59 | 52 | | BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA: |

60 | 53 | | SECTION 1. AMENDATORY 74 O.S. 2021, Section 5060.16, is |
---|
61 | 54 | | amended to read as follows: |

62 | 55 | | Section 5060.16. The Oklahoma Center for the Advancement of |
---|
63 | 56 | | Science and Technology, with the advice and consent of the Committee |
---|
64 | 57 | | Board, shall: |

65 | 58 | | 1. Establish and operate a state program des igned to secure and |
---|
66 | 59 | | impartially distribute funds credited to the Research Support |
---|
98 | 90 | | 3. Design the health research program to ensure the optimum |
---|
99 | 91 | | performance of the investigator and the maximum efficiency of the |
---|
100 | 92 | | project; |
---|
101 | 93 | | 4. Evaluate and approve health research projects to be funded |

102 | 94 | | from the Research Support Revolvin g Fund; |
---|
103 | 95 | | 5. Establish a procedure for the referral of proposed health |
---|
104 | 96 | | research projects to the Committee Board for review; |

105 | 97 | | 6. Establish procedures for review of proposed health research |

106 | 98 | | projects by qualified individuals residing outside this state; |

107 | 99 | | 7. Suspend or terminate any professional service contract |

108 | 100 | | supporting health research projects for failure by an investigator, |
---|
109 | 101 | | institution of higher learning, or nonprofit research institution to |
---|
110 | 102 | | comply with the procedures, requirements, or bylaws of the Center; |

112 | 104 | | 8. Enter into contracts to ensure the optimum performance of |
---|
113 | 105 | | health research investigat ors and to ensure the maximum efficiency |
---|
114 | 106 | | of proposed health research projects ; |
---|
115 | 107 | | 9. Provide a report to the Board detailing any potential |
---|
116 | 108 | | commercial opportunities, if any, for projects receiving funds each |
---|
117 | 109 | | fiscal year; and |
---|
148 | 139 | | SECTION 2. AMENDATORY 74 O.S. 2021, Section 5060.17, is |

150 | 141 | | Section 5060.17. No professional service contract shall be |
---|
151 | 142 | | awarded by the Oklahoma Center for the Advancement of Science and |
---|
152 | 143 | | Technology to support a health research project unless: |

153 | 144 | | 1. The investigators are residents of this state or become |
---|
154 | 145 | | residents of this state before the ninetieth day after a |
---|
155 | 146 | | professional service contract, pursuant to which they will be |
---|
156 | 147 | | functioning as an investigator, has been funded by the Center; |
---|
157 | 148 | | 2. The institutions that administer the professional service |
---|
158 | 149 | | contracts are primarily located in this state and are able to assume |
---|
159 | 150 | | financial responsibility for professional service contracts; |
---|
160 | 151 | | 3. The professional service con tract will not be transferred to |
---|
161 | 152 | | any other institutions within the state without the approval of the |
---|
162 | 153 | | Center and will not be transferred to a n institution outside this |
---|
163 | 154 | | state at any time; and |
---|
164 | 155 | | 4. The funds will not be expended for patient care except if |
---|
165 | 156 | | patient care is an intrinsic part of a funded professional service |
---|
166 | 157 | | contract; and |
---|
167 | 158 | | 5. A binding commitment is obtained from any institution of |
---|
168 | 159 | | higher education, nonprofit research foundation , or private |
---|
198 | 188 | | five (5) subsequent years, which shall include but not be limite d to |
---|
199 | 189 | | the following: |

200 | 190 | | a. employment levels for the year preceding the award and |
---|
201 | 191 | | each subsequent year , |
---|
202 | 192 | | b. any additional funds raised as a direct result of the |
---|
203 | 193 | | award, |
---|
204 | 194 | | c. payroll data resulting from the research , |
---|
205 | 195 | | d. gross sales or revenue as a direct result of the |
---|
206 | 196 | | research, and |
---|
207 | 197 | | e. relevant industry sector information, as determined by |
---|
208 | 198 | | the Center. |
---|
209 | 199 | | The Oklahoma Tax Commission shall collaborate with the Center |
---|
210 | 200 | | for the reporting of f inancial data. The Center may provide an |
---|
211 | 201 | | exception to the commitment required purs uant to this subsection for |
---|
212 | 202 | | certain circumstances that ma ke the providing of data unfeasible, |
---|
213 | 203 | | including but not limited to the death of owners or management, |
---|
214 | 204 | | dissolution of the enterprise, or abandonment of proje cts. |
---|
215 | 205 | | SECTION 3. This act shall become effective November 1, 2023. |
