2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 63 O.S. 2021, Section 683.2, is
3057 amended to read as follows:

3258 Section 683.2. A. Because of the e xisting and increasing
3359 possibility of the occurrence of disaste rs of unprecedented size and
3460 destructiveness resulting from natural and man -made causes, in order
3561 to ensure that preparations of this state will adequately deal with
3662 such disasters and emergenc ies, to generally provide for the common
3763 defense and to protect the public peace, health, and safety, to
3864 preserve the lives and property of the people of this state, and to
3965 carry out the objective s of state and national survival and recovery

4395 1. Create the Oklahoma Department of Emergency Management

4897 2. Authorize the creation of local organizations f or emergency
4998 management in the counties and incorporated mun icipalities of this
5099 state;

52100 3. Provide for the formulation and execution of an emergency
53101 operations plan for the state . A component of the plan shall be
54102 response to a catastrophic health emergency as defined in S ection
55103 6104 of this title;

57104 4. Confer upon the Governor and upon the executive heads or
58105 governing bodies of the political subdivisions of the state the
59106 emergency powers provided by the Oklahoma Emergency Management Act
60107 of 2003;

62108 5. Provide for the rendering of mutual aid among the political
63109 subdivisions of this state and with other states to cooperate with
64110 the federal government with respect to carrying out emergency
65111 management functions and haza rd mitigation; and

67112 6. Provide sufficient organization to meet, prevent or reduce
68113 emergencies in the gene ral interest and welfare of the public and
69114 this state.

71115 B. It is further declared to be the purpose of the Oklahoma
72116 Emergency Management Act of 2003 an d the policy of this state that

73144 all emergency management and hazard mitigation functions of this
74145 state be coordinated to the maximum extent with the comparable
75146 functions of the federal government, including its various
76147 departments and agencies, of other st ates and localities, and of
77148 private agencies of every type, to the end that the most effective
78149 preparation and use may be made of available workforce, resources
79150 and facilities for dealing with disaster and hazard mitigation.

81151 C. It is also directed that ea ch state agency, board,
82152 commission, department or other state entity having responsibilities
83153 either indicated in the state Emergency Operations Plan or by the
84154 nature of the service it provides to the citizens of Oklahoma shall
85155 have written plans and proced ures in place to protect individual
86156 employees, administrators and visitors from natural and man -made
87157 disasters and emergencies occurring at the work place. Plans an d
88158 procedures shall be in concurrence with the Oklahoma Department of
89159 Emergency Management G uidebook titled “Emergency Standard Operating

92160 Procedures” for state departments, agencies, offices and em ployees.
93161 Each state agency, board, commission, department o r other state
94162 entity shall provide a calendar year annual report on the status of
95163 their emergency management program to OEM. OEM shall compile and
96164 integrate all reports into a report to the Gover nor and Legislature
97165 on the status of state emergency prepare dness.

99166 D. Each state agency, board, commission, department or other
100167 state entity shall hav e written plans and procedures in place to

104197 E. The National Incident Management System (N IMS) shall be the
105198 standard for incident management in the State of Oklahoma. All on -
106199 scene management of disasters and emergencies shall be conducted
107200 using the Incident Command System (ICS).

109201 SECTION 2. REPEALER 63 O.S. 2021, Section 6105, is
110202 hereby repealed.

112203 SECTION 3. This act shall become effective Nove mber 1, 2023.
