5548 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5649 SECTION 1. AMENDATORY 41 O.S. 2021, Section 111, is
5750 amended to read as follows:
5851 Section 111. A. Except as otherwise provided in the Oklahoma
5952 Residential Landlord and Tenant Act, when t he tenancy is month-to-
6053 month or tenancy at will, the landlo rd or tenant may terminate the
6154 tenancy provided the landlord or tenant gives a written notice to
6255 the other at least thirty (30) days before t he date upon which the
6356 termination is to become effectiv e. The thirty-day period to
6457 terminate shall begin to run f rom the date notice to terminate is
6558 served as provided in subsection E of this section.
59+B. Except as otherwise provided in the Oklahoma Resi dential
60+Landlord and Tenant Act, when the tenancy is les s than month-to-

93-B. Except as otherwise provided in the Oklahoma Resi dential
94-Landlord and Tenant Act, when the tenancy is les s than month-to-
95-month, the landlord or tenant may terminate the tenancy provided the
9688 landlord or tenant gives to the other a writ ten notice served as
9789 provided in subsection E of this section at least seven (7) days
9890 before the date upon which the terminatio n is to become effective.
9991 C. Unless earlier terminated und er the provisions of the
10092 Oklahoma Residential Landlord and Tenant Act or unless otherwise
10193 agreed upon, a tenancy for a definite term expires on the ending
10294 date thereof without notice.
10395 D. If the tenant remains in possession without the landlord ’s
10496 consent after the expiration of the term of the rental agreement or
10597 its termination under the Oklahoma Residential Landlord and Tenant
10698 Act, the landlord may immediately bring an action for possession and
10799 damages. If the tenant’s holdover is willful and not in good faith
108100 the landlord may also rec over an amount not more than twice the
109101 average monthly rental, computed and prorated on a daily basis, for
110102 each month or portion thereof that the tenant remains in possession.
111103 If the landlord consents to the tenant ’s continued occupancy, a
112104 month-to-month tenancy is thus created, unless the pa rties otherwise
113105 agree.
114106 E. The written notice, required by the Okla homa Residential
115107 Landlord and Tenant Act, to terminate any t enancy shall be served on
116108 the tenant or landlord personally unless otherwise specified by l aw.
109+If the tenant cannot be located, service shall be made by delivering
110+the notice to any family member of such tenant over the age of
111+twelve (12) years residing w ith the tenant. If service cannot be

144-If the tenant cannot be located, service shall be made by delivering
145-the notice to any family member of such tenant over the age of
146-twelve (12) years residing w ith the tenant. If service cannot be
147138 made on the tenant pe rsonally or on such family membe r, notice shall
148139 be posted at a conspic uous place on the dwelling unit of the tenant.
149140 If the notice is posted, a copy of such notice shall be mailed to
150141 the tenant by certified mail or by mailing such notice through the
151142 Firm Mailing Book for Accountable Mai l as provided by the United
152143 States Post Office. If service cannot be made on the landlord
153144 personally, the notice shall be mailed to the landlord by certified
154145 mail. For the purpose of this subsection, the word “landlord” shall
155146 mean any person authorized t o receive service of process and notic e
156147 pursuant to Section 116 of this title.
157148 F. A victim of domestic violence, sexual violence or stalking
158149 may terminate a lease w ithout penalty by providing written notice
159150 and a protective order of an incident of such vi olence within thirty
160151 (30) days of such incident, unless the landlord waives such time
161152 period. Once notice is given to the landlord and a rental payment
162153 is made for the thirty -day period, no further rental payment shall
163154 be due and the lease shall be terminated. Any deposit amount may be
164155 returned to the tenant in the same manner as if t he lease were not
165156 terminated.
166157 G. The provisions of this section shall not apply to an
167158 occupant who has no rental agreement with the landlord and with whom
159+the landlord has not consented to creating a tenancy. A landlord
160+shall have the right to demand that such an occupant vac ate the
161+dwelling unit or the premises or both and shall not be required t o

195-the landlord has not consented to creating a tenancy. A landlord
196-shall have the right to demand that such an occupant vac ate the
197-dwelling unit or the premises or both and shall not be r equired to
198188 commence eviction proceedings. If the occupa nt wrongfully fails to
199189 comply within a reasonable time, the occupant shall, upon
200190 conviction, be guilty of a trespass and may be punished by a fine
201191 not to exceed Five Hundred Dollars ($500.00).
202192 SECTION 2. This act shall become effective Nov ember 1, 2023.
