shall be unlawful for an y person to
509572 operate or maintain any establishment, stationary or otherwise,
510573 where food or drink is offered for sale, or sold, to the public,
511574 unless the person is the holder of a food establishment license
512575 issued for such purpose by the State Commissioner o f Health or
513576 designee. A food establishment license shall not be required for:
514577 1. A produce stand that offers only whole, unc ut and
515578 unprocessed fresh fruits, melons, vegetables and legumes and/or
516579 whole uncracked and unprocessed n uts;

544606 2. A manufacturer, wholesaler or broker of food licensed
545607 pursuant to Section 1 -1119 of this title;
546608 3. A kitchen in a private home if only food th at does not
547609 require time and temp erature control for safety is prepared for sale
548610 or service at a funct ion such as a nonprofit civi c, charitable or
549611 religious organization’s bake sale;
550612 4. An area where food that is prepared as specified in
551613 paragraph 3 of this subsection is sold or offered for human
552614 consumption;
553615 5. A private home that receives catered or home-delivered food;
554616 6. A hotel licensed pursuant to Section 1-1201 of this title
555617 which provides limited food service in compliance with rules
556618 promulgated by the State Commissioner of Health;
557619 7. A kitchen in a private home or in a bed and breakfast tha t
558620 prepares and offers food to gu ests, if the home is owner-occupied,
559621 the number of available guest bedrooms does not exceed three, and
560622 breakfast is the only m eal offered;
561623 8. A nonprofit civic, charitable or religious organization
562624 using unpaid individuals to prepare or serve food on its behalf, for
563625 occasional fund-raising events sponsored and conducted by the
564626 organization. For the purposes of this paragraph, a n “occasional
565627 fund-raising event” shall be defined as an event that occurs four
566628 times a year or less;

594655 9. Day care centers or fami ly day care centers, and all other
595656 child care facilities as defined and licensed pursuant to the
596657 provisions of the Oklahoma Ch ild Care Facilities Licensing Act ;
597658 10. Nursing facilities and specialized facilities, as defin ed
598659 in and licensed pursuant to the provisions of the Nursing Home Care
599660 Act, residential care homes as defined by the Residential Care Act,
600661 adult day care centers as defined by the Adult Day Care Act, and
601662 assisted living centers and continuum of care facili ties licensed
602663 pursuant to the Conti nuum of Care and Assisted Living Act; and
603664 11. Other establishments exempted from food establishment
604665 licensure pursuant to sta te law; and
605666 12. Mobile food vendors lic ensed under this act.
606667 B. Each license shall expire one (1) year followin g the date of
607668 its issuance. The State Department of Health shall charge and
608669 collect for each such license an annual fee to be fixed by the Stat e
609670 Commissioner of Health.
610671 1. The Commissioner may provide by rule for a fee-exempt
611672 license for a food establish ment operated by a nonprofit, civic,
612673 charitable or religious organization that uses unpaid persons to
613674 sell or offer food on a more frequent basis than the occasional
614675 fund-raising event. A fee-exempt license shall not expire bu t shall
615676 remain in full force and effect until affirmatively revoked,
616677 suspended, annulled or withdrawn by the Department in accordance
617678 with applicable law.

645705 2. The Commissioner may by rule also provide that licenses for
646706 establishments serving events of limi ted duration or operating on a
647707 seasonal basis shall extend only for the term of the event or
648708 season, and may by rule adjust the fees for such licenses
649709 accordingly.
650710 3. The Commissioner shall promulgate rules to define farmers
651711 markets and provide by rule for a three-day license for vendors who
652712 only sell at farmers markets as defined in 310:257 -1-2 of the
653713 Oklahoma Administrative Code or at county fairs. Licenses for
654714 vendors who only sell at farmers markets or county fairs shall not
655715 exceed Fifty Dollars ($50.00) . Vendors who do not sell food and
656716 vendors who meet the exceptions provided in subsection A of this
657717 section shall not be required to obtain a three -day license or a
658718 food establishment license.
659719 4. The Commissioner shall provide by rule a multiseasonal
660720 license for snow cone stands that sell hot beverages in addition to
661721 snow cones. A snow cone stand that does n ot sell hot beverages
662722 shall be considered a seasonal food establishment.
663723 C. The State Commissioner of Health shall promulgate reasonable
664724 standards and rules for sanitation of establishments required to be
