68+another; assigning a duty for a game warden to inform
69+a person only when requested to do so; prohibiting
70+game warden from entering a private property under
71+certain circumstances unless requested; stating that
72+suspicion of possession of a firearm or discharge of
73+a weapon shall not itself constitute sufficient
74+probable cause to authorize entry to private
75+property; and providing an effective date .

4781 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4882 SECTION 1. AMENDATORY 29 O.S. 20 21, Section 5-202, is
4983 amended to read as follows:
5084 Section 5-202. A. Except as otherwise pro vided, no person may
5185 hunt or take by any mean s or method upon the land of another without
5286 the consent of the owner, lessee , or occupant of such land.
5387 B. For purposes of this section, consent shall be presumed to
5488 be valid for not more than one (1) year, unl ess the owner, lessee,
5589 or occupant specifica lly grants consent for a specified period of
5690 time.
57-C. Excluding land primarily devoted to farming, ranching, or
58-forestry purposes as set forth in Section 1835.2 of Title 21 of the
59-Oklahoma Statutes, areas exempt from the provisions of subsection A
60-of this section are lands belonging to this state which are not
61-leased and occupied by a resident, excluding school land.

89147 D. Any game warden investigating a hunter in the field has the
90148 does not have a duty, unless the landowner, lessee, or occupant has
91149 requested a game warden to do so, to inform the hunter that it is
92150 necessary to obtain the consen t of the landowner, lessee , or
93151 occupant to hunt or take on the particular property. Prosecution
94152 for violations of the provisio ns of this section may be commenced
95153 only upon written complain t of such owner, lessee, or occupant filed
96154 before any court auth orized to punish such violation, or upon
97155 written complaint to any game warden or officer authorized to make
98156 arrest for such offense s.
99157 E. Unless otherwise requested by a pr operty owner, lessee , or
100158 tenant, a game warden shall not be authorized to enter private
101159 property on the suspicion of the possible possession or di scharge of
102160 a firearm or bow.
103161 F. Suspicion of the possible possession or discharge o f a
104162 firearm or bow shall not itself constitute sufficient probable cause
105163 for authorizing a game warden to enter private property.
106-G. No person shall operate a motor -driven conveyance on lands
107-that are fenced and posted or are in cultivation without permission
108-of the landowner, les see, or occupant.
109-F. H. The consent of any owner, lessee, or occupant of land
110-authorizing a person to hunt, take, fish or engage in any
111-recreational activity upon the land of any such owner, lessee , or
112-occupant shall not be construed to create any additio nal duty of

218+F. H. The consent of any owner, lessee, or occupant of land
219+authorizing a person to hunt, take, fish or engage in any
220+recreational activity upon the land of any such owner, lessee , or
221+occupant shall not be construed to create any additio nal duty of
140222 care or impose any additional liability other than specified by
141223 Sections 16-71.2 and 16-71.3 of Title 2 of the Oklahoma Statutes.
142224 G. I. The obtaining of consent from any owner, lessee , or
143225 occupant of land authorizing a person to hunt, take, fi sh or engage
144226 in any recreational activity shall not relieve the authorized person
145227 using the land from any obligation which the person may have in the
146228 absence of obtaining such consent to exercise care in the use of
147229 such land and in activities thereon, or f rom the legal consequences
148230 of failure to employ such care.
149231 H. J. 1. It shall be an af firmative defense to prosecution
150232 under subsection A of this section that the accused had express or
151233 implied permission or legal authority to be on the property.
152234 2. If an accused reasonably believed he or she was upon
153235 property for which they had permission to be upon, it shall be an
154236 affirmative defense to prosecution under subsection A of this
155237 section that the accused had with him or her, on his or her person,
156238 written permission from the surface owner, surface lessee, hunting
157-lessee, or lawful occupant to be up on such person’s land while the
158-accused was upon any adjoining property. This defense shall not be
159-available to the accused if:
160-a. the accused has previously pled g uilty, nolo
161-contendere, or has been convicted of any act of
162-trespass or has been found civi lly liable of any act

290+lessee, or lawful occupant to b e upon such person’s land while the
291+accused was upon any adjoining property. This defense shall not be
292+available to the accused if:
293+a. the accused has previously pled g uilty, nolo
294+contendere, or has been convicted of any act of
295+trespass or has been found civilly liable of any act
296+of trespass, or
191297 b. the accused, while the accused was upon the adjoining
192298 property, does not have with him or her, on his or her
193299 person, the written permission specified in this
194300 paragraph.
195301 I. K. Any person convicted for the first time of violating any
196302 provisions of this section shall be guilty of a misdemeanor and
197303 punished by the imposition of a fine of not less than Five Hundred
198304 Dollars ($500.00) nor more than One Thousand Five Hundred Dollars
199305 ($1,500.00), or by imprisonment in th e county jail for thirty (30)
200306 days, or by both fine and imprisonment.
201307 J. L. Any person convicted for the second or subsequent time of
202308 violating any provisions of this s ection shall be guilty of a
203309 misdemeanor and punished by the imposition of a fine of not less
204310 than One Thousand Five Hundred Dollars ($1,500.00) nor more than Two
205311 Thousand Five Hundred Dollars ($2,500.00), or by imprisonment in the
206312 county jail for not less than six (6) months, or by both fine and
207313 imprisonment.
