55 | 48 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

56 | 49 | | SECTION 1. AMENDATORY 41 O.S. 2021, Section 111, is |
---|
57 | 50 | | amended to read as follows: |

58 | 51 | | Section 111. A. Except as otherwise provided in the Oklahoma |
---|
59 | 52 | | Residential Landlord and Tenant Act, when t he tenancy is month-to- |
---|
60 | 53 | | month or tenancy at will, the landlo rd or tenant may terminate the |
---|
61 | 54 | | tenancy provided the landlord or tenant gives a written notice to |
---|
62 | 55 | | the other at least thirty (30) days before t he date upon which the |
---|
63 | 56 | | termination is to become effectiv e. The thirty-day period to |
---|
64 | 57 | | terminate shall begin to run f rom the date notice to terminate is |
---|
65 | 58 | | served as provided in subsection E of this section. |

106 | 98 | | Act, the landlord may immediately bring an action for possession and |

107 | 99 | | damages. If the tenant’s holdover is willful and not in good faith |
---|
108 | 100 | | the landlord may also rec over an amount not more than twice the |
---|
109 | 101 | | average monthly rental, computed and prorated on a daily basis, for |
---|
110 | 102 | | each month or portion thereof that the tenant remains in possession. |
---|
111 | 103 | | If the landlord consents to the tenant ’s continued occupancy, a |
---|
112 | 104 | | month-to-month tenancy is thus created, unless the pa rties otherwise |
---|
113 | 105 | | agree. |

114 | 106 | | E. The written notice, required by the Okla homa Residential |
---|
115 | 107 | | Landlord and Tenant Act, to terminate any t enancy shall be served on |
---|
116 | 108 | | the tenant or landlord personally unless otherwise specified by l aw. |

157 | 148 | | F. A victim of domestic violence, sexual violence or stalking |
---|
158 | 149 | | may terminate a lease w ithout penalty by providing written notice |
---|
159 | 150 | | and a protective order of an incident of such vi olence within thirty |
---|
160 | 151 | | (30) days of such incident, unless the landlord waives such time |
---|
161 | 152 | | period. Once notice is given to the landlord and a rental payment |
---|
162 | 153 | | is made for the thirty -day period, no further rental payment shall |
---|
163 | 154 | | be due and the lease shall be terminated. Any deposit amount may be |
---|
164 | 155 | | returned to the tenant in the same manner as if t he lease were not |
---|
165 | 156 | | terminated. |

166 | 157 | | G. The provisions of this section shall not apply to an |

167 | 158 | | occupant who has no rental agreement with the landlord and with whom |
