27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 63 O.S. 2021, Section 683.2, is
30	57		amended to read as follows:

32	58		Section 683.2. A. Because of the e xisting and increasing
33	59		possibility of the occurrence of disaste rs of unprecedented size and
34	60		destructiveness resulting from natural and man -made causes, in order
35	61		to ensure that preparations of this state will adequately deal with
36	62		such disasters and emergenc ies, to generally provide for the common
37	63		defense and to protect the public peace, health, and safety, to
38	64		preserve the lives and property of the people of this state, and to
39	65		carry out the objective s of state and national survival and recovery

40	93		in the event of a disaster or emergency, it is hereby found and
41	94		declared to be necessary to:

43	95		1. Create the Oklahoma Department of Emergency Management
44	96		(OEM);

48	97		2. Authorize the creation of local organizations f or emergency
49	98		management in the counties and incorporated mun icipalities of this
50	99		state;

52	100		3. Provide for the formulation and execution of an emergency
53	101		operations plan for the state . A component of the plan shall be
54	102		response to a catastrophic health emergency as defined in S ection
55	103		6104 of this title;

57	104		4. Confer upon the Governor and upon the executive heads or
58	105		governing bodies of the political subdivisions of the state the
59	106		emergency powers provided by the Oklahoma Emergency Management Act
60	107		of 2003;

62	108		5. Provide for the rendering of mutual aid among the political
63	109		subdivisions of this state and with other states to cooperate with
64	110		the federal government with respect to carrying out emergency
65	111		management functions and haza rd mitigation; and

67	112		6. Provide sufficient organization to meet, prevent or reduce
68	113		emergencies in the gene ral interest and welfare of the public and
69	114		this state.

71	115		B. It is further declared to be the purpose of the Oklahoma
72	116		Emergency Management Act of 2003 an d the policy of this state that

73	144		all emergency management and hazard mitigation functions of this
74	145		state be coordinated to the maximum extent with the comparable
75	146		functions of the federal government, including its various
76	147		departments and agencies, of other st ates and localities, and of
77	148		private agencies of every type, to the end that the most effective
78	149		preparation and use may be made of available workforce, resources
79	150		and facilities for dealing with disaster and hazard mitigation.

81	151		C. It is also directed that ea ch state agency, board,
82	152		commission, department or other state entity having responsibilities
83	153		either indicated in the state Emergency Operations Plan or by the
84	154		nature of the service it provides to the citizens of Oklahoma shall
85	155		have written plans and proced ures in place to protect individual
86	156		employees, administrators and visitors from natural and man -made
87	157		disasters and emergencies occurring at the work place. Plans an d
88	158		procedures shall be in concurrence with the Oklahoma Department of
89	159		Emergency Management G uidebook titled “Emergency Standard Operating

92	160		Procedures” for state departments, agencies, offices and em ployees.
93	161		Each state agency, board, commission, department o r other state
94	162		entity shall provide a calendar year annual report on the status of
95	163		their emergency management program to OEM. OEM shall compile and
96	164		integrate all reports into a report to the Gover nor and Legislature
97	165		on the status of state emergency prepare dness.

99	166		D. Each state agency, board, commission, department or other
100	167		state entity shall hav e written plans and procedures in place to

104	197		E. The National Incident Management System (N IMS) shall be the
105	198		standard for incident management in the State of Oklahoma. All on -
106	199		scene management of disasters and emergencies shall be conducted
107	200		using the Incident Command System (ICS).

109	201		SECTION 2. REPEALER 63 O.S. 2021, Section 6105, is
110	202		hereby repealed.

112	203		SECTION 3. This act shall become effective Nove mber 1, 2023.
