51	123		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	124		SECTION 1. NEW LAW A new section of law to be codified
53	125		in the Oklahoma Statutes as Section 1 -1151 of Title 63, unless there
54	126		is created a duplicati on in numbering, reads as follows:
55	127		This act shall be known an d may be cited as the “Mobile Food
56	128		Vendor Act”.
57	129		SECTION 2. NEW LAW A new section of law to be codified
58	130		in the Oklahoma Statutes as Section 1 -1152 of Title 63, unless there
59	131		is created a duplication in numb ering, reads as follows:
60	132		As used in this act:
61	133		1. “Customer” means any person with whom a mobile food vendor
62	134		conducts his or her mobile vending business, or any person who sto ps
63	135		to contemplate conducting such business with a mobile food vendor;

91	162		2. “Department” means the State Department of Health;
92	163		3. “Food vending vehicle ” means any mobile unit used to sell
93	164		food and beverages by a mobile food vendor;
94	165		4. “Mobile food vendor” means any person who dispenses food or
95	166		beverages from a food vending vehicle for consumption;
96	167		5. “Prepackaged food” means any commercially labeled and
97	168		processed food prepackaged to prevent direc t human contact with the
98	169		food product upon distribu tion from the manufacturer, a food
99	170		facility, or other approved source;
100	171		6. “Sell” means to transfer or exchange for value, to expose,
101	172		display, or offer for sale or exchange, or to procure, store, keep
102	173		or have on hand or in one ’s possession or control for the purpose of
103	174		selling; and
104	175		7. “Vendor” means any person or entity who sel ls food out of a
105	176		mobile vending unit.
106	177		SECTION 3. NEW LAW A new section of law to be codified
107	178		in the Oklahoma Statutes as Section 1 -1153 of Title 63, unless there
108	179		is created a duplication in numbering, reads as follows:
109	180		All mobile food vendors must obtain a mobil e food vending
110	181		license from the State Department of Health. A separate mobile food
111	182		vendor license shall be required for every food vending vehicle used
112	183		by a mobile food vendor.

141	211		in the Oklahoma Statutes as Section 1 -1154 of Title 63, unless there

143	213		A. The State Department of Health shal l make a mobile food
144	214		vendor license application available to applicants on the
145	215		Department’s website.
146	216		B. The Department shall require the following information in a
147	217		mobile food vendor application:
148	218		1. The name, permanent address, telephone number, and emai l
149	219		address of the applicant;
150	220		2. Information pertaining to the nature of the food or
151	221		beverages to be offere d by the applicant; and
152	222		3. A list of the vehicle descriptions and license plate numbers
153	223		for all vehicles directly related to the mobile food vending
154	224		business.
155	225		C. Any person who drives a food vending vehicle shall hold a
156	226		current driver license to drive the fo od vending vehicle.
157	227		D. The applicant shall complete the application form and abide
158	228		by any request for information required by this act made by th e
159	229		Department.
160	230		E. The Department or designee shall confirm completeness of the
161	231		application, collect the license fee, and conduct a health
162	232		inspection prior to issuing a mobile food vend or license.

190	259		F. The State Commissioner of Health may establish a reasona ble
191	260		schedule of fees not to exceed:
192	261		1. Two Hundred Dollars ($200.00) for an initial mobile food
193	262		vendor license; and
194	263		2. One Hundred Seventy-five Dollars ($175.00) for annual
195	264		renewal of a mobile food vendor license.
196	265		G. Upon receipt of a complete, approved application, fees, and
197	266		a passed initial health inspection, the Department shall issue a
198	267		mobile vendor license to the applicant. The license shall be valid
199	268		for one (1) year from the date of issuance.
200	269		H. Licenses are not transfe rable, and a license shall not
201	270		authorize activities of any person other than the person to whom it
202	271		is issued.
203	272		I. The Commissioner may promulgate rules to allow for a mobile
204	273		unit to keep an existing license when purchasing a different mo bile
205	274		unit for the purposes of the existing lic ense. The licensee shall
206	275		submit to a health inspection of the new vehicle prior to beginning
207	276		operations.
208	277		J. It is the responsibility of the licensee to submit a renewal
209	278		application annually, at least fourteen (14) days prior to the
210	279		expiration date of the license. While an application for renewal is
211	280		pending with the Department, a licensee may continue mobile food
212	281		vending operations until the expiration date of the license.

240	308		SECTION 5. NEW LAW A new section of law to be codified
241	309		in the Oklahoma Statutes as Section 1-1155 of Title 63, unless there
242	310		is created a duplication in numb ering, reads as follows:
243	311		A. Mobile food vendors shall follow all state and local l aws
244	312		and regulations governing operations in the jurisdiction where the
245	313		vendor is operating including but not limited to all fire codes,
246	314		zoning codes, occupational tax codes , and any other applicable state
247	315		and local authority codes and laws not in conflict w ith the
248	316		provisions of this act.
249	317		B. A mobile food vendor may opera te in the following locations:
250	318		1. On public property, as long as the vending vehicle is not
251	319		parked within twenty (20) feet of an intersection. A mobile vendor
252	320		may operate from legal parking spaces on the public right -of-way
253	321		including metered spaces upon payment of appropriate fees. When
254	322		operating on public property, a mobile vendor is subject to the same
255	323		parking rules, restrictions, and obligations that a commercial
256	324		vehicle would be subject to if not used by a mobile food vendor; and
257	325		2. On private property located in an industrial, commercial, or
258	326		institutional zoning district if the vendor has permission of the
259	327		property owner or designee.
260	328		C. A mobile food vendor shall not operate in any manner which
261	329		will interfere with or obstruct the free passage of pedestrians or
262	330		vehicles along any street, sidewalk, or parkway.
263	331		D. When operating, a mobile foo d vendor shall:

291	358		1. Maintain a food vending vehicle in good operating order and
292	359		visual appearance including the removal of any graffiti that is not
293	360		part of the overall desig n or art featured on the vehicle;
294	361		2. Park so that its service window faces the sid ewalk or away
295	362		from the street if the vehicle is par ked along a street;
296	363		3. Serve customers through a service window;
297	364		4. Provide a waste receptacle for customers which is cl early
298	365		visible and request its use by customers;
299	366		5. Remove and dispose of all refus e within twenty-five (25)
300	367		feet of the vendor’s operating area at the conclusion of operation;
301	368		6. Submit to any required health inspections;
302	369		7. Display the mobile food vendor license in a conspicuous
303	370		location for public view ; and
304	371		8. Display the food vending vehicle ’s most recent inspection
305	372		report inside the food vending vehicle and provide such inspection
306	373		report to the Department or designee upo n request.
307	374		E. The State Commissioner of Health may promulgate rules to
308	375		enforce the provisions of this act. Rules adopted shall not:
309	376		1. Require a mobile food vendor that does not prepare food to
310	377		have a handwashing sink in the food vending vehicle;
311	378		2. Require a mobile food vendor to associat e with a commissary
312	379		if the vendor carries all the equipment necessary to comply with
313	380		health and safety standards and all applicable regulations;
314	381		3. Limit the number of m obile food vendor licenses issued;

342	408		4. Require a mobile food vendor to obtain any addi tional
343	409		permits from a local authority, unless the mobile food vendor seeks
344	410		to operate in a local, public park;
345	411		5. Require a mobile food vendor to install a Global Positioning
346	412		System (GPS) tracking device on the food vending vehicle;
347	413		6. Require a mobile f ood vendor to stay in constant motion
348	414		except for when serving cu stomers;
349	415		7. Require a mobile food vendor to maintain insurance that
350	416		names a local authority as an additi onal insured unless the vendor
351	417		is attending an event sponsored by the local authority; or
352	418		8. Require a mobile food vendor to submit to inspections beyond
353	419		routine or complaint health inspections conducted by the Department
354	420		or designee unless the Department is investigating a reported
355	421		foodborne illness.
356	422		SECTION 6. NEW LAW A new section of law to be codified
357	423		in the Oklahoma Statutes as Sect ion 1-1156 of Title 63, unless there
358	424		is created a duplication in numbering, reads as follows:
359	425		A. Mobile food vendors shall adhere to all laws and regulations
360	426		of the Oklahoma Administr ative Code pertaining to the preparation
361	427		and handling of food.
362	428		B. Any person preparing food or beve rages in a food vending
363	429		vehicle shall hold a current food handler certification recognized
364	430		by this state. At all times at least one person working in a foo d
365	431		vending vehicle must hold a current food handler certification

393	458		recognized by this state. Evidence of such certification shall be
394	459		presented at initial licensure and renewal .
395	460		C. Upon receipt of a complete lic ense application, the State
396	461		Department of Health shall classify a mobile food vendor into one of
397	462		the three classifications described in this subsection.
398	463		1. A Mobile Food Type I Vendor may only serve unopened,
399	464		prepackaged food items and bottled or canned beverages. Type I
400	465		vendors shall be inspected p rior to initial licensure, upon receipt
401	466		of a complaint, and as necessary for follow-up inspections due to
402	467		cited violations.
403	468		2. A Mobile Food Type II Vendor may serve any food item or
404	469		beverage a Type I Vendor may serve , hot or cold items, or unpackaged
405	470		food, as long as the vendor is not cooking with raw meat. Type II
406	471		Vendors may assemble food in the mobile unit. Typ e II Vendors shall
407	472		be inspected prior to initial licensure, once per year for a routine
408	473		inspection, upon receipt of a complaint, and as necessary for
409	474		follow-up inspections due to cited violations.
410	475		3. A Mobile Food Type III Vendor may serve any food item or
411	476		beverage in accordance with applicable laws and regulations. Type
412	477		III Vendors shall be inspected prior to initial licensure, twice per
413	478		year for routine inspections, upon receipt of a complaint, and as
414	479		necessary for follow-up inspections due to cited violations.
415	480		D. The State Commissioner of Health shall specify
416	481		classification qualifications in rule. If a mobile food vendor

444	508		elects to expand the scope of the vendor’s service in a manner which
445	509		would affect the classification type of the food vending vehicle ,
446	510		the mobile vendor shall notify the Department. The Department shall
447	511		update the classification status of the food vending vehicle if
448	512		applicable and notify the mobile food vendor of the
449	513		reclassification. Failure to report a change in service which would
450	514		affect the classification type of a food vending vehicle may result
451	515		in the suspension or revocation of the mobile food vendor license.
452	516		E. Health inspections shall be conducted by the Department or
453	517		designee. Upon completion of an inspection, the Department or
454	518		designee shall issue a copy of the inspection report , which the
455	519		mobile food vendor shal l post inside the food vending vehicle.
456	520		F. Licensed mobile food vendors shall present to the county
457	521		health department assigned to them for inspections. The State
458	522		Department of Health shall assign inspections to the county health
459	523		department closest to the licensee ’s home unless otherwise agre ed
460	524		upon by the Department and licensee. Routine inspection frequency
461	525		shall be based on the mobile food vendor ’s classification under
462	526		subsection C of this section .
463	527		SECTION 7. NEW LAW A new section of law to be codified
464	528		in the Oklahoma Statutes as Section 1-1157 of Title 63, unless there

493	556		A. The State Department of Health may investigate a food
494	557		vending vehicle upon reasonable suspicio n the mobile food vendor has
495	558		violated the law or upon receipt of a health or safety complaint.
496	559		B. If requested by the Department, a mobile vendor under
497	560		investigation or receiving a follow-up inspection by the Department
498	561		for noncompliance during previous inspections shall present the food
499	562		vending vehicle within five (5) calendar days to the county health
500	563		department location specified by the Department.
501	564		C. Failure to cooperate with an investigation by the Department
502	565		may result in suspension or revocation of a license.
503	566		D. Nothing in this act shall be construed t o impede the
504	567		Department or a local authority in any investigatio n of a reported
505	568		foodborne illness.
506	569		SECTION 8. AMENDATORY 63 O.S. 2021, Section 1 -1118, is
507	570		amended to read as follows:
508	571		Section 1-1118. A. It shall be unlawful for an y person to
509	572		operate or maintain any establishment, stationary or otherwise,
510	573		where food or drink is offered for sale, or sold, to the public,
511	574		unless the person is the holder of a food establishment license
512	575		issued for such purpose by the State Commissioner o f Health or
513	576		designee. A food establishment license shall not be required for:
514	577		1. A produce stand that offers only whole, unc ut and
515	578		unprocessed fresh fruits, melons, vegetables and legumes and/or
516	579		whole uncracked and unprocessed n uts;

544	606		2. A manufacturer, wholesaler or broker of food licensed
545	607		pursuant to Section 1 -1119 of this title;
546	608		3. A kitchen in a private home if only food th at does not
547	609		require time and temp erature control for safety is prepared for sale
548	610		or service at a funct ion such as a nonprofit civi c, charitable or
549	611		religious organization’s bake sale;
550	612		4. An area where food that is prepared as specified in
551	613		paragraph 3 of this subsection is sold or offered for human
552	614		consumption;
553	615		5. A private home that receives catered or home-delivered food;
554	616		6. A hotel licensed pursuant to Section 1-1201 of this title
555	617		which provides limited food service in compliance with rules
556	618		promulgated by the State Commissioner of Health;
557	619		7. A kitchen in a private home or in a bed and breakfast tha t
558	620		prepares and offers food to gu ests, if the home is owner-occupied,
559	621		the number of available guest bedrooms does not exceed three, and
560	622		breakfast is the only m eal offered;
561	623		8. A nonprofit civic, charitable or religious organization
562	624		using unpaid individuals to prepare or serve food on its behalf, for
563	625		occasional fund-raising events sponsored and conducted by the
564	626		organization. For the purposes of this paragraph, a n “occasional
565	627		fund-raising event” shall be defined as an event that occurs four
566	628		times a year or less;

595	656		child care facilities as defined and licensed pursuant to the
596	657		provisions of the Oklahoma Ch ild Care Facilities Licensing Act ;
597	658		10. Nursing facilities and specialized facilities, as defin ed
598	659		in and licensed pursuant to the provisions of the Nursing Home Care
599	660		Act, residential care homes as defined by the Residential Care Act,
600	661		adult day care centers as defined by the Adult Day Care Act, and
601	662		assisted living centers and continuum of care facili ties licensed
602	663		pursuant to the Conti nuum of Care and Assisted Living Act; and
603	664		11. Other establishments exempted from food establishment

605	666		12. Mobile food vendors lic ensed under this act.
606	667		B. Each license shall expire one (1) year followin g the date of
607	668		its issuance. The State Department of Health shall charge and
608	669		collect for each such license an annual fee to be fixed by the Stat e
609	670		Commissioner of Health.
610	671		1. The Commissioner may provide by rule for a fee-exempt
611	672		license for a food establish ment operated by a nonprofit, civic,
612	673		charitable or religious organization that uses unpaid persons to
613	674		sell or offer food on a more frequent basis than the occasional
614	675		fund-raising event. A fee-exempt license shall not expire bu t shall
615	676		remain in full force and effect until affirmatively revoked,
616	677		suspended, annulled or withdrawn by the Department in accordance
617	678		with applicable law.

645	705		2. The Commissioner may by rule also provide that licenses for
646	706		establishments serving events of limi ted duration or operating on a
647	707		seasonal basis shall extend only for the term of the event or
648	708		season, and may by rule adjust the fees for such licenses
649	709		accordingly.
650	710		3. The Commissioner shall promulgate rules to define farmers
651	711		markets and provide by rule for a three-day license for vendors who
652	712		only sell at farmers markets as defined in 310:257 -1-2 of the
653	713		Oklahoma Administrative Code or at county fairs. Licenses for
654	714		vendors who only sell at farmers markets or county fairs shall not
655	715		exceed Fifty Dollars ($50.00) . Vendors who do not sell food and
656	716		vendors who meet the exceptions provided in subsection A of this
657	717		section shall not be required to obtain a three -day license or a
658	718		food establishment license.
659	719		4. The Commissioner shall provide by rule a multiseasonal
660	720		license for snow cone stands that sell hot beverages in addition to
661	721		snow cones. A snow cone stand that does n ot sell hot beverages
662	722		shall be considered a seasonal food establishment.
663	723		C. The State Commissioner of Health shall promulgate reasonable
664	724		standards and rules for sanitation of establishments required to be
665	725		licensed, which shall include the following: buildings, vehicles,
666	726		and appurtenances thereto, including plumbing, ventilation and
667	727		lighting; construction, cleanliness and bactericidal treatment of
668	728		equipment and utensils; cleanliness, wholesomeness, storage and

697	756		hygiene of personnel; toilet facilities; disposal of waste; water
698	757		supply; and other items deemed necessary to safeguard the health,
699	758		comfort, and safety of customers.
700	759		SECTION 9. This act shall become effective July 1, 2023.
701	760		SECTION 10. It being immediately necessary for the preservation
702	761		of the public peace, healt h or safety, an emergency is hereby
703	762		declared to exist, by reason whe reof this act shall take effect and
704	763		be in full force from and after its passage and approval.
