2960 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-1950.1, is
3061 amended to read as follows:

3262 Section 1-1950.1. A. For purposes of this section:

3463 1. “Nurse aide” means any person who provides, for
3564 compensation, nursing care or health-related services to residents
3665 in a nursing facility, a specialized facility, a residential care
3766 home, continuum of care facility, assisted living center or an adult
3867 day care center and who is not a licensed health profess ional. Such

51103 terms are defined in the Nursing Home Care Act,

53104 b. a residential care hom e as such term is defined by the
54105 Residential Care Act,

57107 the Adult Day Care Act,

59108 d. an assisted living center as such term is defined by
60109 the Continuum of Care and Assisted Living Act,

62110 e. a continuum of care facility as such term is defined
63111 by the Continuum of Care and Assisted Living Act,

65112 f. a home health or home ca re agency,

67113 g. the Department of Human Services, in its capacity as
68114 an operator of any ho spital or health care institution
69115 or as a contractor w ith providers under the Medicaid
70116 State Plan Personal Care Program,

72117 h. any facility operated by the Oklahoma Depart ment of
73118 Veterans Affairs, and

75146 i. any facility approved and annually reviewed by the
76147 United States Department of Veterans Affairs as a
77148 medical foster home in which care is provided
78149 exclusively to three or fewer veterans;

80150 3. “Home health or home care agency ” means any person,
81151 partnership, association, corporation or other organization which
82152 administers, offers or provides health care services or supportive
83153 assistance for compensation to three or more ill, disabled, or
84154 infirm persons in the temporary or perma nent residence of such
85155 persons, and includes any subunits or branch offices of a parent
86156 home health or home care agency;

88157 4. “Bureau” means the Oklahoma State Bureau of Investigation;

93159 5. “Completion of the sentence” means the last day of the
94160 entire term of the incarceration imposed by the sentence including
95161 any term that is deferred, su spended or subject to parole.

97162 B. Before any employer makes an offer to employ or to contract
98163 with a nurse aide begins employment or a contract to provide nursing
99164 care, health-related services or supportive assistance to any
100165 individual, the employer shall provide for a criminal history
101166 background check to be m ade on the nurse aide pursuant to the
102167 provisions of the Long-Term Care Security Act. If the employer is a
103168 facility, home or institution which is part of a larger complex of
104169 buildings, the requirement of a criminal history background check

105197 shall apply only to an offer of employment or contract made to a
106198 person who will work pr imarily in the immediate boundaries of the
107199 facility, home, or institution.

109200 Where the provisions of the Long -Term Care Security Act
110201 pertaining to registry screenin gs and national crimin al history
111202 record check checks are not in effect pending an effective date
112203 established in rulemaking, an employer is authorized to obtain any
113204 criminal history background records maintained by the Bureau
114205 pursuant to the following:
115-
116206 1. The employer shall request the Bureau to conduct a criminal
117207 history background check on the nurse aid e and shall provide to the
118208 Bureau any relevant information required by the Bureau to conduct
119209 the check. The employer shall pay a fee of Fifteen Dollars ($15.00)
120210 to the Bureau for each criminal history background check that is
121211 conducted pursuant to such a request;

123212 2. An employer may make an offer of temporary employment to a
124213 nurse aide pending the results of the criminal history background
125214 check. The employer in such instance shall provide to the Bureau
126215 the name and relevant information relating to the pe rson within
127216 seventy-two (72) hours after the date the person accepts temporary
128217 employment. The employer shall not hire or contract with the nurse
129218 aide on a permanent basis until the results of the criminal history
130219 background check are received;

132247 3. An employer may accept a criminal history background report
133248 less than one (1) year old of a person to whom such employer makes
134249 an offer of employment. The report shall be obtained from the

137250 previous employer or contractor of such person and shall only be
138251 obtained upon the written consent of such person; and

140252 4. Every employer while subject to the provisions of this
141253 subsection shall inform each applicant for employment, o r each
142254 prospective contract provider, as applicable, that the employer is
143255 required to obtain a criminal history background record before
144256 making an offer of permanent employment or contract to a nurse aide.

146257 C. 1. If the results of a criminal history backg round check
147258 reveal that the subject person has been convicted of, pled guilty or
148259 no contest to, or received a deferred sentence for, a felony or
149260 misdemeanor offense for any of the following offenses in any state
150261 or federal jurisdiction, the employer shall not hire or contract
151262 with the person:

153263 a. abuse, neglect, or financial exploitation of any
154264 person entrusted to the care or possession of such
155265 person,
156-
157266 b. rape, incest, or sodomy, or any crime that resulted in
158267 the person being registered on a sex offender registry
159268 at any time,

161269 c. child abuse,

163270 d. murder or attempted murder,

177304 2. If less than seven (7) five (5) years have elapsed since the
178305 completion of sentence, and the results of a criminal history check

183308 following offenses, in any state or federal jurisdiction, the

190312 c. indecent exposure and indecent exhibition, except
191313 where such offense disqualifies the applicant as a
192314 registered sex offender,

196316 e. burglary in the first or second degree,

198317 f. robbery in the first or second degree,

200318 g. robbery or attempted robbery with a dangerous weapon,
201319 or imitation firearm,

205348 i. unlawful manufacture , distribution, prescription, or
206349 dispensing of a Schedule I through V drug as defined
207350 by the Uniform Controlled Dangerous Substances Act,

209351 j. grand larceny, or

211352 k. petit larceny or shop lifting.

213353 D. An employer shall not employ or continue employing a person
214354 addicted to any Schedule I thr ough V drug as specified by the
215355 Uniform Controlled Dangerous Substances Act unless the person
216356 produces evidence tha t the person has successfully complete d a drug
217357 rehabilitation program.

219358 E. All employment eligibility determination reco rds received by
220359 the employer pursuant to this section are confidential and are for
221360 the exclusive use of the State D epartment of Health a nd the employer
222361 which requested the in formation. Except on court order or with the

225362 written consent of the person being investigated, the rec ords shall
226363 not be released or otherwise disclosed to any other person or
227364 agency. These record s shall be destroyed after one (1) year from
228365 the end of employment of the person to whom such records relate.

230366 F. As part of the inspections required by the Nursi ng Home Care
231367 Act, Continuum of Care and Assisted Living Act, the Residential Care
232368 Act, and the Adult Day Care Act, the State Department of Health
233369 shall review the employment files of any facility, home or
234370 institution required to obtain a criminal history b ackground
