5952 BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
6053 SECTION 1. AMENDATORY 74 O.S. 2021, Section 5060.16, is
6154 amended to read as follows:
6255 Section 5060.16. The Oklahoma Center for the Advancement of
6356 Science and Technology, with the advice and consent of the Committee
6457 Board, shall:
6558 1. Establish and operate a state program des igned to secure and
6659 impartially distribute funds credited to the Research Support
60+Revolving Fund to support professional service contracts for health
61+research projects;
62+2. Ensure that funding to support health research projects is
63+awarded only on the basi s of scientific merit;

94-Revolving Fund to support professional service contracts for health

96-2. Ensure that funding to support health research projects is
97-awarded only on the basi s of scientific merit;
9890 3. Design the health research program to ensure the optimum
9991 performance of the investigator and the maximum efficiency of the
10092 project;
10193 4. Evaluate and approve health research projects to be funded
10294 from the Research Support Revolvin g Fund;
10395 5. Establish a procedure for the referral of proposed health
10496 research projects to the Committee Board for review;
10597 6. Establish procedures for review of proposed health research
10698 projects by qualified individuals residing outside this state;
10799 7. Suspend or terminate any professional service contract
108100 supporting health research projects for failure by an investigator,
109101 institution of higher learning, or nonprofit research institution to
110102 comply with the procedures, requirements, or bylaws of the Center;
111103 and
112104 8. Enter into contracts to ensure the optimum performance of
113105 health research investigat ors and to ensure the maximum efficiency
114106 of proposed health research projects ;
115107 9. Provide a report to the Board detailing any potential
116108 commercial opportunities, if any, for projects receiving funds each
117109 fiscal year; and
110+10. For each fiscal year, maintain records and provide a report
111+to the Board containing the number of years that each project has
112+been receiving funds.

145-10. For each fiscal year, maintain records and provide a report
146-to the Board containing the number of years that each project has
147-been receiving funds.
148139 SECTION 2. AMENDATORY 74 O.S. 2021, Section 5060.17, is
149140 amended to read as follows:
150141 Section 5060.17. No professional service contract shall be
151142 awarded by the Oklahoma Center for the Advancement of Science and
152143 Technology to support a health research project unless:
153144 1. The investigators are residents of this state or become
154145 residents of this state before the ninetieth day after a
155146 professional service contract, pursuant to which they will be
156147 functioning as an investigator, has been funded by the Center;
157148 2. The institutions that administer the professional service
158149 contracts are primarily located in this state and are able to assume
159150 financial responsibility for professional service contracts;
160151 3. The professional service con tract will not be transferred to
161152 any other institutions within the state without the approval of the
162153 Center and will not be transferred to a n institution outside this
163154 state at any time; and
164155 4. The funds will not be expended for patient care except if
165156 patient care is an intrinsic part of a funded professional service
166157 contract; and
167158 5. A binding commitment is obtained from any institution of
168159 higher education, nonprofit research foundation , or private
160+enterprise that would receive funds pursuant to an award providing
161+information on an annual basis for the dura tion of funding and the

196-enterprise that would receive funds pursuant to an award providing
197-information on an annual basis for the dura tion of funding and the
198188 five (5) subsequent years, which shall include but not be limite d to
199189 the following:
200190 a. employment levels for the year preceding the award and
201191 each subsequent year ,
202192 b. any additional funds raised as a direct result of the
203193 award,
204194 c. payroll data resulting from the research ,
205195 d. gross sales or revenue as a direct result of the
206196 research, and
207197 e. relevant industry sector information, as determined by
208198 the Center.
209199 The Oklahoma Tax Commission shall collaborate with the Center
210200 for the reporting of f inancial data. The Center may provide an
211201 exception to the commitment required purs uant to this subsection for
212202 certain circumstances that ma ke the providing of data unfeasible,
213203 including but not limited to the death of owners or management,
214204 dissolution of the enterprise, or abandonment of proje cts.
215205 SECTION 3. This act shall become effective November 1, 2023.
