AS INTRODUCED 
 
An Act relating to children; directing the Department 
of Human Services to take certain actions to create 
specified program; directing pr omulgation of rules; 
providing for codification; and providing an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1-9-126 of Title 10A, unless 
there is created a duplication in numbering, reads as follows: 
A.  The Department of Human Services shall consult with and, as 
necessary, enter into one or more agreements with the Department of 
Mental Health and Substance Abuse Services and any other relevant 
agencies to create a program designed to prevent children who are 
not otherwise abused or neglected from entering the custody or 
guardianship of the Department of Human Services solely for the 
purpose of receiving services for a serious mental illness or 
serious emotional disturbance .

B.  The Department of Human S ervices, the Department of Mental 
Health and Substance Abuse Servic es, and any other affected agency 
shall promulgate such rules as are necessary to implem ent this 
section. 
SECTION 2.  This act shall become effective November 1, 2023.
