2956 SECTION 1. AMENDATORY 11 O.S. 2 021, Section 22-107.1, is
3057 amended to read as follows:

3258 Section 22-107.1. A. A municipality may by ordinance or
3359 otherwise grant a certificate, license, permit or franchise for the
3460 operation of a video services system, unl ess such authority is
3561 already provided for by law. Any certificate, license, permit or
3662 franchise granted pursuant to this section shall constitute a
3763 bargained contract between the municipality and the video services
3864 provider and shall provide for a consid eration payment to the
3965 municipality as rental for the privileges granted to the provider to

4093 use the public ways and grounds within the municipality in
4194 furtherance of its video services business. The rental payment
4295 shall be set at the amount bargained betw een the municipality and
4396 the video services provider but shall not exceed five percent (5%)
4497 of the annual gross revenues derived by the video services provider
4598 from the provision of video services within the municipality. Any
4699 certificate, license, permit or franchise issued by the governin g

49100 body shall be nonexclusive and shall not exceed a period of twenty-
50101 five (25) years and may be revocable by the governing body if said
51102 the body determines that the holder of the certificate, license,
52103 permit or franchise has willfully failed or neglected t o perform
53104 duties pursuant to the terms of the grant of the certificate,
54105 license, permit or franchise. Nothing herein shall limit the
55106 authority of a municipality to comply with state or federal law.

57107 B. In the event a mun icipality grants an overlapping
58108 certificate, license, permit or franchise for video services within
59109 its jurisdiction on terms or conditions more favorable or less
60110 burdensome than those in any existing certificate, license, permit
61111 or franchise within the mu nicipality the holder of the existi ng
62112 certificate, license, permit or franchise shall be entitled, upon
63113 written notice to the municipality, to adopt the terms in the
64114 overlapping certificate, license, permit or franchise that are more
65115 favorable or less burd ensome than those in the existing c ertificate,

66143 license, permit or franchise and the adopted terms shall become
67144 enforceable by the municipality.

69145 C. In addition to any other authority granted to municipalities
70146 by this section or other applicable law, a muni cipality may also
71147 adopt an ordinance regulating a video services system pursuant to
72148 its police power. No municipal provisions regulating a video
73149 services system may be adopted which are inconsistent with either
74150 state or federal law or with the terms and c onditions of the
75151 certificate, license, permit or franchise bargained by the
76152 municipality and the video services provider.

78153 D. In awarding or renewing a certificate, license, permit or
79154 franchise for video services, a municipality may require adequate
80155 assurance that the video services system provider will provide
81156 adequate public, educational, and governmental access channel
82157 capacity, facilities or financial support. A video services system
83158 provider may, at its sole option, provide a “family friendly”
84159 “family-friendly” tier of video service s in lieu of channel
85160 capacity, facilities, or financial support for public access as a
86161 condition of any certificate, license, permit or franchise for video
87162 services or renewal thereof. Nothing herein shall affect any
88163 channel capacity, facilities, or finan cial support for educational
89164 or governmental access contained in any certificate, license, permit
90165 or franchise for video services or renewal thereof.

94193 E. A “family friendly” “family-friendly” tier of services is a
95194 group of channels, offered to customers pursu ant to Federal
96195 Communications Commission (FCC ) regulations, that primarily contains
97196 programming with a t elevision viewing rating of TV -Y, TV-Y7 or TV-G.

99197 F. “Video services” means video programming, including cable
100198 services, provided through wireline facil ities owned, controlled,
101199 constructed, or operated by the provider of such video service and
102200 located at least in part in the public rights -of-way without regard
103201 to the delivery technology, in cluding Internet protocol techn ology.
104202 “Video services” Video services shall not include:

106203 1. video Video programming provided by a commercial mobile
107204 service provider as defined in 47 U.S.C., Section 332(d) (1);

109205 2. Direct-to-home satellite services as defined in 47 U.S.C.,
110206 Section 303(v) that are transmitted from a satel lite directly to a
111207 customer’s premises without using or accessing any portion of the
112208 public right-of-way; or provided solely
113-
114209 3. Video programing accessed as part of and via a service that
115210 enables users to access content, information, electronic mail,
116211 messaging and other services offered over the public Internet,
117212 including streaming content.

119213 SECTION 2. This act shall become effective November 1, 2023.
