147147 SECTION 1. NEW LAW A new s ection of law to be codified
148148 in the Oklahoma Statutes as S ection 901 of Title 84, unless there is

150150 This act shall be known and may be cited as the “Uniform
151151 Electronic Estate Planni ng Documents Act”.
152152 SECTION 2. NEW LAW A new section of law to be codified
153153 in the Oklahoma Statutes as Section 902 of Title 84, unless there is
154154 created a duplication in numb ering, reads as follows:
155155 As used in the Uniform Electronic Estate Planning Documents Act:
156156 1. “Electronic” means relating to technology havin g electrical,
157157 digital, magnetic, wireless, optical, electromagnetic, or similar
158158 capabilities;
159159 2. “Electronic record” means a record created, generated, sent,
160160 communicated, received, or stored by electroni c means;
161161 3. “Electronic signature” means an electronic symbol or process
162162 attached to or logic ally associated with a record and executed or
163163 adopted by a person with the intent to sign the record ;
164164 4. “Information” includes data, text, images, codes, comput er
165165 programs, software, and databases;
166166 5. “Non-testamentary estate planning document ” means a record
167167 relating to estate planning that is readable as text at the time of
168168 signing and is not a will or contained in a will. Non-testamentary

234234 or physician order for life -sustaining treatment,
235235 (8) a record directing disposition of an individual ’s
236236 body after death,
237237 (9) a nomination of a guardian for the signing
238238 individual,
239239 (10) a nomination of a guardian for a minor child or
240240 disabled adult child,
241241 (11) a mental health treatme nt declaration, or
242242 (12) any other record intended to carry out an
243243 individual’s intent regarding property or healt h
244244 care while incapacitated or on death, and

296296 b. Non-testamentary estate planning document does not
297297 include a deed of real property or certificate of
298298 title for a motor vehicle, watercraft, or aircraf t;
299299 6. “Person” means an individual, estate, business or nonprofit
300300 entity, government or governmental subdiv ision, agency, or
301301 instrumentality, or other legal entity;
302302 7. “Power of attorney” means a record that grants authority to
303303 an agent to act in place of the principal, ev en if the term is not
304304 used in the record;
305305 8. “Record” means information:
306306 a. inscribed on a tangible medium, or
307307 b. stored in an electronic or othe r medium and
308308 retrievable in perceivable form ;
309309 9. “Security procedure” means a procedure to verify that an
310310 electronic signature, record, or performance is that of a specific
311311 person or to detect a cha nge or error in an electronic record,
312312 including a procedure that uses an algorithm, code, identifying word
313313 or number, encryption, callback, or other acknowledgment procedure;
314314 10. “Settlor” means a person, including a testa tor, that
315315 creates or contributes property to a trust;
316316 11. “Sign” means, with present inte nt to authenticate or adopt
317317 a record:
318318 a. execute or adopt a tangible symbol , or

371371 electronic signature ;
372372 12. “State” means a state of the United S tates, the District of
373373 Columbia, Puerto Rico, the United States Virgin Islands, or other
374374 territory or possession subject to the jurisdiction of the Unite d
375375 States. The term includes a federally recognized Indian tribe ;
376376 13. “Terms of a trust” means:
377377 a. except as provided in subparagraph b of this
378378 paragraph, the manifestation of the settlor ’s intent
379379 regarding a trust’s provisions as:
380380 (1) expressed in the trust instrument , or
381381 (2) established by other evidence that would be
382382 admissible in a judicial proceeding; or
383383 b. the trust’s provisions as established, determined, or
384384 amended by:
385385 (1) a trustee or other person in accordance with
386386 applicable law,
387387 (2) a court order, or
388388 (3) a nonjudicial settlement agreement ;
389389 14. “Trust instrument” means an instrument executed by the
390390 settlor or other person authorized by law that contains terms of the
391391 trust including any amendments ; and
392392 15. “Will” includes a codicil and a testamentary instrument
393393 that appoints an executor, revokes or revises another will,

445445 nominates a guardian, or expressly excludes or limits the right of
446446 an individual or class to succeed to property of the decedent
447447 passing by intestate succession.
448448 SECTION 3. NEW LAW A new section of law to be codified
449449 in the Oklahoma Statutes as S ection 903 of Title 84, unless there is
450450 created a duplication in numb ering, reads as follows:
451451 This act shall be construed and applied to facilitate electronic
452452 estate planning documents and signatures consistent with other law
453453 and be consistent with reasonable practices conc erning electronic
454454 documents and signatures and cont inued expansion of those practices.
455455 SECTION 4. NEW LAW A new section of law to be c odified
456456 in the Oklahoma Statutes as Section 904 of Title 84, unless there is
457457 created a duplication in numbering, reads as follows:
458458 A. Except as provided in subsection B of this section, this act
459459 shall apply to an electronic non -testamentary estate planning
460460 document and an electronic signature on a non -testamentary estate
461461 planning document.
462462 B. This act shall not apply to a non-testamentary estate
463463 planning document if the document precludes use of an electronic
464464 record or electronic sign ature.
465465 C. This act shall not affect the validity of an electronic
466466 record or electronic signature that is valid under the Uniform
467467 Electronic Transactions Act, Section 15-101 et seq. of Title 12A of

521521 SECTION 5. NEW LAW A new section of law to be codified

524524 The law of this state and p rinciples of equity applic able to a
525525 non-testamentary estate planning document shall apply to an
526526 electronic non-testamentary estate plannin g document except as
527527 modified by this act.
528528 SECTION 6. NEW LAW A new sec tion of law to be codified
529529 in the Oklahoma Statutes as Section 906 of Title 84, unless there is
530530 created a duplication in numbering, reads as follows:
531531 A. This act shall not require a non-testamentary estate
532532 planning document or sign ature on a non-testamentary estate planning
533533 document to be created, generated, sent, communicated, rec eived,
534534 stored, or otherwise proc essed or used by electronic means or in
535535 electronic form.
536536 B. A person shall not be required to have a non -testamentary
537537 estate planning document in electronic form or signed electronically
538538 even if the person previously created or signed a non-testamentary
539539 estate planning document by electronic means.
540540 C. No person shall waive the provisions of this section.

592592 SECTION 7. NEW LAW A new section of law to be codified
593593 in the Oklahoma Statutes as Section 907 of Title 84, unless there is
594594 created a duplication in numbering, reads as follows:
595595 A. A non-testamentary estate planning document or a signature
596596 on a non-testamentary estate planning document may n ot be denied
597597 legal effect or enforceabi lity solely because it is in elec tronic
598598 form.
599599 B. If other laws of this state require a non-testamentary
600600 estate planning document to be in writing, an electronic record of
601601 the document shall satisfy such requirement.
602602 C. If other laws of this state require a signature on a non -
603603 testamentary estate planning do cument, an electronic signature shall
604604 satisfy such requirement.
605605 SECTION 8. NEW LAW A new section o f law to be codified
606606 in the Oklahoma Statutes as Section 908 of Title 84, unless there is
607607 created a duplication in numb ering, reads as follows:
608608 A. An electronic non-testamentary estate planning document or
609609 electronic signature on an electronic non -testamentary estate
610610 planning document is attributable to a person if it was the act of
611611 the person. The act of the person may be shown in any manner
612612 including by showing the efficacy of a secu rity procedure applied to
613613 determine the person to which the elect ronic record or electronic
614614 signature was attributable.

666666 B. The effect of attribution to a person under subsection A of
667667 this section of a document or signature is determined from the
668668 context and surrounding circumstances at the time of its creation,
669669 execution, or adoption and as provided by law.
670670 SECTION 9. NEW LAW A new section of law to be codified
671671 in the Oklahoma Statu tes as Section 909 of Title 84, unless there is
672672 created a duplication in numbering, reads as follows:
673673 If the laws of this state require a signature or record to be
674674 notarized, acknowledged, verified, or made under oath, the
675675 requirement shall be satisfied with respect to an electronic non-
676676 testamentary estate planning document if an individual authorized t o
677677 perform the notarizat ion, acknowledgment, verification, or oath
678678 attaches or logically associates the individual ’s electronic
679679 signature on the document toge ther with all other information
680680 required to be included under law.
681681 SECTION 10. NEW LAW A new sectio n of law to be codified
682682 in the Oklahoma Statutes as Section 910 of Title 84, unless there is
683683 created a duplication in numb ering, reads as follows:
684684 A. If the laws of this state base the validity of a non-
685685 testamentary estate planning document on whether it is signed,
686686 witnessed, or attested by another individual, the signature,
687687 witnessing, or attestation of that individual may be electronic.
688688 B. For the purposes of this subsection, “electronic presence”
689689 means that two or more individuals in different locations are able

742742 were physically present in the same l ocation. If the laws of this
743743 state base the validity of a non -testamentary estate planning
744744 document on whether it is signed, wi tnessed, or attested by another
745745 individual in the presence of the individual signing the document,
746746 the presence requirement shall be satisfied if the individuals are
747747 in each other’s electronic presence.
748748 SECTION 11. NEW LAW A new section of l aw to be codified
749749 in the Oklahoma Statutes as Section 911 of Title 84, unless there is
750750 created a duplication in numb ering, reads as follo ws:
751751 A. Except as provided in subsection B of this section, if the
752752 laws of this state require an electronic non-testamentary estate
753753 planning document to be r etained, transmitted, copied, or filed, the
754754 requirement is satisfied by retaining, transmitting, co pying, or
755755 filing an electronic recor d that:
756756 1. Accurately reflects the information in the document after it
757757 was first generated in final form as an electro nic record or under
758758 Section 12 of this act; and
759759 2. Remains accessible to the extent required by the other law.
760760 B. A requirement under subsection A of this section to retain a
761761 record does not apply to information the s ole purpose of which is to
762762 enable the record to be sent, communicated, or received.
763763 C. A person may satisfy the requirements of subsection A of
764764 this section by using the services of anoth er person.

816816 D. If the laws of this state require a non-testamentary estate
817817 planning document to be pr esented or retained in its original form
818818 or provides consequences if a non -testamentary estate planning
819819 document is not presented or retained in its origin al form, an
820820 electronic record retained in accordance with subsection A of this
821821 section satisfies such requirement.
822822 E. The provisions of this section do not preclude a
823823 governmental agency from specifying r equirements for the retention
824824 of a record subject t o the agency’s jurisdiction in addition to t he
825825 requirements provided in this section. For the purposes of this
826826 section, “governmental agency” means an executive, legislative, or
827827 judicial agency, departmen t, board, commission, authority,
828828 institution, or instrumentality of the federal government or of a
829829 state or of a county , municipality, or other politic al subdivision
830830 of a state.
831831 SECTION 12. NEW LAW A new section of law to be codified
832832 in the Oklahoma Statutes as Section 912 of Title 84, unless there is
833833 created a duplication in numb ering, reads as foll ows:
834834 An individual may cr eate a certified paper copy of an electronic
835835 non-testamentary estate planning document by affirming under penalt y
836836 of perjury that the paper copy is a complete and accurate copy of
837837 the document.

899899 In applying and construing this uniform act, a court shall
900900 consider the promotion of uniformity of the law among jurisdiction s
901901 that enact it.

905905 This act modifies, limits, or superse des the Electronic
906906 Signatures in Global and National Commerce Act, 1 5 U.S.C. Section
907907 7001 et seq., as amended, but does not modify, limit, or supersede
908908 15 U.S.C. Section 7001(c), or au thorize electronic de livery of any
909909 of the notices described in 15 U.S.C. Section 7003(b).

968968 SECTION 17. NEW LAW A new section of law to be codified
969969 in the Oklahoma Statutes as Section 917 of Title 84, unless there is
970970 created a duplication in n umbering, reads as follows:
971971 If a provision of this act or its application to a person or
972972 circumstance is held invalid, t he invalidity does not affect another
973973 provision or application that can be given effect without the
974974 invalid provision.
975975 SECTION 18. This act shall become effective November 1, 2023.
